HomeMy WebLinkAboutRESOLUTIONS-1970-012-R-700 • "A* i� U 12- R- 70 RESOLUTION WHEREAS, Chapter 24, Section 11-1-6 of Revised Statutes, 1969, permits municipalities for the assumption of extraordinary powers by during specified emergency situations, and the Council is desirous of implementing this grant regard to civil liberties; and the Illinois to provide the (Mayor Evanston City with all due WHEREAS, the Evanston City Council judges it to -be deGiable that under emergency conditions the exercise of extraordinary power be returned to the corporate author- ities as soon as possible, and believes it possible for the corporate authorities to assemble within a few hours after declaration of an emergency situation; and WHEREAS, Section 42.02 of Chapter 102 of the Illinois Revised Statutes, 1969, (The Open 1,41eetings Act) specifically prohibits the corporate authorities from taking action without 24 hours due notice of their assembly; and WHEREAS, it is the manifest intent of Section 11-1-6 of the Illinois Revised Statutes to Lraive the requirement of 24 hours due notice under emergency situations, but whereas this waiver applies only to situations wherein the Mayor assumes extraordinary powers; NOW, THEREFORE, BE IT RESOLVED, that the Evanston City Council respectfully petitions the Illinois General Assembly to enact emergency legislation amending Section 42.02 of Chapter 102 (The Open tleetings Act) to provide that, when the ;xayor has issued a proclamation of state of emer- gency under Section 11-1-6 of the Illinois Revised Statutes, the City Council may be convened and empowered to act as soon as practicable, without advance public notice.
