HomeMy WebLinkAboutOrdinance 88-O-24, Amending City Code Title 1, Chapter 7, Section 2, _General Duties of the Clerk Page 1 of 2 12/09/2024 88-O-24 AN ORDINANCE Amending City Code Title 1, Chapter 7, Section 2, General Duties of the Clerk WHEREAS, the Evanston City Council finds that it is in the best interest of the City of Evanston to amend City Code Title 1, Chapter 7, Section 2, “General Duties of the Clerk”, adding Section N, for the purpose of aligning the duties of the City Clerk with the requirements of the Residential Landlord Tenant Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS, THAT: SECTION 1: The foregoing recitals are found as fact and incorporated herein by reference. SECTION 2: Ordinance 1-7-2 is hereby amended as follows: (N) The City Clerk shall make available a model apartment lease agreement, as amended from time to time, and copies of all required disclosure documents to Evanston tenants and housing providers pursuant to City Code Section 5-3-10 (C). SECTION 3: If any provision of this ordinance or application thereof to any person or circumstance is held unconstitutional or otherwise invalid, such invalidity shall not affect other provisions or applications of this ordinance that can be given effect without the invalid application or provision, and each invalid provision or invalid application of this ordinance is severable. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval, and publication in the manner provided by law. 88-O-24 SECTION 5: All ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 7: The findings and recitals contained herein are declared to be prima facie evidence of the law of the City and shall be rece ived in evidence as provided by the Illinois Compiled Statutes and the courts of the State of Illinois.
