R E S O L U T I O N
WHEREAS, the City Council of the.City of Evanston, Illinois strongly
urges that the Illinois Constitutional Convention incorporate in the pro-
posed Constitution a Home Rule provision that provides for maximum practi-
cable initiative by local governments in serving Illinois citizens residing
in urban areas] and
WHEREAS, the Evanston City Council believes that the Home Rule provi-
sion should reflect and be based on the following principles:
1. It should express a "concurrent powers" or similar concept
that unequivocally reverses Dillon's rule.
2. it should not prevent the Illinois General Assembly from
exercising ultimate control over those measures affecting
the common good of the whole State or parts thereof.
3. It should offer the least possible exposure to judicial
erosion.
4. Consistent with Mr. Justice Cardozo's dictum that a consti-
tution ought to be limited to "principles for an expanding
future," it should not unnecessarily inhibit flexibility
of future application.

WHEREAS, the Evanston City Council has carefully studied the Home Rule
proposals of Convention Delegates Netsch, Woods, and Zeglis, and has measured
these alternative proposals against the above stated principles:

NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Evanston, Illinois, that it supports the Home Rule proposal of Convention
Delegate Netsch and urges the Illinois Constitutional Convention to in-
corporate this Home Rule provision into the proposed Constitution to be
submitted to the voters of Illinois; and
BE IT FURTHER RESOLVED, that the City Clerk be and hereby is in-
structed to transmit copies of this resolution to all Convention Delegates;
and
BE IT FURTHER RESOLVED, that the Mayor and City Manager are hereby
authorized to take other appropriate steps to urge that the Home Rule
proposal of Convention Delegate Netsch be incorporated in the forthcoming
proposed Illinois Constitution.
