HomeMy WebLinkAboutRESOLUTIONS-1985-067-R-859/5/85 67-R-85 A RESOLUTION Authorizing the City Manager to • Enter into a Lease Agreement for the Use of Parking Spaces by Northwestern University -- WHEREAS, the City of Evanston currently owns property west of Maple Avenue between University.Place and Clark Street; and WHEREAS, Northweste'n University is currently constructing a Basic Industry Research Laboratory on property east of Maple Avenue between University Place and Clark Street; and �i j WHEREAS, the Basic Industry Research Laboratory will have a i parking requirement of between 160 and 200 parking spaces that cannot be �I ;j provided on the building site; and WHEREAS, The City Council finds that the best interest of the • j City of Evanston and its residents will be served by the leasing of City i i property for interim parking to be used by employees and visitors of the ;I Basic Industry Research Laboratory; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: I i� SECTION 1: The City Manager is hereby authorized and directed to execute and the City Clerk is hereby authorized ;i to attest, on behalf of the City of Evanston: a lease by and between the City of Evanston, as Lessor, and Northwestern University, as Lessee, for between 160 and 200 parking spaces on City -owned land located west of Maple Avenue between University Place and Clark Street for the purpose of ii satisfying the parking requirement of the Lessee's Basic Industry Research • Laboratory. SECTION 2: The exact number of spaces is to be- determined by the City of Evanston's parking regulations which are in effect when buildinq permits for said Laboratory are issued. 67-R-85 SECTION 3: The lease term shall commence immediately prior to the issuance of a Certificate of Occupancy for said Laboratory and shall end upon adequate, qualified parking spaces being provided elsewhere. • SECTION 4: The City Manager is authorized and directed to negotiate any additional terms and conditions on the lease agreement as may be determined to be in the best interests of the City. • SECTION 5: This Resolution shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. i Adopted: i 1985 i I' j ATTEST: i - J City Clerk Mayor p/L& TLC • • 11 PARKING SPACE LEASE , This agreement made this Zgkday of K 1985, by and between the City of Evanston, a Municipal Corporation (LESSOR), and Northwestern University, an Illinois Corporation, (LESSEE). �.WITNESSETH: LESSOR, for andf n consideration of the covenants and agree-,%,w "4 ments set forth herein, -.do -es hereby lease to LESSEE parking spaces located in the parking lot at Maple Avenue and University Place, Evansto6, Illinois, under the terms and conditions set forth as follows: 1. That.the term of the lease shall begin immediately prior to the issuance of a Certificate of Occupancy for LESSEE's Basic Industry Research Laboratory at the northeast corner of Maple Avenue and Clark Street and shall end upon adequate, qualified parking spaces being provided elsewhere. 2. That LESSOR agrees to lease to the LESSEE a total of not fewer than 160 or more than 200 parking spaces in the aforedescribed Lot as determined by current parking regulations in effect when building permits for said Laboratory are issued. 3. That in consideration for the lease of said parking spaces LESSEE agrees to pay LESSOR monthly rent of Fifteen Dollars ($15.00) per space per month, payable on or before the first of each month. :Payment should be mailed to the Parking System, City of Evanston, 2100 Ridge Avenue, Evanston, Illinois 60204-0832, and should be made payable to the City Collector. The aforesaid rent may be increased at any time to equal the general monthly parking rental rate per space for said Lot. • • 0 4. LESSOR reserves the right to designate by any means it chooses those parking spaces leased pursuant to this agreement; and to change the location of those spaces within the designated lot at its discretion upon at least 30 days written notice of such relocation to the LESSEE: 5. That LESSEE agre, to defend LESSOR or to pay the cost of defense of LESSOR and to indemnify and hold harmless LESSOR from the payment of any sum or sums of money, to any persons whomsoever on j account of all claims, actions or suits growing out of injuries to persons or property arising out of or in the course of LESSEE's use of the aforesaid parking spaces, except for injuries to persons or property . arising out of the negligence or wilful misconduct of LESSOR. 6. That LESSEE agrees to conform to the reasonable require- ments and regulations of the LESSOR upon written notice thereof, relating to the use of said spaces. 7. That LESSEE agrees to limit its use of the aforedescribed parking spaces to the parking of motorized vehicles for ten passengers or less. 8. In the event the number of parking spaces required for the Basic Industry Research Laboratory is reduced, by amendment to the parking regulations or otherwise, the number of leased spaces provided for fierein shall be adjusted accordingly. 9.
