HomeMy WebLinkAboutOrdinance 38-O-26 Amending City Code Section 3-4-6 to Extend Permitted Hours of Alcohol Service for Class E-2 Entertainment Venue (Medium) Liquor License holders (1) (1) (1) (2) (1)4/27/2026 38-O-26 AN ORDINANCE Amending City Code Section 3-4-6 “Classification and License Fees” to Extend Permitted Hours of Alcohol Service for Class E-2 Entertainment Venue (Medium) Liquor License Holders WHEREAS, the permitted hours of alcohol service for Class E -2 medium- sized entertainment venues is more restrictive than the permitted hours for other entertainment venue classifications in the City; and WHEREAS, modifications to the City Code can make the permitted hours of alcohol service more consistent for all entertainment venues in the City , and WHEREAS, the Evanston City Council finds that it is in the best interest of the City of Evanston to amend the City Code to increase the permitted hours of alcohol service for Class E-2 medium-sized entertainment venues in the City; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1: Table 1 of City Code Section 3-4-6 “Classification and License Fees” of the Evanston City Code of 2012, as amended, is hereby further amended as follows: 3-4-6. – CLASSIFICATION AND LICENSE FEES TABLE 1 CLAS S TYPE CONSUM E ON SITE CONSUM E OFF SITE INITIAL FEES RENE W FEE LOCATION LIMIT PERMITTE D HOURS Page 1 of 3 38-O-26 E-2 ENTERTAINMEN T VENUE (MEDIUM) LIQUOR NONE $2,00 0 $2,00 0 AS PERMITTE D BY TITLE 6 OF THE CODE 4 P.M. 11 A.M. – 2 A.M. (MON- THURS); 4 P.M. 11 A.M. – 3 A.M. (FRI- SUN) SECTION 2: City Code Section 3-4-6 “Classification and License Fees” of the Evanston City Code of 2012, as amended, is hereby further amended as follows: 3-4-6. – CLASSIFICATION AND LICENSE FEES (E-2) CLASS E-2 licenses, which shall authorize the sale of alcoholic liquor for consumption on the premises where served, limited to patrons of a medium -sized entertainment venue, with a capacity of between two hundred twenty-six (226) and three hundred twenty-five (325) people, presenting live performances, for compensation. 1. The sale of alcoholic liquor shall not take place between the hours of 2:00 a.m. and 4:00 p.m. 11:00 a.m., except that sales may be made up to 3:00 a.m. on Friday, Saturday, Sunday mornings and up to 3:00 a.m., on the mornings of January 1, Memorial Day, July 4, Labor Day, and Thanksgiving. 2. The sale of alcoholic liquor shall not take place more than two (2) hours before a live performance begins, nor more than two (2) hours after the end of a live performance. The applicant for the renewal only of such licenses may elect to pay the amount herein semiannually. Such election shall be made at the time of the application. The annual single payment fee for initial issuance or renewal of such license shall be two thousand dollars ($2,000.00). Page 2 of 3 38-O-26 The total fee required hereunder for renewal applicants electing to make semiannual payments, payable pursuant to the provision of Section 3-4-7 of this Chapter, shall be two thousand two hundred dollars ($2,200.00) SECTION 3: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4: If any provision of this Ordinance 38-O-26 or application thereof to any person or circumstance is held unconstitutional or otherwise invalid, such invalidity shall not affect other provisions or applications of this Ordinance that can be given effect without the invalid application or provision, and each invalid application of this Ordinance is severable. SECTION 5: Ordinance 38-O-26 shall be in full force and effect after its passage and approval. SECTION 6: The findings and recitals contained herein are declared to be prima facie evidence of the law of the City and shall be received in evidence as provided by the Illinois Compiled Statutes and the courts of the State of Illinois.
