The YTD balance is $230,000.00. In 2027 and 2028, funds will be deducted from 130.30.3800.62195 Landscape Maintenance Services due to the transfer of Greenways from Public Works to Parks and Recreation. Staff recommends approval of a single- source contract with Pizzo & Associates, Ltd. for a total of $22,950.02 over three years according to the following schedule: • 2026 - $7,650.02 • 2027 - $7,650.00 • 2028 - $7,650.00 Summary: The Ecology Center provides a variety of educational programming and services to the community. This contract will provide stewardship services around the building to support the native plant habitat and long-term management of the site. The services will continue the stewardship work provided by Pizzo in 2025, which was implemented as part of the LEED certification requirements during the Ecology Center renovations. Stewardship work will include invasive and non-native vegetation control through hand pulling, brush cutting, mowing or treatment as needed. (Pizzo) Stewardship, Prescribed Fire, Clearing, Design, and Consulting Services Payment: Invoices for Stewardship, Prescribed Fire, Clearing, Design, and Consulting Services will be issued monthly for work performed in the year the contract begins or per visit based on contract language, and payment in full is due within thirty (30) days of the invoice date. Payment shall be made in accordance with the Illinois Local Government Prompt Payment Act (50 ILCS 505 et seq.) Installation and Restoration Services Payment: A payment equal to twenty-five percent (25%) of the total Restoration Contract Price, as set forth in the accompanying contract, is due upon execution of the Agreement. The remaining balance, including an y approved additional costs, is due upon completion. Installation or Restoration includes any project involving the establishment or enhancement of native plant communities through seeding or planting, including, but not limited to, tree and brush clearing, herbaceous vegetation removal, site preparation, native seed installation, native plug planting, and the installation of erosio n control blankets or other soil stabilization measures. All additions or deletions to the scope of work must be agreed upon in writing by both parties. Additions will be billed on a time-and- materials basis unless otherwise stated in writing, including time spent on travel, pick-up or delivery, clean-up or setup, and any related costs. Prepayment Discount: A prepayment discount of 1.5% will be applied to all accounts paid in full upon contract signing. Finance Charges and Returned Payments: Any payment not received within thirty (30) days of the invoice date will accrue a finance charge of two percent (2%) per month, or the maximum rate permitted by law, until paid in full. Any payment not made in accordance with the Illinois Local Government Prompt Payment Act shall incur a penalty consistent with the Prompt Payment Act. Pizzo & Associates, Ltd. (“Pizzo”) reserves the right to suspend or terminate work without liability in the event of nonpayment until all outstanding balances, including accrued interest, are paid in full. Returned checks will incur a $200.00 service charge, and the Owner shall be responsible for all reasonable costs of collection, including attorney’s fees, court costs, and related expenses. If the Owner or Client fails to make payment as required, Pizzo may exercise lien rights as permitted by applicable state law. Administrative Tasks and Costs: The Owner shall provide written notice to Pizzo regarding any client-specific requirements related to access, safety, billing, or contract administration prior to any bid deadline. Pizzo will include these costs in its propo sal. If such requirements arise after contract execution, they will be billed on a time-and-materials basis. Guarantees: For Owner-managed sites, trees and shrubs are guaranteed to survive for one (1) year from the installation date or will be replaced, with replacement being the Owner’s sole remedy. Pizzo may substitute another species at its discretion. This gua rantee is void if the Owner fails to properly maintain the plantings, and does not cover damage due to Owner actions, contaminated soils, third- party damage, herbicides, herbivory, wildlife, floods, stormwater, or acts of God. Perennials, seeds, annuals, and transplanted materials carry no warranty, expressed or implied. Failure to make payment within thirty (30) days of job completion voids al l guarantees. For Pizzo-managed sites, trees and shrubs are similarly guaranteed to survive for one (1) year or will be replaced, and native seed installations are guaranteed to produce at least three (3) native plants per square foot at the end of the fifth growing sea son. Pizzo will re-seed