(225 West Ohio Street, 4th Floor, Chicago, IL 60654) for 2024 Capital Improvements Projects Construction Engineering in the not-to-exceed amount of $343,049.00. Funding Source: Funding is provided from the General Fund (Account 100.40.4410.62150) in the amount of $257,286.75 (Account $85,762.25 of amount the Sewer Fund the from and in 515.40.4410.62150). CARP: Transportation & Mobility Council Action: For Action Summary: The Bureau of Capital Planning and Engineering has a robust annual capital improvements program that includes the design and construction engineering of various infrastructure projects, including roads, water mains, sewers, alleys, sidewalks, and pedestrian crossings. Construction engineering tasks for each project include review and approval of material submittals, newsletter distribution, resident coordination, contractor coordination, weekly construction meetings, on-site monitoring of construction, quantity measurement, preparation of pay estimates, and preparation of as-built drawings at the completion of construction. A3.Page 202 of 1169 Doc ID: 53be52ce65e2bf0c255ccd2cc851988659b0da48 The Bureau is currently understaffed to support the construction engineering required for the 2024 annual transportation capital improvements projects. Annual transportation projects include:  Water Main Improvements  MFT Street Resurfacing  Alley Improvements  Sidewalk Improvement and Gap Infill Program  Neighborhood Traffic Calming The scope of work for these contracts has expanded significantly over the last few years, with new lead service line regulations, an increase of funding through the Motor Fuel Tax program, and an additional focus on alley and sidewalk improvement. These projects are designed in-house, and four full-time civil engineering employees oversee the construction. In recent years, there have consistently been vacancies in this team. On June 12, 2023, the City Council approved the prequalification of consulting firms for transportation engineering and surveying services (RFQ 23-10). This allows the City to hire additional engineering services to supplement staffing as needed. Currently, two of the four positions are vacant. With the expanded workload and low staffing level, the staff recommends hiring two consultant engineers to assist with construction oversight tasks. Analysis: On June 12, 2023, the City Council approved the prequalification of four consulting firms to provide design, construction engineering, and surveying services for various infrastructure projects. On March 24, 2024, the four prequalified firms were requested to provide a cost proposal for two resident engineers to provide construction engineering services for various 2024 capital improvement projects. The cost proposals received are summarized below: TERRA Engineering, Ltd. (TERRA) submitted the lowest cost to provide the requested services. Additionally, TERRA has performed satisfactory work for the City in the past, including construction services for 2023 capital improvement projects. Thus, staff recommends awarding TERRA to provide construction engineering services for the 2024 capital improvement projects. As a woman-owned business, TERRA satisfies the M/W/D/EBE goal. A memo reviewing their compliance is attached. Page 2 of 25 A3.Page 203 of 1169 Doc ID: 53be52ce65e2bf0c255ccd2cc851988659b0da48 Detailed Financial Analysis These services will replace the work of two vacant Civil Engineer II staff positions. Of the two positions being replaced, one is paid from the General Fund, and the other is paid 50% from the General Fund and 50% from the Sewer Fund. The savings in salaries and benefits from vacant positions will offset this contract cost. Legislative History: On June 12, 2023, the City Council Approved the Prequalification of Consulting Firms for Transportation Engineering and Surveying Services (RFQ 23-10). Locations were selected based on the existing condition of the alley and the need for storm sewer upgrades. Storm sewer improvements ranged between 400 ft and 1,500 ft for each alley. Pavement removal and excavation was completed with minimal disruption to the adjacent residential and commercial properties. Storm sewer pipes ranging from eight to twenty-four inches were installed along with new drainage structures. Alleys were backfilled to grade and paved with eight inches of Portland Cement Concrete. Additionally, sidewalk and curb and gutter located adjacent to the alley aprons were replaced in compliance with ADA Standards. Pre-existing conditions, construction progress, and completed as-builts were documented with quantities and photos, providing evidence of the work in each stage. Upon completion, final restoration and clean-up was done to ensure any disturbed areas were replaced as-is or better. Public involvement was also of the utmost importance, in keeping the residents of Evanston both informed and addressing any issues and concerns in a timely manner. This project was funded by the City of Evanston. The project included survey, geotechnical and environmental services, traffic data collection, traffic operations analysis, traffic signal design, pedestrian and bicycle accommodations, and preparation of contract bid plans for the modernized traffic signals. Topographic survey covered utilities, right-of-way, and roadside features from which a digital terrain model was developed. The geotechnical and environmental services performed resulted in an approved Categorical Exclusion. Traffic data was collected quickly and efficiently using Miovision video cameras to obtain peak hour traffic volumes. The focus of the project was to modernize three traffic signals on Emerson Street located at the intersections with Maple Avenue, Elgin Road, and Dodge Avenue, and one