It is one of the special uses specifically listed in the zoning ordinance: Commercial Indoor Recreation facilities and Planned Developments are special uses in the oCSC Overlay. The Commission believes this standard is met. 2. It is in keeping with the purposes and the policies of the Comprehensive General Plan and the Zoning ordinance as amended from time to time: The proposed development will fill a vacant space and provide a public amenity and the Commission believes this standard is met. 3. It will not cause a negative cumulative effect, when its effect is considered in conjunction with the cumulative effect of various special uses of all types in the immediate neighborhood and the effect of the proposed type of special use upon the City as a whole: The Commission believes that the concerns about negative impacts from the development will not be realized and that th e positive benefits for the overall community outweigh potential moderate impacts to the immediate neighborhood. This standard is met. 4. Does not interfere with or diminish the value of property in the neighborhood: The Commission did not hear conclusive evidence to the contrary and believes this standard is met. 5. Can be adequately served by public facilities and services: The Commission believes this standard is met due to the fact that the property has previously accommodated similar commercial uses of a com parable intensity. 6. Does not cause undue traffic congestion: In consideration of the two conditions of approval that outline a proactive and a reactive strategy to address potential traffic congestion in the alley, the Commission believes this standard is met. 7. Preserves significant historical and architectural resources: There are no significant historical or architectural resources on the subject property or Page 4 of 44 60-O-26 vicinity that would be threatened by the proposed special use. The Commission believes this standard is not applicable. 8. Preserves significant natural and environmental features: There are no significant natural or environment features on the subject property or vicinity that would be threatened by the proposed special use. The Commission believes this standard is not applicable. 9. Complies with all other applicable regulations of the district in which it is located and other applicable ordinances, except to the extent such regulations have been modified through the plan ned development process or the grant of a variation: The development will comply with all applicable regulations of the C2 and oCSC districts, as well as all applicable ordinances. The Commission believes this standard is met. WHEREAS, after having considered the evidence presented, including the exhibits and materials submitted, and public testimony provided, the LUC made the following findings per Section 6-3-6-9 of the Zoning Ordinance: 1. The requested Site Development Allowance(s) will not have a substantial adverse impact on the use, enjoyment or property values of adjoining properties that is beyond a reasonable expectation given the scope of the applicable Site Development Allowance(s) of the Planned Development location: The Commission believes the standard is met since the requested Site Development Allowances were relatively moderate and the remainder of the development is in compliance with Code. 2. The proposed development is compatible with the overall character of existing development in the immediate vicinity of the subject property: Green Bay Road includes several developments of a similar size and bulk and t he Commission believes the standard is met. 3. The development site circulation is designed in a safe and logical manner to mitigate potential hazards for pedestrians and vehicles at the site and in the immediate surrounding area: The Commission believes the standard is met given the proactive and reactive conditions of approval and the applicants efforts to redesign the site plan to address concerns regarding the alley usage. 4. The proposed development aligns with the current and future climate and sustainability goals of the City: The development will be in compliance with the Green Building Ordinance and the Commission believes that the standard is met. Page 5 of 44 60-O-26 5. Public benefits that are appropriate to the surrounding neighborhood and the City as a whole will be derived from the approval of the requeste d Site Development Allowance(s): The Applicant has committed to pay standard commercial property taxes and make improvements to the alley and this standard is met.