areas not meeting this standard, limited to one replanting within five years from the contract date. Native perennials are guaranteed an eighty percent (80%) survival rate after one (1) year. Guarantees do not cover damage caused by Owner actions, contaminated soils, third-party interference, herbicides, herbivory, wildlife, floods, stormwater, or acts of God. Failure to make payment within thirty (30) days of the final invoice voids all guarantees, which terminate once Pizzo is no longer managing the site. If conditions are favorable and permission is granted by the local fire jurisdiction, the full contract bala nce shall be due if the burn is halted for reasons not attributable to Pizzo. Return trips to complete the burn will be billed at the contracted r ate. Landscape plantings, mulch beds, and above-ground utilities in or near the burn area may sustain heat or flame damage and are not guaranteed. The Owner acknowledges that smoke may move off-site and agrees to notify potentially affected parties. The Owner shall indemnify and hold Pizzo harmless for any damage or claims arising from the prescribed fire. If local authorities charge a fee for their required presence, the Owner shall pay those costs in addition to the contract price. Nature-Based Ecosystems Disclaimer: Pizzo’s services are designed and managed as functioning ecological systems rather than conventional landscaping. Unlike traditional landscaping, which often prioritizes uniform appearance and predictable outcomes , habitat restoration focuses on establishing resilient ecosystems. Plant species will grow, reproduce, and disperse naturally, potentially resulting in additional plants each year. Species composition and distribution cannot be precisely predicted or guaranteed. Some species may shift location or become dominant over time based on environmental factors. Annual success depends on soil, weath er, and other natural variables. Pizzo provides stewardship to guide ecological development rather than maintaining or contro lling it. By engaging Pizzo’s services, the Owner acknowledges and accepts these inherent characteristics. To help clients understand the main differences between landscaping and habitat restoration, consider the following points: •Predictability: Habitat restoration supports natural processes, which are inherently dynamic and variable. •Plant Distribution: In restoration, plants may spread, shift, or change dominance over time; some areas may see more growth, others less. •Species Diversity: Restoration emphasizes ecological function and native species diversity. •Maintenance Expectations: Habitat restoration relies on long-term periodic stewardship rather than fixed intervention. The long-term success of ecological restoration is directly dependent on consistent and appropriate stewardship following installation. Restoration areas are dynamic, living systems that require continued management to control invasive species, promote native plant establishment, and maintain ecological balance. If the Client elects to modify, reduce, or decline the recommended stewardship program or associated management activities, Pizzo & Associates, Ltd. shall not be held responsible for any reduction in the success, quality, or sustainability of the restoration outcomes. Any deviation from the recommended stewardship schedule, scope, or duration may alter the anticipated project timeline and ecological performance expectations. •Natural Variability: Weather, soil conditions, wildlife, and other natural factors can alter outcomes in restoration projects. •Timeframe for Results: Restoration takes MULTIPLE growing seasons for ecosystems to stabilize and for the plant community to mature. •Opportunistic Growth: Following invasive species removal or disturbance, native species may colonize open areas naturally (“Open Soil Paradox”), which is a positive ecological response, not a planting failure. Establishing a balanced, resilient ecosystem requires time, patience, and ongoing stewardship, with expectations distinct from conventional landscaping. By engaging Pizzo, the Owner agrees to these ecological principles and inherent uncertainties. Aquatic Weed Control: Due to the unpredictable nature of weather, nutrient levels, and water conditions, Pizzo provides no warranty for the complete control or eradication of aquatic plants or algae. Supplemental Watering: Supplemental watering may be required for plant establishment, particularly if installation occurs outside standard timeframes (March 1 – June 30 or September 15 – October 31) or during drought conditions. The Owner will be notified prior to initiating supplemental watering; if declined, all warranties for seeding and plant installation are void. Watering services will be