A RESOLUTION
Creating An "Affirmative Action Plan"
Directed Toward the Utilization of
Lower Income Evanston Residents,
Evanston Small Businesses and Minority
Businesses in the Implementation Of The
1981-82 Community Development Block Grant
Program
WHEREAS, the City of Evanston did apply for and received a 1981
Community Development Block Grant from the U.S.Department of Housing and
Urban Development; and
WHEREAS, the City Council of the City of Evanston did authorize
and direct the City Manager to sign all necessary certifications and
assurances in applying for said block grant, pledging that Evanston will
conduct the program in conformity with Title VI of the Civil Rights Act
of 1964, Title VIII of the Civil Rights Act of 1968, Section 109 of the
Housing and Community Development Act of 1974, Executive Order 11246,
Executive Order 11063, and Executive Order 11625; and
WHEREAS, the Community Development Block Grant assurance requires
among other things, that the City of Evanston comply with 24 CFR Part
135, Employment Opportunities for Businesses and Lower Income Persons
in Connection with Assisted Projects, and Utilization of Minority Busi-
nesses; and
WHEREAS, 24 CFR Part 135 directs the City of Evanston to develop
a "Section 3 Affirmative Action Plan" which identifies the maximum feasi-
ble use of lower income Evanston residents and eligible business concerns,
which qualify as small under the small business size standards of the
Small Business Administration, in the implementation of its grant pro-
gram; and
WHEREAS, Executive Order 11625 mandates increased utilization of
minority businesses; and the U.S. Department of Housing and Urban De-
velopment (HUD) has recommended the adoption of goals for participation
by minority business enterprises in the implementation of the Community

Development Block Grant Program; and

WHEREAS, the City of Evanston in an effort to assure community
participation in the development and implementation of the'A.ffirmative
Action Plan did schedule a public hearing to develop an Affirmative
Action Plan;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS, that the following program, referred.
to as the Seventh Year Community Development Section 3 Affirmative Action
Plan, is hereby approved and the City Manager is hereby directed to carry
out said program:
"SEVENTH YEAR COMMUNITY DEVELOPMENT SECTION 3
AFFIRMATIVE ACTION PLAN"
I. Employees
The positions to be funded by the City of Evanston's Seventh
Year Community Development Block Grant (CDBG) program will
be to the following agency and for the general purposes out-
lined below:
City of Evanston
• Grant Administration - To provide general grant
management:
- 2 Senior Planners
- 2 Planners
- 1 Clerk Typist
- 1 Planning Aide
Housing Rehabilitation - To provide administrative
support for the rehabilitation program:
- 1 Rehabilitation Coordinator
- 1 Finance Specialist
- 2 Rehab Specialists
- 1 Clerk Typist
Emergency Housing - To provide emergency housing
services:
- 1 Housing Coordinator
- 1 Caseworker
- 2 Clerk Typists (part-time)
Code Enforcement - To provide inspection services:
- 1 Property Standards Inspector II
The recruitment and hiring of the aforementioned personnel
shall be done in accordance with the City of Evanston's
Affirmative Action program and EEOC guidelines. In addition,
agencies receiving the City of Evanston CDBG funds shall be
required to develop an affirmative action program in their
recruitment and hiring, and adopt certain policies in accord-
ance with Resolution 24-PR-79 adopted by the City Council of
the City of Evanston, on May 14, 1979.

In an effort to meet the recommended goal as suggested by HUD, by
which the:
Minority business participation level equals (=) the
percentage of minorities in the general population of
the City, times (x) the estimated total dollar amount
to be let by contracts and/or used to purchase goods
and services.
It is recommended that the City of Evanston establish a minimum
goal of $397,189 by which minority businesses will participate
in the Community Development Block Grant Program for the 1981-82
Program year.
III. BUSINESS UTILIZATION
In order to reach the goals and objectives of Evanston's Affirmative
Action Program the following steps will be taken:
A. The City Manager and/or his designate is hereby
authorized to seek the advice, counsel and assistance
of all qualified agencies, public or private in the
administration of Evanston's Affirmative Action Program.
B. All departments of the City involved in the solicitation
of services for the Community Development Block Grant
Program shall notify the Evanston Review, The Dodge Reports,
the appropriate businesses listed on the registry of small
Evanston businesses and any additional resources which be-

come available.

C. The City shall also seek qualified businesses through
a general recruitment statement to be published in the
Evanston Review and Dodge Reports.
D. Each activity will be reviewed to determine if the total
activity or a component could be designated for a small
and/or minority business enterprise.
For a set -aside project, the City may use the negotiated
16 bid process whereby a qualified small and/or minority
business would be located and the contract price would
be established through negotiations.
The City will make available upon request copies of plans
and specifications for negotiated_ bid projects to comunity
organizations. Any organization may contact a qualified
small business and may present said contractor and the
proposed contract amount to the City of Evanston for
consideration. No contract for consideration of more
than Ten Thousand Dollars ($10,000) shall be negotiated.
E. All bid documents shall contain the following:
1) A certification of Title I, Chapter 12 of the Evanston
City Code, 1979, the Fair Employment Practices Ordinance;
2) A certification of bidder regarding equal employment
opportunity in accordance with Executive Order 11246;
,and
3) A certification of bidder regarding employment
opportunities for project area businesses and
lower income persons.
F. The Administrative Departments of the City shall cooperate
with all agencies, public and private, formed for the purpose
of assisting eligible Evanston small and/or minority business
concerns. Said Administrative Departments shall further
give all necessary assistance to eligible Evanston small
and/or minority business concerns ificluding but not limited to
the preparation and submission of bids for services.
G. The Office of the City Manager of the City of Evanston in
conjunction with the Housing and Community Development Act
Committee of the City Council of the City of Evanston shall
be charged with the responsibility for implementation and
procedural development of the aforesaid policy.
