A RESOLUTION
Authorizing the City Manager To Execute Construction Easement
Purchases for the Green Bay Road Corridor Improvement Project
WHEREAS, Green Bay Road is a major north-south arterial road through
the City’s Central Business District. and the Green Bay Road Corridor has significant
pedestrian, bus, and vehicular traffic; and
WHEREAS, the Green Bay Road Corridor Improvement Project aims to
address street resurfacing, streetscape improvements, modernizing traffic signals at
Lincoln Street, Central Street and Livingston Street intersections, pedestrian and
vehicular access improvements, and street light upgrade and ADA Ramps at all the
intersections; and
WHEREAS, because the adjacent properties to the Project extend to the
edge of the sidewalk and have no offset, the contractor has to use a portion of private
property during construction to build the new sidewalk; and
WHEREAS, according to the Illinois Department of Transportation (IDOT)
policy and guidelines, any area used outside the right-of-way limits for construction must
have an approved easement.; and
WHEREAS, City staff have successfully negotiated the use of the private
property for temporary construction easements with the property owners, and the
construction easement area has been appraised by a third-party and the cost has been

determined as per IDOT guidelines. A copy of the certified review appraisals is
attached hereto as Exhibit 1 and incorporated herein by reference; and
WHEREAS, the City will be using temporary construction easements from
three adjacent property owners with the easement costs of $15,500, $34,000, and
$11,500, respectively; and
NOW BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON, COOK COUNTY, ILLINOIS:
SECTION 1: The foregoing recitals are hereby found as fact and
incorporated herein by reference.
SECTION 2:The Construction Easement Purchases for the Green Bay
Road Corridor Improvement Project are hereby approved and the City Manager is
hereby authorized and directed to execute the Purchase Agreements.
SECTION 3:The City Manager is hereby authorized and directed to
negotiate any additional conditions of the Agreements as may be determined to be in
the best interests of the City.
SECTION 4:All prior ordinances, resolutions or motions, or parts of
ordinances, resolutions, or motions in conflict with any of the provisions of this
Resolution shall be, and the same are hereby repealed to the extent of conflict.
SECTION 5:This Resolution and every provision thereof shall be
considered severable. If any section, paragraph, clause, or provision of this Resolution
is declared by a court or law to be invalid or unconstitutional, the invalidity or
unconstitutionality thereof shall not affect the validity of any other provisions of the
Resolution.

SECTION 6:This resolution shall be in full force and effect from and after
its passage and approval, in the manner provided by law.
