A RESOLUTION

}; WHEREAS, it is.a goal of the City Council of the City of Evanston
,,through such legislation as the Residential Condominium Ordinance to provide
1for upgrading and maintaining residential property in the City, while also
!;assuring maximum protection for purchasers of condominiums, tenants in
buildings designed for conversion, and residents of the City of Evanston in
i} general ; and
!t. WHEREAS, the City Council recognizes that the status of the City as
}1
.!a home rule jurisdiction enables local government to tailor legislation to
meet local needs and concerns; and
} WHEREAS, the Uniform Condominium Act (House Bill 1862) now before
i, the Illinois_ Legislature would preempt most of the home rule powers of the
City in this area:

EVANSTON:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SECTION 1: That the City Council of the City of Evanston hereby
reiterates its position that the proposed Uniform
Condominium Act (or any bill containing similar provisions) does not meet the
needs of the City of Evanston and will indeed reduce the level of protection
currently provided under the Evanston Condominium Ordinance and unreasonably
preempts home rule powers provided in the Illinois Constitution;, and
SECTION 2: That the City Council of the City of Evanston urges
the members of the Legislature and the Governor to
;oppose the proposed legislation or any similar legislation so long as any
it
provision.pre.empting home rule powers is included; and

SECTION 3: That the City Council of the City of Evanston strongly
encourages other home rule jurisdictions within the
iState of Illinois to join Evanston in this effort.
