A RESOLUTION
Authorizing the Limited Settlement and Release of Claims between
The City of Evanston and CCC Holdings, Inc.
WHEREAS, the City entered into a contract with CCC Holdings, Inc.for the
construction of a new animal shelter; and
WHEREAS, the parties and the subcontractors had disputed claims during
the course of the contract with respect to unsuitable soils and undercuts and payment for
same;
WHEREAS, the parties reached an agreement that resolves these claims
as well as subcontractors claims, including but not limited to Doetsch, Inc., as well as
additional claims related to the scope of the project, LEP charges, and the assessment
of liquidated damages,(“Settlement Payment”); and
WHEREAS, pursuant to the terms of the Settlement Agreement the City will
authorize payment for Pay App No. 21, which is also contained on the bills list for
approval; and
WHEREAS, in compliance with Section 2(e) of the Open Meetings Act, 5
ILCS 120/2(e), the City must approve final action on settlement of th ese claims in open
session; and
NOW BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: That the foregoing recitals are hereby found as fact and
incorporated herein by reference.

SECTION 2: The City is hereby authorized to approve settlement with CCC
Holdings, Inc. and issue payment for Pay App No. 21 pursuant to the terms of the
Settlement Agreement.
SECTION 3: Resolution 2-R-26 shall be in full force and effect from and
after its passage and approval, in the manner provided by law.
