Kaminski Presiding Official: Alderman Romain Summary of Action The meeting of the Police Services Committee was convened at 7:45 P.M. by Alderman Romain at the Evanston Civic Center in room 2402. The following agenda items were covered. Item I - Minutes Minutes of the November 20, 1984 meeting were reviewed and accepted. Item II - Communications • The January 1985 ALERT was reviewed. • The minutes from the Residential Crime Prevention Committee were accepted. • The inspection report of the lockup facility was reviewed. • The most recent response time update was reviewed. • The memo from Herb (fill regarding cite trespass ordinance for Evanston Township High School was discussed. Alderman Morton made a motion to introduce the ordinance to council. The Committee ap- proved the motion. • The Committee discussed the memo from Sharon Eiseman regarding the Parental Responsibility Ordinance. In her memo, Ms. Eiseman identified four questions in which she needed additional information regarding the ordinance. The Committee addressed these questions. The Committee requested that the staff put together a response to Ms. Eiseman's memo be sent to some citizens. The ordinance will again be discussed at the next meeting. • The Committee reviewed the Neighborhood Foot Patrol Evaluation. The Committee indiecaced the report was very professional and thorough. • Citizen letters were reviewed. • The Career Development Program was discussed. 2-2b-85 Page I of 3 Item III Complaint Reviews • 84-021 Complainant: B/M (35) Charges: Physical Mistreatment Accused: W/M (33 & 31) Uniformed Summary: The complainant alleged that the accused officers physically mistreated him during an arrest. Specifically, the complainant claims he was grabbed by the neck and choked. The accused officers denied the allegation and indicated that they used reasonable force to control the complainant as he resisted the arrest. Disposition: Not Sustained Review: Accepted • 84-031 Complainant: W/M & W/F (48 & 28) Charges: Unnecessary Force, Illegal Search, Failure to Identify Accused: B/M (34) Uniformed Summary: The complainants alleged that the accused Officer pushed her with his hand and illegally searched and entered a rear porch of their residence. When asked for his name and star number, the accused officer apparently refused the complainant's request. The accused officer denied the allegations and stated he acted within the scope of his office. Disposition: Sustained Review: Accepted • 84-037 Complainant: Charges: Accused: B/M (35) Harassment B/M (32) Uniformed Summary: The complainant alleged chat the accused officer harassed him after stopping a car in which he was a passenger. The accused officer denied the allegation and stated he performed his duties within the scope of the law. Disposition: Not Sustained Review: Accepted • 84 -04 1 Complainant: B/M (48) Charges: Unprofessional Conduct Accused: W/M (46) Uniformed Summary: The complainant alleged chat the accused officer threw pieces of a ripped ticket in his face. The accused officer denied the allegation and stated he was returning the pieces of the ticket the complainant had torn up. Disposition: Not Sustained 2-26-85 Page 2 of 3 Review: Accepted • 84-042 Complainant: W/Fs (28 & 31) Charges: Unprofessional Attitude Accused: W/M (33) Uniformed Summary: The complainants alleged that the accused officer was rude to them when he handled a call regarding a girl sleeping in a hallway. The accused officer denied the allegation and stated he acted properly. Disposition: Exonerated Review: Accepted • 84-04 3 Complainant: Charges: Accused: W/M (19) Excessive Force W/M (35) Uniformed Summary: The complainant alleged that the accused officer used excessive force during his arrest after being involved in a high speed chase throughout several suburbs. The officer denied the allegations. Disposition: Exonerated Review: Accepted IV - Other Business • The Committee reviewed the literature on the stun gun. If possible, they requested a demonstration of the device and additional information. • Ms. Elaine Johnson from the Animal Control Commission addressed the Committee regarding proposed Ordinance 9-0-85 - Number of Dogs that Occupy a Premise. In addition, the Committee was asked to respond to a memo from Brian Coyman regarding the proposed ordinance. The two issues before Hic Committee were ,is follows: should the number of dogs allowed per family be increased from two to four; and, should enforcement responsibility be given to the Animal Warden or Zoning Department. The Committee recommended that the number of dogs be limited to three and the enforcement responsibility be limited to the Animal Control Warden. Alderman Romain made a motion that the Committee support a cat leash law. The motion was seconded by Alderman Neems and passed. Presiding Official: Alderman Robert Romain The meeting of the Police Services Committee was convened at 7:45 p.m. by Alderman Romain at the Evanston Civic Center, room 2402. The following agenda items were considered. Item I - Minutes Minutes of the February 19, 1985, meeting were reviewed and accepted with one correction. Alderman Morton mentioned that at the meeting, the Committee discussed that they will make a regular report to Council on the activity at the Police Services Committee. Item II - Communications • The March 1985 ALERT was reviewed. Alderman Morton commended the Department on the crime statistics. • RCPC minutes were reviewed. • A letter from the Public Complaints Commissioner was reviewed. The Committee requested that additional information be obtained regarding this organization. f Citizen letters were reviewed. • Information on the stun gun was reviewed. Chief Logan indicated that the Department would like to examine this device further before taking action. p The Trepass