A RESOLUTION
Granting an Easement for Ingress and Egress
Purposes to a Portion of City of Evanston
Roadway located in Deering Park,
:! Evanston, Cook County, Illinois.

WHEREAS, Margaret Kreml, the property owner of
11certain real estate located at 2651 Sheridan Road in Evanston,
,
'Illinois has requested an easement from the City of Evanston
11for ingress and egress purposes only to a 60-foot portion of
'+roadway on City of Evanston property legally described as -
follows:
Lot 5 and that part of Lot 6 lying North of a line
beginning at a point on the Westerly line of said lot 6
which is 6 feet Northwesterly of the Southwesterly
corner thereof as measured on the Westerly line of said
lot and extending East parallel to the South line of
Lot 6 and said South line extended all in Block 5 in
Charles E. Brown's Lake Grove Addition to Evanston,
said Addition being a subdivision of parts of Lots 35,
36, 37 and 38 in Baxter's Subdivision and parts of Lots
23, 24 and 25 in Smith's Subdivision in .the South part
of Ouilmette Reservation in Township 42 North, Range
13, East of the Third Principal Meridian, and also all
lands, if any, including any accretions lying
Eastwardly of the above described premises and between
the North and South lines thereof extended Eastwardly
to the present (May 1, 1959) Westerly line of the
water's edge of Lake Michigan as it exists when free
from natural disturbing causes, excepting that part of -
said lots 5 and 6 described as follows: beginning at
the Northwest corner of said Lot 5, thence
Southeasterly along the Southwesterly line of said lots
5 and 6, 172 feet to the Southwesterly corner of lot
"A" of. Owner's Subdivision of part of said lots 5 and 6
as shown on the plat of said lot "A" recorded September
17, 1956 as document number 16,699.947, thence
Northeasterly along the Southeasterly line of said lot
"A'"_132 .feet to the Southeasterly corner of said lot,
thence Northeasterly along a line forming an angle of
165 degrees 01 minutes 40 seconds measured from West to
South to East with the Southeasterly line of said lot.
"A", a distance of 95.47 feet, thence North along a
line perpendicular to the South line of lot 5 aforesaid
to the North line of said lot, thence westerly along
said North line to the place of beginning; and
WHEREAS, when the City of Evanston acquired said
• ilproperty by court order through condemndation proceedings in
;11970, it was subject to an existing easement over the same

jroadway in favor of owners of another property also contiguous

to said roadway; and
WHEREAS, the owner of 2651 Sheridan Road requires
('said easement for ingress to and egress from her property; and
WHEREAS, the Grantee of the easement has agreed on
!behalf of herself, her heirs and assigns, to indemnify and hold

harmless the City of Evanston and provide appropriate
insurance, and to contribute tb the City a proportionate share
4 of the cost of maintenance and repair of the roadway, all as
iset forth in the Easement Agreement attached hereto as Exhibit
iI
HA; and
WHEREAS, the City Council of the City of Evanston
finds that there will be no detriment to the public by the
granting of this easement, as the roadway is a private roadway
not accessible or open to the public;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF EVANSTON, COOK COUNTY, ILLI"NOIS:
SECTION 1: That the City Council of the City
of Evanston does hereby authorize the.
E�City Manager to enter into an agreement granting an easement
'for ingress and egress purposes.to Margaret Kreml in return for
!Margaret Kreml's agreement to indemnify, hold harmless and
insure the City of Evanston and pay certain maintenance and
repair costs, all as set forth in Exhibit A attached hereto.
