A Resolution
Authorizing the City Manager to Sign
the Agreement with the Illinois Historic
Preservation Agency for CDBG Programs Affecting
Certain Historic Properties
WHEREAS, the City of Evanston proposes to administer
its Community Development Block Grant (CDBG) program with funds
from the United States Department of Housing and Urban
Development under Title I of the Housing and Community
Development Act of 1974; and
WHEREAS, for the purposes of this agreement, the City's
CDBG program (Program) encompasses the following activities:
City Single -Family Loans, City Multi -Family Loans, City
Conservation Grants, City Downtown Facades, City Neighborhood
• Facades, Minor Repairs, and other Building Rehabilitations;
WHEREAS, the City has determined that the
administration of its program may have an effect on properties
included in or eligible for inclusion in the national Register of
Historic Places and has consulted with the Illinois State
Historic Preservation office and the Advisory Council on Historic
Preservation (Council) pursuant to 36 CFR 800.13 of the
regulations implementing Section 106 of the National Historic
Preservation Act, 16 U.S.C. 470f;
WHEREAS, the City, the Illinois State Historic
Preservation office and the Council have agreed that the Program
shall be administered in accordance with certain stipulations to

satisfy the City's Section 106 responsibilities for all
individual undertakings of the Program;

WHEREAS, the stipulations are contained in the
Programmatic Agreement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the City Manager is hereby authorized
and directed to sign the aforesaid
Programmatic Agreement, and to negotiate additional terms as may
be necessary and desirable.
SECTION 2: This Resolution shall be in full force and
effect from and after the date of its
passage and approval in the manner provided by law. V.

PROGRAMMATIC :AGREEMENT

COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
WHEREAS, the City of Evanston, Illinois (City), proposes to administer
its Community Development Block Grant (CDBG) program with funds from the
U.S. Department of Housing and Urban Development under Title I of the
Housing and Community Development Act of 1974; and
WHEREAS, for the purposes of this agreement, the City's CDBG program
(Program) encompasses the following activities: City Single -Family
Loans, City Multi -Family Loans, City Conservation Grants, City' Downtown
Facades, City Neighborhood Facades, ENAW Minor Repairs, and other
Building Rehabs; and
WHEREAS, the City has determined that the administration of its program
may have an effect on properties included in or eligible for inclusion
in the National Register of Historic Places and has consulted with the
Illinois State Historic Preservation Officer (SHPO) and the Advisory
Council on Historic Preservation (Council) pursuant to 36 CFR 800.13 of
the regulations implementing Section 106 of the National Historic
Preservation Act (16 U.S.C. 470f);
NOW, THEREFORE, the City, the SHPO and the Council agree that the
Program shall be administered in accordance with the following
stipulations to satisfy the City's Section 106 responsibilities for all
individual undertakings of the Program.
STIPULATIONS
The City shall ensure that the following measures are carried out:
1. The City shall employ a Preservation Coordinator responsible for
the implementation of the Agreement who meets the minimum
professional qualifications outlined in the Secretary of the
Interior's "Professional Qualifications Standards". This staff
person shall receive annual education and training in the
principles and methodologies of preservation practices.
2. The City shall continue to update its citywide survey of historic
properties to identify additional properties that may be eligible
for the National Register of Historic Places. The City shall ensure
that the survey continues to meet the Secretary of the Interior's
"Standards for Survey and Planning".
3. Properties that are listed on the National Register, included in
National Register historic districts as contributing properties, or
are determined to meet one or more criterion for the National
Register, shall be treated in the following manner:
a. Properties that are to be rehabilitated will be rehabilitated
in accordance with the recommended approaches of the Secretary
of the Interior's "Standards for Rehabilitation and
Guidelines for Rehabilitating Historic Buildings" (Standards).
Rehabilitation accomplished in this manner will have no
• adverse effect on such properties and further compliance will
not be necessary.

b. The City will retain the documentation,*.including work -w ita�
ups and before. and after photographs -."in their files a*s •
evidence of compliance with the Standards.-
c. If the Standards cannot be met, or if the contemplated action
could have an indirect adverse effect on the property, prior
to taking any action, the City will consult with the Illinois
State Historic Preservation Officer and obtain the comments of
the Council in accordance with 36 CFR part 800.6(b) of the
Council's regulations.
The City shall ensure that a report on all activities carried out
pursuant to this agreement is provided annually to the SHPO and,
upon request, to interested parties. I

5. This agreement shall remain in effect for federal fiscal years 1992
through 2002. From time to time during that period, the SHPO.:shall
monitor the City of Evanston's CDBG program to ensure that:the
terms of this agreement are being adequately carried out.
6. Nothing in this agreement shall prevent the City from seeking -the
advice of the SHPO on any activity carried out pursuant to this
agreement or from requesting technical assistance from the SHPO at
any time.
7. Any party to this Agreement may request that it be terminated or
amended, whereupon the parties will consult in accordance with'36
CFR 800.13 to consider such amendment. `

Execution and implementation of this Programmatic Agreement and carrying
out its terms evidences that the City has afforded the Council a
reasonable opportunity to comment on the Program and that the City,:has
taken into account the effects of the Program on historic properties.

F."HEREAS, the City of Evanston is and has been an entitlement coamuiiity: :.
since;;1975 for a Community Development Block Grant Program and anticipates;
receiyirg funds for fiscal years 1984-88 through the Department of Housing and-
Urba_zn::Development, and
WHEREAS, HUD has delegated to the City of Evanston its responsibility
for seeking comments of the Advisory Council on Historic Preservation pur-_,z--
suant*,to the Housing and Community Development Act of 1977, and
w'HEREAS, the City of Evanston has determined, in consultation with the
Illinois State Historic Preservation Officer, that the Comm`ty Development
Block Grant Program will have an effect on properties inauded,tn or:eligi
ble'for-inclusion in the National Register of Historic:Places•:and_has:..re
quested' the comments of the Advisory Council on His toric--Preservatioa:
pursuant to section 106 (and section11OF) of the National. Historic Preser-
vation Act (16 U.S.C. 470) and its implementing regulations, "Protection of
Hist,otic and Cultural Properties (36 CFR Part 800).
"NOW THEREFORE, the City of Evanston., the Illinois State Historic
Preservation Office and the Advisory Council on Historic Preservation agree
that-.the.Evanston CD3G Program during the period 1984-88, shall be imple-
mented in accordance with the following stipulations in order to take into
account the effect of the undertaking on historic properties.

the Memorandum shall be undertaken to identify properties that might meet the
criteria for listing in the National Register of Historic Places. The survey
shall be conducted in consultation with the State Historic Preservation
Officer and will take into account the professional standards identified in the
Advisory Council's current Manual on M-itization Measures:

Register, potentially eligible for the National Register, or are included in
the National Register either singly or within historic districts will be
treated in the following manner:
a. Properties that are to be rehabilitated will be rehabilitated
in accordance with the recommended approaches in "The Secre-
tary of the Interior's Standards for Rehabilitation and
Guidelines for Rehabilitating Historic Buildir.._.s" (Standards) .
Rehabilitation accomplished in this manner wil: have no adverse
effect on such properties and further compliance will not be
necessary.
