A RESOLUTION
Authorizing the City Manager to Execute Change Order No. 6 to the
Agreement with CDM Smith Inc. for Professional Engineering Services
for the Corrosion Control Study (RFP 21-26)
WHEREAS, the City of Evanston owns and operates a public water supply
system that provides safe and reliable drinking water to the residents of Evanston and
several wholesale water customers; and
WHEREAS, the United States Environmental Protection Agency (U.S. EPA)
promulgated the Lead and Copper Rule Revisions (LCRR) to strengthen corrosion
control treatment requirements and further reduce exposure to lead in drinking water;
and
WHEREAS, the Illinois Environmental Protection Agency (Illinois EPA) requires
the City of Evanston to complete a Corrosion Control Study to identify and implement
the optimal corrosion control treatment for its drinking water system in accordance with
State and Federal drinking water regulations; and
WHEREAS, on September 13, 2021, the City Council approved a professional
services agreement with CDM Smith Inc. (RFP 21-26) to perform a comprehensive
Corrosion Control Study for the City's water treatment system; and
WHEREAS, the agreement has subsequently been amended through five
change orders to accommodate additional laboratory testing, corrosion control
evaluations, administrative funding updates, project management activities, and
schedule extensions necessary to satisfy regulatory requirements; and
WHEREAS, on July 9, 2026, the Illinois EPA issued a Special Exception Permit
approving the results and recommendations of the Evanston Water Treatment Plant
Corrosion Control Optimization Study and approving the associated technical
memorandum prepared by CDM Smith; and
WHEREAS, the Illinois EPA Special Exception Permit requires the City to
conduct a full-scale plant pilot, submit the results of the pilot testing, and provide an
Optimal Corrosion Control Treatment Recommendation to the Illinois EPA no later than

January 9, 2028, prior to implementing modifications to the existing phosphate feed
system; and
WHEREAS, the agreement with CDM Smith expired on April 30, 2026, and no
work has been performed under the agreement since its expiration while the City
awaited issuance of the Illinois EPA Special Exception Permit to determine the
remaining regulatory requirements; and
WHEREAS, sufficient funding remains within the existing contract amount of One
Million Two Hundred Nineteen Thousand Dollars ($1,219,000.00) to complete the
remaining scope of work, including the required full-scale plant pilot, and therefore no
increase in the contract amount is required; and
WHEREAS, Change Order No. 6 extends the contract completion date from April
30, 2026, to January 31, 2028, a period of 641 calendar days, to allow completion of the
remaining work required by the Illinois EPA Special Exception Permit without increasing
the contract amount; and
WHEREAS, the City Council has determined that approving Change Order No. 6
is in the best interests of the City to maintain compliance with applicable State and
Federal drinking water regulations and to protect the public health, safety, and welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF EVANSTON, COOK COUNTY, ILLINOIS:
Section 1:The foregoing recitals are hereby found to be true and correct and are
incorporated herein as though fully set forth.
Section 2:The City Council hereby authorizes the City Manager to execute
Change Order No. 6 to the agreement with CDM Smith Inc. for the Corrosion Control
Study (RFP 21-26), extending the contract completion date from April 30, 2026, to
January 31, 2028, without increasing the current contract amount of $1,219,000.00, in
substantially the form attached hereto and approved as to form by the Corporation
Counsel.
Section 3: The City Manager, Corporation Counsel, City Clerk, and other
appropriate City officials are hereby authorized and directed to execute all documents
and take all actions necessary to carry out the intent of this Resolution.

Section 4: If any provision of this Resolution is declared invalid or unenforceable
by a court of competent jurisdiction, such determination shall not affect the validity of the
remaining provisions.
Section 5: This Resolution shall be in full force and effect from and after its
passage and approval in the manner provided by law.

The following changes are hereby made to the AGREEMENT:
Change Order No. 6 does not increase the contract amount. Instead, it extends the contract
completion date by 641 calendar days, from April 30, 2026, to January 31, 2028, allowing CDM
Smith to complete the full-scale plant pilot, prepare the Optimal Corrosion Control Treatment
Recommendation, continue coordination with the Illinois Environmental Protection Agency
(IEPA).

Original CONTRACT PRICE: $ 974,500.00
Current CONTRACT PRICE adjusted by previous CHANGE ORDERS $ 1,219,000.00