traffic signal at the intersection of Elgin Road and Benson Avenue. The modernization improvements included evaluation of peak-hour traffic operations and intersection lane arrangements, signal timing patterns throughout the day, adaptive signal timing, and the addition of a traffic signal interconnect system. The existing Clearwell No. 9 tank is the city’s largest potable water storage and chlorination mixing tank that was originally constructed in 1934 and serves the City of Evanston Water Treatment Plant. The Clearwell No. 9 underground tank is located on Northwestern University’s campus at the southwest corner of the intersection of N. Campus Drive and Lincoln Street. Assessment of the existing underground concrete tank through structural inspections resulted in a finding of limited remaining viable life of the original 1934 structure. This structural assessment resulted in the City of Evanston moving forward with a plan to replace the existing Clearwell No. 9 structure with a below grade 5-million-gallon capacity cast in place concrete Clearwell No. 9 replacement structure that fit within the footprint of the existing 1934 Clearwell No. 9 tank. TERRA provided plans and specifications for the removal of the existing at grade parking lot and replacement of the area with a 36-inch thick fiber reinforced topsoil and landscape section placed above the new below grade Clearwell No. 9 structure, removal and replacement of existing sidewalks, removal and replacement of damaged landscape areas due to construction site activities, the mill and grind of the surface course (top two inches) of the existing asphalt pavement along N. Campus Drive and Lincoln Street, stormwater drainage and erosion control plans, design of a 48”x24” mechanical joint tapping sleeve connection to an existing 48-inch diameter precast concrete pressure pipe water main, design of 107-lineal feet of 24-inch DIP potable water transmission line yard piping, design of 154-lineal feet of DIP storm sewer pipe, design of a 6-foot diameter dry well for sump pump discharge, civil site details, and the preparation of maintenance of traffic (MOT) plans. Engineering services included LSLR Program Development, Field Investigations, Design of Private Side LSLR Projects, Engineering Services During Construction of Private Side LSLR Projects and Project Management. The City of Evanston has a water main improvement program to replace 1%, or 1.5 miles, of the distribution system pipeline per year. The City currently replaces the City-owned portion of the service lines connected to the water mains replaced as part of the water main improvement pro-gram. The City-developed Drinking Water Lead Reduction Initiative is composed of the following elements: ƒLead Service Replacement (LSLR) Loan Program: In an effort to encourage and in-centivize property owners to replace lead water service pipes during water main re-placement work, the City is offering a zero interest loan to the property owner for the re-placement of the customer owned lead service line (between the shutoff valve and the house). The loan is for the full plumbing cost and is repayable to the City at $100 per month. ƒPoint of Use Filter Program: Under this Program, the City is offering a point- of-use fil-ter pitcher and two replacement filter cartridges to those properties where partial or full lead service line replacements occur in conjunction with the annual Water Main Im-provement Project. ƒPost Construction Lead Testing Program: Under this Program, the City is offering post construction lead testing approximately six weeks following full or partial lead service pipe replacements in conjunction with the annual Water Main Improvement Project. Additionally, the City will share the cost of replacing a lead service line with property owners who are not impacted by a water main replacement project. Under this program, if the property owner replaces the private portion of the water service (from their home to the valve located in the parkway) at their own expense, the City will replace the portion of the water service from the valve to the water main located in the street at no additional expense to the property owner. The project included roadway reconstruction with permeable pavement, storm sewer installation, water main replacement, combined sewer repairs and lining, curb and gutter, porous parkway areas, underdrains, street light pole replacement, erosion and sediment control, parkway restoration, and sidewalk installation. Kenilworth suffered a flooding event in 2008 that caused the Village Board of Trustees to identify and mitigate the causes of sewer surcharging and flooding. Kenilworth had a combined sewer system that allowed for stormwater mixing with sewage causing a surcharge of water and sewage into basements, streets, and Lake Michigan. A new sewer system was constructed allowing them to avoid the integration of stormwater into the sanitary sewer and Lake Michigan. The Green Infrastructure costs for this project were supported in part due to the generous support of the Metropolitan Water Reclamation District of Greater Chicago. The project included replacement of existing infrastructure, streetscape enhancements, pedestrian upgrades and new traffic signals. TERRA assisted the city throughout the public involvement process and developed a comprehensive plan for the intersection and regional improvements that considered public input. TERRA provided site civil engineering, landscape architecture, and construction engineering services on this fast-track project which allowed six months for design and construction. The City of Peoria was intent on managing total project costs while providing a high-quality product. The intersection reconstruction work included