WHEREAS, the City Council finds that the Zoning Board of f i Appeals has granted a variation from the off-street park.ing regulations of the Zoning Ordinance to permit the leasing of forty-one (41) parking spaces in Lot 46 at 1616 Sherman Avenue, which is approximately 1200 feet from the subject property,in order to fulfill the off-street parking i requirements of the Evanston Zoning Ordinance as they apply to the use of a portion of 500 Davis Street as medical offices; and WHEREAS, Davis Street Venture, an Illinois limited partnership, owner of the property located at 500 Davis St-reet has proposed to lease__ forty-one (41) parking spaces in�s_a-id-Lot 46 at 1616 Sherman Avenue; and WHEREAS, the City Council of the City of Evanston finds that the best interests of the City of Evanston would be served by such a lease. • • • NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS. i SECTION 1: The City Manager is hereby authorized and directed to sign, and the City Clerk is hereby authorized and directed to attest on behalf of the City of Evanston a lease by and between the City of Evanston as Lessor and Davis Street Venture as Lessee for the property consisting of forty-one (41) parking spaces in the parking lot located at 1616 Sherman Avenue, Evanston, Illinois, and known as Parking Lot 46, and described as follows: Lots 15, 16, 17, 18, 33, 34, 35, 36 and that portion of the 24 foot Public Alley having been vacated 10 feet north of the north line of Lots 15 and 36, 10' south of the south line of lots 18 and 33, and all portions in between in block 65 of the Village of Evanston; all in the SW 1/4 of Section 18, Township 41 NOrth Range 14 East of the Third Principal Meridian in the City of Evanston, County of Cook, State of Illinois. SECTION 2: That the lease to be executed by and between the City of Evanston and Davis Street Venture shall be: (a) for a period of five (5) years; or (b) until adequate qualified parking spaces are provided I elsewhere meeting all the requirements of the City's Zoning Ordinance; or (c) until the termination of the occupancy at 500 Davis of the PruCare medical facility, and that the lease shall provide provisions for renewal at the appropriate,tfine` if necessary. SECTION 3: This Resolution shall be in full force and effect ! from and after its passage and approval in the ! manner provided by law. Z4M ATTEST: / /7� Aol-� City Clerk Adopted: 7/1/ 1982 0 PARKING SPACE LEASE This agreement made this day of 1982, by and between the City of Evanston, a Municipal Corporation (LESSOR), and • the Davis Street Venture (LESSEE), an Illinois limited partnership for the is purpose of compliance with ZBA 81-44- V(F). WITNESSETH: LESSOR, for and in consideration of the convenants and agreements set forth herein, does hereby lease to LESSEE parking spaces located on the i 11 , roof of the parking lot commonly known as Parking Lot No. 46 located at I' �j 1616 Sherman Avenue, Evanston, Illinois, under the terms and conditions i set forth as follows: I 1. That the term'of the lease shall begin October 1, 1982 or prior to the issuance of a Certificate of Occupancy whichever i is sooner, and shall end upon the earlier to occur of: , (a) the termination of the occupancy at 500 Davis of the PruCare medical facility; or (b) until adequate j q qualified parking spaces are provided elsewhere; or (c) five (5) years from the commencement of the rental term. 2. That LESSOR agrees to lease to the LESSEE a total of forty-one (41) parking spaces located on the roof of the aforedescribed Lot No. 46. 3. That in consideration for the lease of said parking spaces LESSEE agrees to pay LESSOR monthly rent of Twenty -Five Dollars ($25.00) per space, for a total of One Thousand Twenty -Five Dollars ($1,025.00) per month, payable on or before the first of each month to the City Cnllector, City of Evanston, 2100 Ridge Avenue, Evanston, Illinois 60204. That aforesaid rent may be increased at any time to equal' the general • monthly parking rental rate per space for said Lot No. 46. 4. LESSOR reserves the right to designate by any means it chooses those parking spaces leased pursuant to this agrement; and to change the location of those spaces within the designated lot at its • discretion, upon written notice of such relocation to the LESSEE. 5• That LESSEE agrees to defend LESSOR or to pay the cost of defense of LESSOR and to indemnify and hold harmless LESSOR from the payment of any sum or sums of money, to any persons whomsoever on account of all claims, actions or suits growing out of injuries to persons or property arising out of or in the course of LESSEE's use of the aforesaid parking spaces, except for injuries to persons or property arising out of the negligence wilful misconduct of LESSOR. 6. That LESSEE agrees to conform to the reasonable requirements and regulations of the LESSOR upon written notice thereof, relating to the use of said spaces. • 7. That LESSEE agrees to limit its use of the aforedescribed parking spaces to the parking of motorized vehicles for ten passengers or less. • 8. That LESSOR agrees to consider renewal of this lease upon the request of the LESSEE, but no later than six (6) months prior to the termination of this lease.