Ordinance is being prepared for Council consideration. Item III - Complaint Review • 85-001 Complainant: B/M (38) Charges: Failure to Identify Accused: W/M (33) Off -duty Officer lb Summary: The complainant alleged.that the accused officer failed to identify himself as a police officer. The accused officer, who was working an off -duty detail in plain clothes, denied the allegation. Disposition: Exonerated Review: Accepted Item IV - Other Business • The Parental Responsibility Ordinance was discussed. Sharon Eiseman, Assistant Corporation Council, was present to discuss several questions she had proposed to the Committee. Representatives from the Parent Teachers Association were present to provide input. Alderman Romain presented comments from other Council members regarding the Ordinance. Sharon Eiseman will provide a final draft for the next meeting. • The Committee discussed the Board and Commission Review Report. Further action was deferred to the next meeting. • Chief Logan distributed a Victim Card Survey to the Committee. The card is currently being sent to crime victims in order to evaluate our service. The meeting of the Police Services Committee was convened at 7:45 p.m. by Alderman Romain at the Evanston Civic Center in room 2402. A quorum was not present, so no action was taken at this time. The following agenda items were considered. Item I - Minutes Minutes from the March 19, 1985, meeting were reviiwed but not voted upon. Item II - Communications • Training Bureau Summary was reviewed. • Citizen letters were reviewed. • Ordinance on cat leashes was deferred for the new Committee. • Information from the Public Complaints Commissioner was reviewed. Item III - Complaint Reviews None. Item IV - Other Business • Draft Parental Responsibility Ordinance was discussed with several citizens in the audience. Some citizens requested data to support the new Ordinance. Staff indicated that information would try to be obtained. Members Absent: Alderman Jack Korshak Staff Present: Chief William Logan and Commander Frank Kaminski Presiding Official: Alderman Bleveans The meeting of the Police Services Committee was convened at 7:45 p.m. by Alderman Bleveans at the Evanston Civic Center in room 2402. The following agenda items were considered. Item I - Minutes Minutes of the April 16, 1985, meeting were reviewed, but not approved, because none of the members present were at the last meeting. Item 1I - Communications • The May issue of the ALERT was reviewed. • Minutes from the Residential Crime Prevention Committee were reviewed and accepted. • The Committee discussed the Amendment to the Trespass Ordinance which changes the definition of a minor from under 18 years to under 17 years of age. This change was requested by the Police Department to facilitate enforcement and to handle 17 year -old violators as adults. After further discussion, the Committee also requested that the definition of a trespasser be changed to read: Any person who enters upon school lands or in school buildings after receiving notice that such entry is forbidden, and remains upon such land or in such building after receiving oral or written notice to depart from any person authorized by the appropriate school board to provide such notice. A motion was made by Alderman Morton to accept these changes to the Ordinance. Alderman Nelson seconded the motion, and it was unanimously approved. Alderman Bleveans requested that this Ordinance with the changes be introduced at the special June 3 Council meeting. 5-21-85 Page I of 3 • Citizen letters were reviewed. a Response time reports were reviewed. Item III - Complaint Reviews 84-040 Complainant: W/M (32) Charges: Improper display of weapon Accused: B/M (33) Off duty Summary: The complainant alleged that the accused officer pointed a handgun at him while he was employed as an attendant at a service station. The accused officer denied the allegation. Disposition: Not sustained Review Accepted • 84-002 Complainant: W/M (63) Charges: Verbal abuse Accused: W/M (46) Uniformed sergeant Summary: The complainant alleged that the accused sergeant was verbally abusive toward him during a telephone conversation concerning. his car being towed, and then on the following evening, he observed the same sergeant verbally abuse two female citizens at the police station when they inquired about their vehicles. This all occurred during the snow emergency. The accused sergeant claimed that he did not recall these incidents because he had hundreds of complaints during the snow emergency. Disposition: Sustained Review: Accepted Chief Logan stated that in future snow emergency situations, he plans to split the functions of towing and tow releasing in order to avoid these types of problems. Item IV - Other Business • The Committee discussed the draft of the Parental Responsibility Ordinance and made the following draft changes: Page 1, Paragraph 4: "such responsibility will aid in discouraging alcohol abuse, thereby presumably decreasing the incidence of traffic accidents and anti -social behavior, such as juvenile offenses including vandalism, theft, and disorderly conduct;" Page 3, (B) Exceptions: Eliminate 2 A motion was made by Alderman Nelson to approve the Ordinance with these changes. The motion was seconded and unanimously passed. The following agenda items were considered. Item I - Minutes Minutes of the May 21, 1985, meeting were reviewed and accepted with one change on page 1, Item II, the third point. With reference to the definition of a trespasser, the "and" in the third line should be an "or." Item II - Communications e An informational letter about the PSC was reviewed. Alderman Bleveans requested that his stationery be used for future letters. • Minutes from the Residential Crime Prevention Committee were