Stenstrom Petroleum Services Group - Service Center North Fuel Island Replacement (Bid 23-58)
Memorandum To: Honorable Mayor and Members of the City Council CC: Members of Administration and Public Works Committee From: Stefanie Levine, Senior Project Manager. CC: Edgar Cano - Public Works Agency Director; Lara Biggs - City Engineer Subject: Contract Award with Stenstrom Petroleum Services Group for the Service Center North Fuel Island Replacement Project (Bid 23-58) Date: February 12, 2024 Recommended Action: Staff recommends the City Council authorize the City Manager to execute an agreement with Stenstrom Petroleum Services Group (2422 Center Street, Rockford, Illinois 61108) for the Service of the in 23-58) (Bid amount Replacement Island Fuel North Center Project $1,577,362.00. A waiver of the City's Local Employment Program requirements requires a 2/3 vote of the City Council. Funding Source: Funding is provided from the Capital Improvement Fund 2024 General Obligation Bonds (Account of budget 2024 FY which an has 415.40.4124.65515-623007), approved $1,700,000 and a YTD balance of $1,700,000. Council Action: For Action Summary: Constructed in 1980, the 139,566 square-foot Evanston Municipal Service Center is located at 2020 Asbury Avenue. Consisting of four interrelated building wings and two storage facilities, the complex serves as the heart of City operations, housing Public Works, Facilities and Fleet Management, and Parking Services operations. The existing complex has two fuel islands, mainly original to the facility's construction. Both islands are far beyond their useful life and in need of replacement. After an extensive master planning effort, it has been determined that the north fuel island will be replaced first. In the long term, it is hoped that the south fuel island can be eventually removed if all fueling service needs can be met at the new north island. Doc ID: e26629d46284e28d0a343a4cbef5061ce1e3b3bb On February 27, 2023, the City Council approved the award of a contract to Greeley and Hansen to design the new north fuel island. Since that time, staff, Greeley, and Hansen have worked together to develop the project's design solution. This project is the first construction project to be awarded from the Service Center Master Plan discussed at the City Council on January 8, 2024. The project was originally bid in October 2023, but no bids were received. After discussion with prospective bidders, staff and Greeley and Hansen modified the construction documents to help make the project more palatable. Modifications to the documents included technical changes, City's the of waiver full a Local materials alternate accepting as such to Employment (LEP) and M/W/E/DBE programs. On December 20, 2023, the option of a full waiver was reviewed by the M/W/EBE Development Committee. Without a quorum present for the discussion, the Committee noted that this project's specialty work and unique hazards might merit a waiver in this case but that this should not be considered setting a precedent for other similar projects. The project was then issued for bid a second time, as described below. Analysis: This contract was advertised for bid on December 21, 2023. On January 16, 2024, the City received two bids as follows: Stenstrom Petroleum Services Group (Stenstrom) is a licensed contractor with the Illinois State Fire Marshal and has worked with the City to provide interim repairs to the north fuel island on multiple occasions. Staff has reported that Stenstrom has always been a reliable contractor Stenstrom's checked also Hansen and has well. performed and Greeley references, receiving positive reviews on installations similar to or larger than the Service Center project. Staff, therefore, recommends an award to Stenstrom Petroleum Services Group at a total cost of $1,577,362. Completion of this project is anticipated in late October 2024. As noted above, this bid included a full waiver of the City's Local Employment Program (LEP) and M/W/E/DBE programs in an effort to attract bidders following a lack of bids received during a previous bid attempt. A discussion of the waiver is included in the attached memo. Legislative History: On February 27, 2023, the City Council approved a contract with Greeley and Hansen, LLC, for engineering services related to the North Fuel Island Replacement. In an effort to make the bidding environment more attractive for prospective vendors, staff requested 100% waivers of the MWDEBE and LEP programs during the project’s second bidding. The waiver request was based on the lack of bid response to Bid #23-49 and the subsequent direct feedback related to the MWDEBE and LEP programs PWA Staff received from multiple vendors who specialize in this work. Lara Biggs, Capital Planning and Engineering Bureau Chief attended the city’s MWEBE Development Committee meeting held December 20, 2023, to discuss the project. The Committee was informed that the replacement of the Service Center’s north fuel island is a mission critical project for the city. Ms. Biggs shared an overview of the unique project scope and work that would be performed by the vendor; the perspective and feedback from the then potential bidders of Bid 23-49; and requested guidance from the Committee. After a lengthy discussion the Committee acknowledged the replacement of the Service Center’s north fuel island project work is highly technical and specialized work in nature and recognized the limited number of potential qualified vendors. The MWDEBE Committee agreed (no quorum/ no vote) this is a critical project, and it precludes applying the city’s MWDEBE subcontracting goal and LEP participation. If we cancel or non-renew this Coverage Part by written notice to the first Named Insured, we will mail or deliver notification that such Coverage Part has been cancelled or non-renewed to each person or organization shown in a list provided to us by the first Named Insured if you are required by written contract or written agreement to provide such notification. However, such notification will not be mailed or delivered if a conditional notice of renewal has been sent to the first Named Insured. Such list: 1. Must be provided to us prior to cancellation or non-renewal; 2. Must contain the names and addresses of only the persons or organizations requiring notification that such Coverage Part has been cancelled or non-renewed; and 3. Must be in an electronic format that is acceptable to us. B. Our notification as described in Paragraph A. of this endorsement will be based on the most recent list in our records as of the date the notice of cancellation or non-renewal is mailed or delivered to the first Named Insured. We will mail or deliver such notification to each person or organization shown in the list: 1. Within seven days of the effective date of the notice of cancellation, if we cancel for non-payment of premium; or 2. At least 30 days prior to the effective date of: a. Cancellation, if cancelled for any reason other than nonpayment of premium; or b. Non-renewal, but not including conditional notice of renewal. C. Our mailing or delivery of notification described in Paragraphs A. and B. of this endorsement is intended as a courtesy only. Our failure to provide such mailing or delivery will not: 1. Extend the Coverage Part cancellation or non-renewal date; 2. Negate the cancellation or non-renewal; or 3. Provide any additional insurance that would not have been provided in the absence of this endorsement. D.