billed on a time-and-materials basis, including travel, pick-up or delivery, clean-up, setup, and related costs. Dumping of Garbage, Litter, Soil, Construction Debris, and Landscape Debris or Encroachment: If garbage, debris, soil, or other materials are dumped within the project area, or if encroachment occurs, Pizzo shall notify the Owner and bill cleanup or restoration costs on a time-and-materials basis. Pizzo may substitute materials, quantities, or species without Owner consent if deemed necessary due to weather, availability, or site conditions, provided the project’s overall character is maintained, and may e mploy subcontractors to perform all or part of the work. Boundary and Utility Marking for Field Work: The Owner shall provide a current plat of survey for delineation of property boundaries. If boundaries are unmarked, Pizzo may hire a surveyor, billed to the Owner. The Owner must identify all private u tilities prior to work commencement and shall be responsible for any repair costs related to private utilities. Delays by Others: If Pizzo’s work is delayed due to causes beyond its control, the Owner shall be notified. If the delay is caused by another contractor or third party, the Owner must promptly resolve it; if unresolved by the next business day, resulting costs m ay be billed to the Owner. Design Plans, Photographs, Videos, and Award Submissions: The Owner grants Pizzo permission to produce sketches, drawings, photographs, and videos, including aerial footage, for design, restoration, marketing, or educational purposes. All copyrights remain the property of Pizzo. Pizzo may also submit the project for awards or recognition and use such submissions for marketing purposes. Default Remedies: In the event of default by the Owner, the Owner shall pay all costs of collection, including attorney’s fees, court costs, and accrued interest. Any litigation related to this Agreement shall be filed exclusively in the Sixteenth Judicial Circuit Court, DeKalb County, Illinois. Circuit Court of Cook County, Illinois. Cancellations: Following mutual negotiation and execution, either party may terminate the Agreement upon written notice. Termination must be executed by the President and/or Vice President of Pizzo and an authorized representative of the Owner. Both parties must agree in writing on the terms of cancellation, including any applicable fees or obligations, before termination is effective. Restoration included 12 acres of invasive species control, 18 acres of native seeding, and 300 LF of bank stabilization utilizing encapsulated soil lifts with live stakes and toe protection. Chicago Botanic Garden – North Lake Shoreline Restoration A Section 206 Ecosystem Restoration Project with the combined eﬀorts of CBG and the U.S. Army Corps of Engineers, this project consisted of restoring 6,400 feet of shoreline along CBG’s North Lake. The scope of work for this project included installation of over 100,000+ native perennial plugs, 1,000+ native trees and shrubs, protection of sensitive plantings within the garden, shoreline stabilization with Geo-Web and benthic mesh. National Great Rivers Research & Education Center (LEED PLATINUM) The NGRREC Facility landscape was designed to mimic the natural ecotypes found in the conﬂuence region demonstrating which plants that would be found together in nature. The installation in Fall 2010 consisted of 100% native species and included bio-swales, a green roof, native seed, 275 Trees, 450 shrubs and 17,000+ native plugs.comprehensive project management to deliver it on spec, on time and within budget. Below is a quick overview of how billing, visits, and scheduling work, and why this approach provides the best ecological outcomes and value for your investment. 1. How does billing work? • Stewardship contracts run from April through November, the active growing season. • You will receive 8 equal monthly invoices, which spreads the cost evenly for predictable budgeting. • The contract is based on a block of labor hours and materials, not a fixed number of visits. • There is no pre-payment required for stewardship, payment is only required when invoices are delivered during the contract year. 2. How many visits should I expect? • On average, most sites receive around 3-5 visits per season. • However, the number of visits may be more or fewer depending on site conditions. • Some work may require longer visits with larger crews, while other times it may be shorter visits with smaller crews. 3. Why can’t visits be set in advance? • Invasive species emerge and are best controlled at specific points in their life cycle. • For example, garlic mustard, reed canary grass, phragmites, and buckthorn are each treated most effectively at different times of year.
