HomeMy WebLinkAboutRESOLUTIONS-1987-062-R-8761 R-87 A RESOLUTION_ ,i Authorizing the City Manager to Enter into a Lease in re Parking Space in City Parking i' Lot 46 at 1616 Sherman Avenue , WHEREAS, The City of Evanston is the owner of real property commonly known as City Parking Lot 46 and located i at 1616 Sherman Avenue; and WHEREAS, the City Council of the City of Evanston finds that the continued lease of a portion of said parking facility in its present manner is appropriate, profitable i i; to and in the best interest of the City of Evanston; and WHEREAS, the City Council finds that in 1982 the 1' Zoning Board of Appeals granted a variation from the off- street parking regulations of the Zoning Ordinance to permit I the leasing of forty-one (41) parking spaces in said Lot ' 46 at 1616 Sherman Avenue, which is approximately 1200 feet from the subject property, in order to fulfill the off-street parking requirements of the Evanston Zoning • Ordinance as they apply to the use of a portion of 500 Davis Street as medical offices; and WHEREAS, the City Council finds that in 1987 the Zoning Board of Appeals has granted a variation from the off-street parking regulations of the Zoning Ordinance to permit the leasing of fifteen (15) additional parking spaces in Lot 46 at 1616 Sherman Avenue, which is approxi- matlely 1200 feet from the subject property, in order to fulfill the off-street parking requirements of the Evanston i Zoning Ordinance as they apply to the expansion of the medical offices within the 500 Davis StreetOBuilding; and WHEREAS, Davis Street Venture, an Illinois limited i partnership, owner of the property located at 500 Davis Street has proposed to relet the forty-one (41) parking i 4� spaces in said Lot 46 at 1616 Sherman Avenue; and I WHEREAS, Davis Street Venture, an Illinois I i limited partnership, owner of the property located at 500 Davis Street, proposes to lease the additional fifteen (15) • parking spaces; and WHEREAS, the City Council of the City of Evanston finds that the best interests of the City of Evanston would a' be served by renewing the original lease and entering into the new lease agreement; and WHEREAS, the .fifteen (15) additional parking ,P g !: spaces are available for and have been.reserved for the Davis Street Venture for the property at 500 Davis Street; I, i; NOW, THEREFORE, BE IT RESOLVED BY THE'CITY,.'COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: The City Manager is hereby authorized j� and directed. to'sign, and the City Clerk is hereby authorized and directed to attest on behalf j� of the City of Evanston a lease by and between the City of Evanston as Lessor and Davis Street Venture as Lessee for l !; the property consisting of fifty-six (56) parking spaces " in the parking lot located at.1616 Sherman Avenue, Evanston, i Illinois, and known as Parking Lot 46, and described as i follows: Lots 15, 16, 17,18, 33, 34, 35, 36 and that portion of the 24 foot Public:Alley having been vacated 10 feet north of the (� north line of Lots 15 and 36, 10' south i of the south line of lots 18 and 33, and all portions in between in block 65 of the Village of Evanston; all in the SW 1/4 of Section 18, Township 41 North, Range j 14 East of the Third Principal Meridian in the City of Evanston, County of Cook, State of Illinois. �E ij • �I ,1 i -2- i SECTION 2: That the lease to be executed �i by and between the City of Evanston and Davis Street Venture shall be: I; (a) for a period of five (5) years; or • (b) until adequate qualified parking spaces are provided elsewhere meeting all the requirements of the City's Zoning Ordinance; or I' (c) until the termination of the occupancy at 500 Davis Street of the PruCare medical facility, and that the leases shall provide provisions for renewal at the appropriate time if necessary. li i SECTION 3: This Resolution shall be in full force and effect from and after its.passage and approval in the manner provided by law. ATTEST..- City .lerk -- I Adopted:. ..........�!, 1987 ,I I ,i -3- f� �i i j l� , PARKING SPACE LEASE This agreement made this 1st day of September, 1987, by and between the City of Evanston, a Municipal Corporation (LESSOR), and the Davis Street Venture (LESSEE), an Illinois limited partnership for the purpose of compliance with ZBA 87-6-V(F) and 28 A 81-44-V(F). WITNESSETH: LESSOR, for and in consideration of the covenants and agreements set forth herein, does hereby lease to LESSEE parking spaces located on the roof of the parking lot commonly known as Parking Lot No. 46 located at 1616 Sherman Avenue, Evanston, Illinois, under the terms and conditions set forth as follows: 1. That the term of the lease shall begin October 1, 1987, or prior to the issuance of a Certificate of Occupancy, whichever is sooner, and shall end upon the earlier to occur of: (a) the termination of the occupancy at 500 Davis Street of the PruCare medical facility; or (b) untiladequate qualified parking spaces are provided elsewhere; or five (5) years from the commencement of the rental term. 2. The LESSOR agrees to lease to the LESSEE a total of fifty-six (56) parking spaces located on the roof of the aforedescribed Lot No. 46. 3. That in consideration for the lease of said parking spaces LESSEE agrees to pay LESSOR monthly rent of Forty Dollars ($40.00) per space, for a total of Two Thousand Two Hundred Forty Dollars ($2,240.00) per month, payable on the first of each month to the City Collector but i mailed to Parking System, City of Evanston, 2100 Ridge Avenue, Evanston, Illinois 60204. That aforesaid rent may be increased at any time to equal the general monthly M 0 • • il parking rental rate per space for said Lot 46. 4. LESSOR reserves the right to designate by any means it chooses those parking spaces issued pursuant to this agreement; and to change the location of those spaces within the designated lot at its discretion upon written notice of such relocation to the LESSEE. 5. That LESSEE agrees to defend LESSOR or to pay the cost of defense of LESSOR and to indemnify and hold harmless LESSOR from the payment of any sum or sums of money, to any persons whomsoever on account of all claims, actions or suits growing out of injuries to persons or property arising out of or.in the course of LESSEE's use of the aforesaid parking spaces, except for injuries to persons or property. arising out of the negligence or wilful misconduct of LESSOR. 6. That LESSEE agrees to conform to the reasonable requirements and regulations of the LESSOR upon written notice thereof, relating to the use of said spaces. 7. That LESSEE agrees to limit its use of the aforedescribed parking spaces to the parking of motorized passenger vehicles licensed to carry ten (10) or,fewer passengers. 8. That LESSOR agrees to consider renewal of this lease upon the request of the LESSEE, but no later than six (6) months prior to the termination of this lease.
