HomeMy WebLinkAboutRESOLUTIONS-1980-045-R-806/10/80 45-R-80 • A RESOLUTION Creating An "Affirmative Action Plan" Directed Toward The Utilization Of Lower Income Evanston Residents, Evanston Small Businesses and Minority Businesses In The Implementation Of The 1980-81 Community Development Block Grant Program WHEREAS, the City of Evanston did apply for and receive a 1980 Community Development Block Grant from the U.S. Department of Housing and Urban Development; and WHEREAS, the City Council of the City of Evanston did authorize and direct the City Manage„r to sign all necessary certifications and • assurances in applying for said block grant, pledging that Evanston will conduct the program in conformity with Title VI of the Civil Rights Act of 1964, Title VII of the Civil Rights Act of 1968, Section 109 of the Housing and Community Development Act of 1974, Executive Order 11246, Executive Order 11063, and Executive Order 11625; and WHEREAS, the Community Development Block Grant assurances re- quire, among other things, that the City of Evanston comply with 24 CFR Part 135, Employment Opportunities for Businesses and Lower Income Persons in Connection with Assisted Projects, and Utilization of Minority Businesses; and WHEREAS, 24 CFR Part 135 directs the City of Evanston to develop a "Section 3 Affirmative Action Plan" which identifies the maximum feasible use of lower income Evanston residents and eligible business concerns, which • . qualify as small under the small business size standards of the Small Business Administration, in the implementation of its grant program; and WHEREAS, Executive Order 11625 mandates increased utilization of minority business; and the U.S. Department of Housing and Urban Development has recommended the adoption of goals for participation by minority business • enterprises in the implementation of the Community Development Block Grant Program; and WHEREAS, the City of Evanston in an effort to assure community participation in the development and implementation of the Affirmative Action Plan did schedule a public meeting as a means of identifying and utilizing the maximum number of lower income Evanston residents, eligible small busi= ness concerns and minority businesses; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS, that the following program, referred to as the Sixth Year Community Development Affirmative Action Plan, is hereby approved and the City Manager is hereby directed to carry out said program: • "SIXTH YEAR COMMUNITY DEVELOPMENT SECTION 3" AFFIRMATIVE ACTION PLAN I. Employees The positions to be funded by the City of Evanston's Sixth Year Community Development Block Grant program shall be to the following Agencies and for the general purpose outlined below: A. City of Evanston 1. Grant Administration - To provide general grant management: - 1 Senior Planner (75% time) - 1 Senior Planner - 2 Planners - 1 Clerk Typist - 1 Planning Aide (Full or part-time) Housing - 1 Finance Specialist - 3 Rehab Specialists • - 1 Clerk Typist - 1 Financial Aide (part-time) - 1 Rehabilitation Coordinator Emergency and Housing Counseling - 1 Housing Coordinator - 2 Caseworkers (part-time) - 1 Clerk Typist (part-time) Code Enforcement - 1 Property Standards Inspector II • • • B. Evanston Community Development Corporation (ECDC) - Grant Administration - Housing Rehabilitation C. Latino -American Association of Evanston - Neighborhood Planner The recruitment and hiring of the aforementioned personnel shall be done in accordance with the City of Evanston's Affirmative Action program and EEOC guidelines. In addition, those other agencies receiving the City of Evanston's CDBG funds shall be required to develop an affirmative action program in their recruitment and hiring in accordance with Resolution 24-PR-79 adopted by the Evanston City Council on May 14, 1979. II. PROJECT/GOALS Evanston's Sixth Year Community Development Block Grant Program designates the following: Acquisition $ 30,000 Chicago/Main Parking 45,000* 4 C's Daycare Center Rehabilitation 135,000* Accessibility --Evanston Family Counseling Service 27,800* Foster Center 50,000* Target Area Beautification 276,000* Gilbert Park 30,000* Adam Perry Park 30,000* Chicago/Der.ppster 142,500* Custer/Callan 115,000* Church/Dodge Economic Development Seed Money 75,000 Demolition 10,000* Rehab Administration 110,026 Single Family Rehab Loans and Grants 518,500* Rehab Multi -Family Interest Subsidy 25,000* ECDC Block Rehabilitation 100,000* Urban Ark 54,428* Conservation Grants 5,000* Weatherization 15,000* Housing Counseling 43,000 Community Defender 86,365* Latinoamerican Association Planner 24,000* Relocation Payments and Assitance 10,000 ECDC Corporate Administration 150,000* IHDA Section 8 Substantial Rehab 25,000 Multi -family Code Enforcement 17,250 CDBG Administration 125,500 Unspecified Local Option 74,131 TOTAL Community Development Block Grant $ 2,349,500 *Activity to be let for contracts and/or purchase of goods and services. Total activities to be let for contracts and/or purchase of goods and services = $1,839,593.00. In an effort to meet the recommended goal as suggested by HUD, by which the: Minority business participation level equals (=) the percentage of minorities in the general popu- lation of the City, times (x) the estimated total dollar amount to be let by contracts and/or used to purchase goods and services, it is recommended that the City of Evanston establish a minimum goal of $331,126 by which minority businesses will participate in the Community Development Block Grant Program for the 1980- 81 program year. III. BUSINESS UTILIZATION In order to reach the goals and objectives of Evanston's Affirmative Action Program the following steps will be taken: A. The City Manager and/or his designate is hereby authorized to seek the advice, counsel and assistance of all qualified agencies, public or private in the • administration of Evanston's Affirmative Action Program. B. All departments of the City involved in the solicitation of services for the Community Development Block Grant (CDBG) Program shall notify the Evanston Review, The Dodqe Reports, the appropriate businesses listed on the registry of small Evanston businesses; and any additional resources which become available. C. The City shall also seek qualified businesses through a general recruitment statement to be published in the Evanston Review, Dodge Reports, and the CCC News Gazette. D. In Evanston's Sixth Community Development program year, it will be the City's goal to award at least fifty per- cent (50%) of the City's Community Development funds allocated for housing rehabilitation to eligible small businesses. E. Each activity will be reviewed to determine if the total activity or a component could be designated for a small and/or minority business enterprise. For a set -aside project, the City may use the negotiated bid process whereby a qualified small and/or minority business would be located and the contract price would be established through negotiations. The City will make available upon request copies of plans and specifications for negotiated bid projects to community organizations. Any organization may contact a qualified small business and may present said contractor and the proposed contract amount to the City of Evanston for con- sideration. No contract above Ten Thousand Dollars ($10,000) shall be negotiated. F. The City's commitment, or that of a grant recipient, a participating contractor, or subcontractor, to this pro- gram shall be stated in all bid documents. In addition all bid documents shall contain the boundaries of Evanston's Section 3 project area which are the City's boundaries. G. Contractors shall include copies of their Affirmative Action Program in all bids and document the potential utilization of lower income Evanston residents. H. The Administrative Departments of the City shall cooperate with all agencies, public or private, formed for the pur- pose of assisting eligible Evanston small and/or minority business concerns. Said Administrative Departments shall further give all necessary assistance to eligible Evanston small and/or minority business concerns in the, preparation and submission of bids for services. I. The Office of the City Manager of the City of Evanston in • conjunction with the Housing and Community Development Act Committee of the City Council of the City of Evanston shall be charged with the responsibility for implementation and procedural development of the aforesaid policy.
