HomeMy WebLinkAboutRESOLUTIONS-1984-024-R-84• 2/23/84 24-R-84 A RESOLUTION Authorizing the City Manager to Enter into a Lease Regarding Parking Spaces in City Parking Lot 46 at 1616 Sherman Avenue WHEREAS, the City of Evanston is the owner of real property and commonly known as City Parking Lot 46 and located at 1616 Sherman Avenue; and WHEREAS, said property is presently used for public off-street parking facilities; and WHEREAS, the City Council of the City of Evanston finds that the continued use of a portion of said property as a public off-street parking +; facility in its present manner is no longer necessary, appropriate required �! for the use of, profitable to, or in the best interest of the City of Evanston; and WHEREAS, the City Council finds that the Zoning Board of Appeals has granted a variation from the off-street parking regulations of the Zoning Ordinance to permit the leasing of forty-one (41) parking spaces in Lot 46 at 1616 Sherman Avenue, which is approximately 1,200 feet from the subject property, in order to fulfill the off-street parking requirements of the Evanston Zoning Ordinance as they apply to the use of a portion of 500 Davis Street as medical offices; and WHEREAS, Davis Street Venture, an Illinois limited partnership, owner of the property located at 500 Davis Street, has proposed to lease forty-one (41) parking spaces in said Lot 46 at 1616 Sherman Avenue; and i !i ! WHEREAS, the City Council of the City of Evanston finds that the j; best interests of the City of Evanston would be.served by such a lease; and WHEREAS, such a lease entered on March 15, 1982, was entered into by and between the City of Evanston,as Lessor, and Davis Street Venture, as i! Lessee; and 4 2/23/84 1A:1! �j WHEREAS, Davis Street Venture, Lessee, is desirous of selling the property located at 500 Davis Street; and �i �j WHEREAS, there exists uncertainty as to whether the March 15, 1982, �f lease is assignable; is NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF z H EVANSTON, COOK COUNTY, ILLINOIS: i I� i; SECTION 1: The City Manager is hereby authorized and directed to sign, and the City Clerk is hereby authorized and directed to attest on behalf of the City of Evanston a lease by and between i the City of Evanston as Lessor and Davis Street Venture as Lessee for the property consisting of forty-one (41) parking spaces in the parking lot located at 1616 Sherman Avenue, Evanston, Illinois, and known as Parking Lot 46, and described as follows j Lots 15, 16, 17, 18, 33, 34, 35, 36 and that portion of the 24 foot Public Alley having been vacated 10 feet North of the North Line of Lots 15 and 36, 10 feet South of the South line of Lots 18 and 33, and all portions in between in Block 65 of the Village of Evanston; all in the Southwest 1/4 of Section 18, Township 41 North Range 14 East of the Third Principal Meridian in the City of Evanston, County of Cook, State of Illinois. SECTION 2: That the lease to be executed by and between the City of Evanston and Davis Street Venture shall be: (a) for a period of five (5) years; or (b) until adequate qualified parking spaces are provided elsewhere meeting all the requirements of the City's Zoning Ordinance; or (c) until the termination of the occupancy at 500 Davis of the PruCare medical facility, and that the lease shall provide provisions for renewal at the appropriate time, if necessary. li SECTION 3: This resolution shall be in full force and effect from and after its passage and approval in the manner �1 i. 11 provided by law. `/G'MaY9101, ATTEST: i City Clerk Adopted: �, 1984 �� -2-
