HomeMy WebLinkAboutRESOLUTIONS-1990-050-R-909/5/90 50-R-90 A RESOLUTION Authorizing the City Manager to Enter into an Easement Agreement with the Reba Church • WHEREAS, the Reba Place Church of 727 Reba Place, Evanston, Illinois has requested an easement for construction and maintenance of an entrance step and bushes located at 611 South Boulevard on City of Evanston property; and WHEREAS, the legal description of subject easement is: That Part of Custer Avenue described as follows: Commencing at the Southwest corner of Lot 13, Block 8 of Keeney and Rinn's Addition to Evanston, being the South 1/2 of the South 1/2 and the South 1/2 of the North 1/2 of the South 1/2 of the N.E. 1/4 of Section 19-41-44, also all of the North 1/2 of the North 1/2 of the South 1/2 of the SouthEast 1/4 of Section 19, Township 41 North, Range 14 East of the Third Principal Meridian, thence Northerly along the West line of said Lot 13, a distance of 99.25 feet, thence West at right angles to the last described line a distance of 1.50 feet, thence Southerly parallel to the West line of said Lot 13 to the intersecting point on North line of South Boulevard; thence easterly along the north line of South Boulevard, to the point of beginning, all in Cook County, Illinois. WHEREAS, Reba Place Church has agreed to indemnify • and hold harmless the City of Evanston; and • WHEREAS, the City Council of the City of Evanston does find that there will be no detriment to the public use of said property by the construction and maintenance of said entrance step and bushes. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS that the City Manager be and hereby is authorized to enter into an easement agreement for twenty years with the Reba Place Church for and in consideration of Three Hundred Dollars ($300.00) for the construction and maintenance of entrance step and bushes as set forth in a drawing dated August 22, 1990, marked as Exhibit A and attached hereto and incorporated by reference and to take 1 50-R-90 , those steps necessary for the facilitation of said construction. Mayor • ATTEST: City Clerk Adopted: .% , 1990 • • 2 Grant of Easement The Grantor, City of Evanston, ("City"), an Illinois municipal corporation, in consideration of the sum of $300.00 (three hundred dollars), and other valuable consideration, the • receipt of which is hereby acknowledged, gives and grants to the Reba Place Church of 727 Reba Place, Evanston, Illinois, a twenty year easement for the purpose of construction and maintenance of an entrance step and bushes located on City property at 611 South Boulevard as set forth in Exhibit A attached hereto and made a part hereof, and further gives to Grantee the right of access to such easement for said purposes on property situated in Cook County, Illinois, legally described as follows: That Part of Custer Avenue described as follows: Commencing at the Southwest corner of Lot 13, Block 8 of Keeney and Rinn's Addition to Evanston, being the South 1/2 of the South 1/2 and the South 1/2 of the North 1/2 of the South 1/2 of the N.E. 1/4 of Section 19-41-44, also all of the North 1/2 of the North 1/2 of the South 1/2 of the SouthEast 1/4 of Section 19, Township 41 North, Range 14 East of the Third Principal Meridian, thence Northerly along the West line of said Lot 13, a distance of 99.25 feet, thence West at right angles to the last described • line a distance of 1.50 feet, thence Southerly parallel to the West line of said Lot 13 to the intersecting point on North line of South Boulevard; thence easterly along the north line of South Boulevard, to the point of beginning, all in Cook County, Illinois. This grant of easement and right of access are made subject to the condition that Grantee shall comply with the following conditions: 1. Grantee shall, at its expense, restore to at least the same condition the property subject to the easement, as well as adjoining property, within a reasonable time after Grantee has altered or damaged the property while constructing and/or maintaining the said entrance step and bushes. 2. Grantee shall, at its expense, repair or replace pipes, wires, or any other property in any utility which may be damaged in any way while Grantee is constructing and/or maintaining the step and bushes. 3. Grantee further agrees to indemnify and hold harmless and defend Grantor from any and all claims, damages, • and judgments arising out of, or in connection with, this grant of easement.