a “road diet” reducing the intersection from six lanes to three, and creating curb bump outs with landscaped rain garden planters and decorative seat walls to improve the streetscape experience. The intersection was raised to create a “tabletop,” placing the focus on pedestrians and calming traffic speeds. Signal improvements included new traffic signals which incorporate an all-pedestrian phase, allowing diagonal crossings. Regional improvements include new midblock crosswalks with in-roadway lighting and pedestrian activated beacons around the Bradley University campus, along with neighborhood vehicular traffic calming measures to minimize traffic impact due to reduced intersection capacity. Nothing herein shall be construed as a limitation or waiver of defenses available to the City and employees and agents, including but not limited to the Illinois Local Governmental and Governmental Employees Tort Immunity Act, 745 ILCS Doc ID: 53be52ce65e2bf0c255ccd2cc851988659b0da48 10/1-101 et seq. At the City Corporation Counsel’s option, Consultant must defend all suits brought upon all such Losses and must pay all costs and expenses incidental to them, but the City has the right, at its option, to participate, at its own cost, in the defense of any suit, without relieving Consultant of any of its obligations under this Agreement. Any settlement of any claim or suit related to this Agreement by Consultant must be made only with the prior written consent of the City Corporation Counsel, if the settlement requires any action on the part of the City. To the extent permissible by law, Consultant waives any limits to the amount of its obligations to indemnify, defend, or contribute to any sums due under any Losses, including any claim by any employee of Consultant that may be subject to the Illinois Workers Compensation Act, 820 ILCS 305/1 et seq. or any other related law or judicial decision, including but not limited to, Kotecki v. Cyclops Welding Corporation, 146 Ill. 2d 155 (1991). The City, however, does not waive any limitations it may have on its liability under the Illinois Workers Compensation Act, the Illinois Pension Code or any other statute. Consultant shall be responsible for any losses and costs to repair or remedy work performed under this Agreement resulting from or arising out of any act or omission, neglect, or misconduct in the performance of its Work or its sub- consultants’ work. Acceptance of the work by the City will not relieve the Consultant of the responsibility for subsequent correction of any such error, omissions and/or negligent acts or of its liability for loss or damage resulting therefrom. All provisions of this Section shall survive completion, expiration, or termination of this Agreement. L. Insurance. Consultant shall carry and maintain at its own cost with such companies as are reasonably acceptable to City all necessary liability insurance (which shall include as a minimum the requirements set forth below) during the term of this Agreement, for damages caused or contributed to by Consultant, and insuring Consultant against claims which may arise out of or result from Consultant’s performance or failure to perform the Services hereunder: (1) worker’s compensation in statutory limits and employer’s liability insurance in the amount of at least $500,000, (2) comprehensive general liability coverage, and designating City as additional insured for not less than $3,000,000 combined single limit for bodily injury, death and property damage, per occurrence, (3) comprehensive automobile liability insurance covering owned, non-owned and leased vehicles for not less than $1,000,000 combined single limit for bodily injury, death or property damage, per occurrence, and (4) errors and omissions or professional liability insurance respecting any insurable professional services hereunder in the amount of at least $1,000,000. Consultant’s certificate of insurance shall contain a provision that the coverage afforded under the policy(s) will not be canceled or reduced without thirty (30) days prior written notice (hand delivered or registered mail) to City. Consultant understands that the acceptance of certificates, policies and any other documents by the City in no way releases the Consultant and its sub-contractors from the requirements set forth herein. Consultant expressly agrees to waive its rights, benefits and entitlements under the “Other Insurance” clause of its commercial general liability insurance policy as respects the City. In the event Consultant fails to purchase or procure insurance as required above, the parties expressly agree that Consultant shall be in default under this Agreement, and that the City may recover all losses, attorney’s fees and costs expended in pursuing a remedy or reimbursement, at law or in equity, against Consultant. Upon notification from the City that it has received a Freedom of Information Act request that calls for records within the Consultant’s control, the Consultant shall promptly provide all requested records to the City so that the City may comply with the request within the required timeframe. The City and the Consultant shall cooperate to determine what records are subject to such a request and whether or not any exemption to the disclosure of such records or part thereof is applicable. Vendor shall indemnify and defend the City from and against all claims arising from the City’s exceptions to disclosing certain records which Vendor may designate as proprietary or confidential. Compliance by the City with an opinion or a directive from the Illinois Public Access Counselor or the Attorney General under FOIA, or with a decision or order of Court with jurisdiction over the City, shall not be a violation of this Section.
