A RESOLUTION
Authorizing the Acquisition of Property
Through Condemnation or Otherwise for
Off -Street Parking Purposes
WHEREAS, the City Council has determined that the
construction of an off-street parking facility and necessary
adjuncts would be in the best interests of the res,idents of the
City of Evanston and would be a public purpose; and
WHEREAS, the construction of such facilities would
increase business for commercial ventures currently established
within the City, would strengthen the property and non -property
tax and income bases, and would provide jobs for City
residents; and
WHEREAS, the exercise of the City's powers of eminent
domain required in order to condemn or purchase the site for an
off-street parking facility and necessary adjuncts are
contained in the Illinois Revised Statutes.,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That it i.s hereby determined that
an off-street parking facility and
necessary adjuncts be acquired; constructed, managed,
controlled, maintained and operated within the corporate limits
of the City of Evanston on the real property legally described
in Exhibit A which is attached hereto and made a part hereof
and that said off-street parking facility and necessary -
ad
juncts be used, occupied, improved and developed in a manner
necessary and convenient for public use.
SECTION 2: That under the authority vested
in the corporate authorities of the City
of Evanston through the statutes of the State of Illinois, it

is hereby determined that it is necessary and desirable that
the City shall acquire title to and possession of the real
property legally described'in attached Exhibit A, which real

property is necessary, required and needed for an off-street
parking facility and necessary adjuncts and which real property
lies wholly within the limits of the City of Evanston.
SECTION 3: That the City Manager of the City
of Evanston or his designees, be and they
are hereby authorized, empowered and directed to negotiate
personally or through their representatives for and on behalf
of said City with the owner or owners of the hereinabove

described real property for the purchase and acquisition
thereof by said City.
SECTION 4: That in the event the City Manager
or his designee are unable to agree with
the owner or owners of said real property as to the
compensation therefor, then title to and possession of the real
property legally described in attached Exhibit A shall be
acquired by the City of Evanston through condemnation, and the
City Manager or his designee are hereby authorized, empowered
and directed to institute proceedings.in any court of competent
jurisdiction to acquire title to and possession of the real
property legally described in attached Exhibit A for the CiI ty
in accordance with the eminent domain laws of the State of
Illinois.
SECTION 5: This resolution shall take effect
and be in full force from and after its
passage.
