HomeMy WebLinkAboutRESOLUTIONS-1980-004-R-80C7 0 • is M , r r^. 1/9/80 4( ' 4-R-80 A RESOLUTION Recommending that the General Assembly Veto the Home Rule Preemptive Provision of House Bill 1707, the Residential' Landlord -Tenant Act WHEREAS, the City Council of the City of Evanston is committed to creating a more equitable relationship between landlords and tenants by establishing rights and obligations for both of these parties; WHEREAS, the City Council of the City of Evanston considers the landlord -tenant relationship an appropriate subject of local regulation* under its home rule powers and in 1975 adopted a comprehensive municipal 1. ordinance governing this relationship; and WHEREAS, House Bill 1707 by Section 1.204 declares it to be State policy that "control of the legal relationships between landlords and tenants shall be exclusively a State power and a: State concern," and specifically pre- empts the control by any unit of local government, including home rule units ' of the rights and duties arising out of landlord -tenant relationship; NOW, THEREFORE, be it resolved by the City Council of the City of Evanston that it urgently recommends that the General Assembly of the State of Illinois either defeat House Bill 1707, or that said bill be amended to delete Section 1.204 and to specifically provide for concurrent jurisdiction i f1 of the landlord tenant relationship by home rule units..
