HomeMy WebLinkAboutRESOLUTIONS-1984-084-R-8411/7/84 • U i • 84-R-84 A RESOLUTION Authorizing the City to Enter into a Lease for Parking Lot No. 60 WHEREAS, the City of Evanston has leased a private parking lot at 1234 Chicago Avenue; and WHEREAS, the lease for said lot has expired; and WHEREAS, it is in the best interests of the City of Evanston and its residents that off-street parking be maintained in the area of Chicago Avenue and Dempster Street; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That the City Manager is hereby authorized and directed to sign and the City Clerk is hereby authorized to attest on behalf of the City of Evanston a lease by and between the City of Evanston as ! Lessee and Richard Johnstcne as Lessor for a certain parking lot located at 1234 Chicago Avenue and legally described as: Lots 1, 2, and 3 in F.B. Brewer's Subdivision of the South 137 feet of the North 312 feet of Block 1 of Snyder's addition to Evanston's subdivision of the North one-half of the Northwest one -quarter, East of Railroad and West of Chicago Avenue of Section 19, Township 41, North Range 14, East of the Third Principal Meridian, City of Evanston, Cook County, Illinois for a term of one year and at a rental of Sixteen Hundred Dollars. ($1,600) per month. SECTION 2: This lease shall be in substantial conformance with the proposed lease attached hereto as Exhibit A. SECTION 3: The City Manager is hereby authorized and i directed to negotiate any additional conditions on the lease as may be determined to be in the best interests of the City. ATTEST: City Clerk Adopted: , 1984. • U • L E A S E THIS INDENTURE made this � day of ' �'� �' 1984, by and between Richard Johnstone, hereinafter referred to as Lessor, and the City of Evanston, a municipal corporation, hereinafter referred to as Lessee. W I T N E S S E T H Lessor, for and in consideration of the covenants and agreements hereinafter mentioned to be kept and performed by Lessee, does hereby lease to Lessee the premises hereinafter described, for a term commencing November 1, 1984 and expiring October 31, 1985. Said premises are to be used by Lessee as a part of its off-street parking system and are legally described as: Lots 1, 2, and 3 in F.B. Brewer's Subdivision of the South 137 feet of the North 312 feet of Block 1 of Snyder's addition to Evanston's Subdivision of the North one-half of the Northwest one -quarter, East of Railroad and West of Chicago Avenue of Section 19, Township 41, North Range 14, East of the Third Principal Meridian, City of Evanston, Cook County, Illinois. These premises are commonly described as 1234-1238 Chicago Avenue, Evanston, Illinois. 1. Lessee shall have the right to operate and to maintain at Lessee's expense facilities for parking of autcn-obiles by the public for a fee and for that purpose Lessee at its expense shall maintain the lot. Lessee shall have the right to remove portions of the fencing along the northern boundary of the property at Lessee's expense. Lessee shall provide snow removal and police enforcement at its expense. Lessee shall make minor repairs to maintain the existing surface of the lot in good condition. Lessee may install signs and make grading and similar improvements during the lease term. 2. Lessee agrees to hold Lessor harmless from any public liability or property damage arising out of or in the course of its operation of said off- street parking facility permitted under the terms of this lease. Lessee agrees to furnish Lessor with a certificate of self-insurance, if required, showing public liability bodily injury limits of not less than $500,000/$1,000,000 and property damage of not less than $100.000. 3. Lessee shall have the right to use the private driveway adjacent to the northern side of the parking facility also owned by Lessor for the purpose of ingress and egress from the parking lot during the duration of the lease term. 4. Lessee agrees to pay as rental for the use of the premises and the private d_rive"ay One Thousand Six Hundred Dollars ($1,600.00) per • month. The rental fee under this contract may be renegotiated during the term of this contract to reflect actual and substantiated increases in Lessor's actual costs for property taxes based upon the assessed property value. 5. This lease may be renewed for one (1) additional term for one vear by mutual consent of the parties hereto, and the rent and other pro- visions of this lease shall be subject to renegotiation and revision at the beginning of each new lease period. The Lessee, not less than ninety (90) days before the end of the lease period, shall notify the Lessor in writing as to whether it wishes to renew the lease and shall set forth any amendments to the lease it deems desirable. 6. This lease may be terminated by either party with a ninety (90) day written notice. Upon ternination of this lease, the Lessee shall remove from the area so leased within a reasonable time all removable signs and posts which it has installed and shall restore the fencing along the northern property boundary to the quality of the fencing which lies adjacent and contiguous thereto. All notices required shall be by registered mail. 7. Any notices to Lessor shall be addressed to Richard Johnstone, 230 Lexington Drive, Buffalo Grove, Illinois 60090, and those to Lessee shall be • addressed to the City Manager, 2100 Ridge Avenue, Evanston, Illinois 60204. IN WITNESS WHEREOF, the parties hereto have executed this lease the date first above written, each being duly authorized for the uses and purposes herein stated.
