A RESOLUTION
Authorizing the City Manager to
• Enter Into a Lease for a Parking Lot at
{� 1234 Chicago Avenue
WHEREAS, the private parking lot at 1234 Chicago Avenue has
recently been closed; and
WHEREAS, the closing of said private parking lot has resulted in I
,the loss of approximately forty-four (44) off-street parking spaces in the
!Chicago -Dempster area; and
WHEREAS, merchants and members of the business community in the
Chicago -Dempster area have requested that the City make all efforts to

(provide off-street parking in this area; and
WHEREAS, the Chicago -Dempster Merchants Association has indicated
1;that it will provide a subsidy to the City in the amount of approximately
(;$500.00 per month for the rental of this parking lot; and
!, WHEREAS, the City would utilize this parking lot to develop thirty
• (30) permit spaces at $20.00 per month and maintain fourteen (14) spaces for i
:.customer parking; and
i
WHEREAS, the anticipated revenue from said parking lot is $1,100,
and
WHEREAS, the rental amount of this lot is $1,300; and
I. WHEREAS, the City Council finds that the hest interests of the
City of Evanston and its residents will be served by the lease of this
parking lot by the City,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: The City Manager is hereby authorized and directed to
sign and the City Clerk is hereby authorized to
attest on behalf of the City of Evanston a lease by and between the City
of Evanston, as lessee, and Richard Johnston, as lessor, for a certain
parking lot located at 1234 Chicago Avenue, Evanston, for a term of one

year at a rental of $1,300 per month.
SECTION 2: The lease shall be in substantial conformance with
the proposed lease attached hereto as Exhibit A.
SECTION 3: The City Manager is hereby authorized and directed to
negotiate any additional conditions on the lease as
may be determined to be in the best interests of the City.

LEASE
THIS INDENTURE made this day of ,

j 1983 by and between Richard Johnston, hereinafter referred to as Lessor,
and the City of Evanston, a municipal corporation, hereinafter referred to as
Lessee.
W I T N E S S E T H
Lessor, for and in consideration of the covenants and agreements
hereinafter mentioned to be kept and performed by Lessee; does hereby lease
to Lessee the premises hereinafter described, for a term commencing
September 1, 1983 and expiring August 31, 1984. Said premises are to be
used by Lessee as a part of its off-street parking system and are legally

described as:

The premises are commonly described as Chicago Avenue, Evanston, Illinois
�i 1. Lessee shall have the right to operate and to maintain at
lessee's expense facilities for parking of automobiles by the public for a
,i
j fee and for that purpose Lessee at its expense shall maintain lot. Lessee
I
shall provide snow removal and police enforcement at its expense. Lessee
shall make minor repairs to maintain the existing surface of the lot in good
i
condition. Lessee may install signs and make grading and similar improvements
�i during the lease term.

or..property damage arising out of or in the course of its operation of said
I' off—street parking facility permitted under the terms of this lease caused

directly by the negligence of the City of Evanston.
j 3. Lessee agrees to pay as rental for the use of the premises
i� $1,300.00 per month.
j4. This lease may be renewed for one (1) additional term of one
year by mutual consent of the parties hereto, and the rent and other
provisions of this lease shall be subject to renegotiation and -revision at
the beginning of each new lease period. The Lessee, not less than sixty (60)
h days before the end of the lease period, shall notify the Lessor in writing
•�! as to,wt�ether it wishes to renew the lease and shall set forth any amendments

to the Lease it deems desirable.
5. Upon termination of this lease, the Lessee shall remove from
the area so leased within a reasonable time all removable signs which it
has installed. (All notices required shall be by registered mail.)
6. Any notices to Lessor shall be addressed to Richard Johnston,
1415 Waukegan Road, Northbrook, Illinois 60062, and those -to the Lessee shall
be addressed to the City Manager, 2100 Ridge Avenue, Evanston, Illinois 60204.
�! IN WITNESS WHEREOF, the parties hereto have executed this Lease the
date first above written, each being duly authorized for the uses and purposes
