A RESOLUTION
Authorizing the Acquisition of Property by
Condemnation or Otherwise for Alley Purposes
WHEREAS, the City Council of the City of Evanston is
• empowered, pursuant to the Illinois Revised Statutes, to
acquire, by purchase or eminent domain, real property for alley
purposes; and
WHEREAS, the City Council has considered the necessity
for and acquisition of the real property legally described in
Section 1 ("subject property") for alley purposes and has
determined that it is necessary to acquire the subject property
for alley purposes, pursuant to the Illinois Revised Statutes;
and
WHEREAS, the acquisition of the subject property is
useful, advantageous and desirable for alley purposes; and for a
public purpose and the public welfare.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
• Section 1: That under the authority vested in the City
Council of the City of Evanston through the statutes of the
State of Illinois, it is hereby determined that it is necessary
and desirable that the City of Evanston shall acquire title to
and possession of the subject property legally described as:
Parcel 1
The West 40 feet of Lot dl and Lot 12 except the North
Twelve (12) feet of Lot 12 in Block 15 of the Village of
Evanston, in the Northeast 1/4 of fractional Section 18,
Township 41 North, Range 14 East of the Third Principal
Meridian in Cook County, Illinois.
Parcel 2
The West 40 feet of Lot 12 except the South 54 feet of
Lot 12 in Block 15 of the Village of Evanston, in the
Northeast 1/4 of fractional Section 18, Township 41
North, Range 14 East of the Third Principal Meridian in
Cook County, Illinois.
• which property is necessary, required and needed for alley
purposes and which property lies wholly within the limits of the
City of Evanston.

Section 2: That the City Manager of the City of
Evanston be and is hereby authorized, empowered and directed to
negotiate for and on behalf of the City of Evanston with the
owner or owners of the subject property for the purchase of the
subject property thereof at fair market value by the City.
• Section 3: That in the event that the City Manager is

unable to agree with the owner or owners of the subject property
as to the compensation to be paid therefor, fee simple title to
and possession of the subject property shall be acquired by the
City of Evanston through condemnation, and the law firm of Burke
and Ryan, as attorneys for the City of Evanston, is hereby
authorized, empowered and directed to institute proceedings in
any court of competent jurisdiction to acquire fee simple title
to and possession of said subject property for City of Evanston
in accordance with the Illinois Revised Statutes and eminent
domain laws of the State of Illinois.
Section 4: That this Resolution shall take and effect
and be in full force from and after its passage as provided by
law.
