A RESOLUTION
Authorizing the City Manager to Execute an Intergovernmental
Agreement with the Skokie Park District for a Reciprocal Fee
Agreement for Resident and Non-Resident Access to Certain Grounds
and Facilities
WHEREAS, the City and Park District are units of local government as
that term is defined in Article VII, Section 1, of the Illinois Constitution of 1970, and
public agencies as that term is defined in Section 2 of the Intergovernmental
Cooperation Act, 5 ILCS 220/2; and
WHEREAS, Article VII, Section 10 of the Illinois Constitution of 1970
provides that units of local government may contract or otherwise associate among
themselves to obtain or share services and to exercise, combine or transfer any power
or function in any manner not prohibited by law or by ordinance and may use their
credit, revenues and other resources to pay costs related to intergovernmental
activities; and
WHEREAS, the Illinois Intergovernmental Cooperation Act, 5 ILCS 220/1
et seq. further provides that any power or powers, privileges, functions, or authority
exercised or which may be exercised by a public agency of this State may be exercised,
combined, transferred, and enjoyed jointly with any other public agency of this State;
and
WHEREAS, the Parties have a history of intergovernmental cooperating,
including entry into a series of intergovernmental agreements dating back to at least

1991 regarding reciprocal fee agreements for resident and non-resident use of the
City’s beach and the Park District’s outdoor swimming pools; and
WHEREAS, the Parties have determined that it is in their respective best
interests and the interests of their residents to continue with a reciprocal fee agreement
for these facilities, but with to update the terms and conditions as set for in the
Intergovernmental Agreement (“Agreement”), attached hereto as Exhibit A; and
WHEREAS, the Parties have determined that it is in their respective best
interests and the interests of their residents to continue the shared usage contemplated
by the Original IGA, but wish to update the terms and conditions as set forth in this
Agreement; and
WHEREAS, the Parties have determined that the intergovernmental
cooperating and reciprocal fee agreement contemplated by the Agreement will not
interfere with either Party’s delivery of recreational activities for its residents and have
further determined that said cooperation will expand and promote public recreational
opportunities for the Parties’ mutual communities and the general public; and
WHEREAS, the Evanston City Council has determined that it will serve
and be in the best interest of the City to enter into the Agreement;
NOW BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: The City Council hereby adopts the foregoing recitals as its
findings, as if fully set forth herein.

SECTION 2: The City Council hereby approves, pursuant to the City of
Evanston’s home rule power, the Agreement in the form attached to this Resolution as
Exhibit A.
SECTION 3: The City Manager is hereby authorized to sign the
“Intergovernmental Agreement Between the City of Evanston and Skokie Park District
for a Reciprocal Fee Agreement for Resident and Non-Resident Access to Certain
Grounds and Facilities”, attached hereto as Exhibit A and incorporated herein by
reference.
SECTION 4: This Resolution shall be in full force and effect from and after
its passage and approval in the manner provided by law.
