AN ORDINANCE
Amending Evanston City Code 10-4-5-2 “Parking Restrictions in
Residential Districts” to Add a Prohibition on the Sale, Unauthorized Transfer
Or Advertising of One-Day Visitor Parking Permits and Spaces
WHEREAS, the City of Evanston is a home-rule municipality under Article VII, Section 6 of the
Illinois Constitution and may exercise any power and perform any function pertaining to its government
and affairs, including regulation of parking, traffic, land use, and public safety; and
WHEREAS, the City issues one-day visitor parking permits for the limited purpose of allowing
bona fide visitors of eligible residents to park within residential permit parking districts; and
WHEREAS, the City Council finds that the sale, advertisement, barter, exchange, or other
commercial transfer of one-day visitor parking permits or parking spaces undermines the purpose of the
residential parking program, reduces parking availability for residents and their legitimate visitors, and
creates opportunities for abuse of the City's parking regulations; and
WHEREAS, the City Council further finds that prohibiting the commercialization of one-day visitor
parking permits and parking spaces is necessary to preserve the integrity of the residential parking
program, promote equitable access to visitor parking, and protect the public health, safety, and welfare.
NOW BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK
COUNTY, ILLINOIS, THAT:
SECTION 1: City Code Section 10-4-5-2, “Parking Restrictions in Residential Districts,” is hereby
amended to add subsection (D), which shall read as follows:
10-4-5-2. Parking Restrictions in Residential Districts.
(D) Prohibition on the Sale, Unauthorized Transfer or Advertising of Parking Spaces and/or One-Day
Visitor Parking Permits
1. Sale Prohibited. No person shall sell, offer for sale, lease, barter, exchange, auction, transfer or
otherwise provide parking spaces and/or One-Day Visitor Parking Permits for compensation or
anything of value,”
2. Advertising Prohibited. No person shall advertise, list, or offer such parking spaces and/or
One-Day Visitor Parking Permits for sale, lease or transfer on any third-party parking application,
social media platform, website, or digital marketplace, including but not limited to mobile
applications facilitating paid parking transactions.
3. No person shall reproduce, counterfeit, alter, or otherwise falsify a one-day visitor parking permit.
4. No person shall use, possess, display, or attempt to use a one-day visitor parking permit obtained
through an unauthorized sale or transfer.
5. Presumption. The presence of a listing, advertisement, or digital posting offering a one-day visitor
parking permit and/or residential parking space for compensation shall constitute prima facie
evidence of a violation of this subsection.

6. Penalty. Any violation of this subsection shall be punishable by a fine of two hundred
dollars ($200) per violation. Each listing, advertisement, or transaction shall constitute a
separate offense. In addition to any fine authorized by this Code, the City may
immediately suspend or revoke a resident's eligibility to purchase or receive one-day
visitor parking permits for up to two years from said violation, upon a determination that
the resident knowingly violated this subsection.
7. Enforcement: Violations may be established through complaints, online advertisements,
investigative findings, or any other competent evidence.
SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 3: This ordinance will be in full force and effect after its passage, approval and
publication in the manner provided by law.
SECTION 4: If any provision of this ordinance or application thereof to any person or
circumstance is held unconstitutional or otherwise invalid, such invalidity shall not affect other provisions
or applications of this ordinance that can be given effect without the invalid application or provision, and
each invalid provision or invalid application of this ordinance is severable.
