AN ORDINANCE
Amending Title 3, Chapter 25, Section 8, “Revenue Stamps Required”
of the City Code to Allow for Electronic Real Estate Transfer Stamps
WHEREAS, the City of Evanston requires Reat Estate Transfer Stamps to
be affixed for most real estate transfers within the City of Evanston and doing so
electronically will improve the efficiency of the process for Evanston residents;
WHEREAS, the Evanston City Council finds that it is in the best interest of
the City of Evanston residents to amend the City Code to reflect these changes.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: Title 3, Chapter 25, Section 8, “Revenue Stamps Required”
of the Evanston City Code of 2012, as amended, is hereby further amended as follows:
3-25-8. REVENUE STAMPS REQUIRED.
The tax herein levied and imposed shall be collected by the director of finance or
his/her designee for the City through the sale of revenue stamps, which shall be cau sed
to be prepared by said director of finance in such quantities and denominations as said
director of finance may from time to time prescribe. Such revenue stamps shall be
available for sale at and during the regular business hours of the City offices or at other
locations designated by the director of finance. Upon payment of the tax herein levied
and imposed, the revenue stamps so purchased shall be affixed to the deed or other
instrument of conveyance. Any person so using and affixing a revenue stamp o r stamps
shall cancel it and so deface it as to render it unfit for use by marking it with his/her
initials and the day, month and year when the affixing occurs. Such markings shall be
made by writing or stamping in indelible ink or by perforating with a machine or punch or
by electronic stamp by the City of Evanston. However, the revenue stamp(s) shall not
be so defaced as to prevent ready determination of its denomination and genuineness.

SECTION 2: All ordinances or parts of ordinances in conflict herewith are
hereby repealed.
SECTION 3: If any provision of this Ordinance or application thereof to any
person or circumstance is held unconstitutional or otherwise invalid, such invalidity shall
not affect other provisions or applications of this Ordinance that can be given effect
without the invalid application or provision, and each invalid application of this Ordinance
is severable.
SECTION 4: This Ordinance shall be in full force and effect after its
passage and approval.
SECTION 5: The findings and recitals contained herein are declared to be
prima facie evidence of the law of the City and shall be received in evidence as provided
by the Illinois Compiled Statutes and the courts of the State of I llinois.