reviewed. • Training bulletins on parental responsibility and the trespass ordinances were reviewed. It was suggested that the ALERT publish an article on the Parental Responsibility Ordinance. e The Catalyst article on the Community Aid Program and the Education/Age Survey were reviewed. s The Handicapped Parking Amendment was reviewed. The Committee requested to know if anyone from City Nall had authority to write tickets for this violation. Chief Logan responded that Max Rubin has the authority to issue parking citations around the Civic Center. • A memo regarding the in-service training on street gangs was reviewed. • The citizen letters were accepted, and the Committee requested that other Council members be informed of these letters. Alderman Bleveans requested that all the letters in this packet be sent to all Council members with a memo from him indicating that in the future, a representative sample of letters will be sent to Council members. 7-16-85 Page 1 of 3 e General Order 16 was reviewed. The Committee requested a better copy. e Alderman Korshak requested that the Committee discuss supplementary police services provided Northwestern University, and he questioned whether the University should bear the cost when more than routine services are needed, i.e., the recent demonstrations. The Committee requested that staff research how other communities with universities handle this. Item III - Complaint Reviews • 85-003 Complainant: W/M (16) Charges: Excessive force Accused: B/M (32) civilian Parking Enforcement officer Summary: The complainant alleged that the accused Parking Enforcement officer grabbed him by the neck and forced his face down on a table. The accused officer admitted to grabbing the complainant after being harassed and provoked. Disposition by Chief: Sustained Review by Committee: Accepted a 85-004 Complainant: B/M (24) Charges: Excessive force Accused: W/M (40) uniformed sergeant Summary: The complainant alleged that the accused officer unnecessarily used mace during his arrest. The accused officer admitted to using mace and stated that it was necessary -to effectuate the arrest. Disposition by Chief: Not sustained Review by Committee: Accepted s 85-006 Complainant: B/M Charges: Excessive force Accused: B/M Summary: The complainant alleged that the accused officer physically mistreated and verbally abused him. The accused officer denied the allegation and stated his actions were within the scope of the law. This incident occurred during the execution of a narcotics search warrant. The accused officer denied the allegation. The accused officer stated the complainant was intoxicated and with several friends when he confronted him and became abusive. When the complainant and his friends surrounded the accused officer, he defended himself. Disposition by Chief: Unfounded Review by Committee: Accepted Item IV - Other Business • The Draft Antique Ordinance was reviewed and discussed. The Committee had several questions in reference to the difference between junk and antiques. The Committee requested that this be evaluated by staff. • The Committee reviewed the Case Screening Program Chief Logan indicated that he plans to implement in the near future. The following agenda items were considered. Item I - Minutes Minutes of the July 16, 1985, meeting were reviewed and accepted. Item II - Communications a The news release on the newly formed Research Advisory Committee was reviewed. Chief Logan notified the Committee of the individuals on the Research Advisory Committee. a General Order 16 was accepted. a Response Time Reports were reviewed and accepted. The Committee requested a report on the number of part I calls per capita for Evanston and surrounding communities. a The citizen letters were accepted. a The PSC Letter was reviewed and accepted. a The University Special Events Survey/Incident Summary Report was reviewed. The Committee requested Chief Logan to develop a proposed Evanston Police Department/Northwestern University compact and present it to the Police Services Committee. a The report on narcotic raids and arrests was reviewed and accepted. Chief Logan informed the Committee that the increases in the number of raids and arrests are due to the high priority that has been placed on narcotic traffickers. 9-17-85 Page 1 of 4 The Civilian Traffic Control Program was reviewed and accepted. Chief Logan informed the Committee of the cost savings that will be realized with the implementation of this program. • The E.T.H.S. Security Log was reviewed and accepted. Item III - Complaint Reviews Upon receiving a complaint from a citizen regarding the conduct of a member of the Department, an official complaint register number is initiated and an initial investigation is conducted. This report is then forwarded to the Internal Affairs Division where a formal investigation is conducted which involves interviews of the complainant, witnesses, and accused member. The completed investigation is then forwarded to the accused member's deputy chief who makes a disposition in reference to the case (e.g. unfounded, not sustained, sustained, etc.). If the complaint is sustained, a disciplinary recommendation is given. This process is also shared with the member's supervisors. The entire complaint is reviewed by the Chief and he makes the official disposition. The Police Services Committee reviews all complaints. The Committee does not have authority to overturn any disposition made by the Chief. • 85-010 Complainant: B/M (56) Charges: Excessive force Accused: W/M (40) uniformed sergeant Summary: The complainant alleged that the accused sergeant used excessive force to effect his arrest. The accused sergeant related that minimal force was used to effect the arrest only after the complainant became the aggressor after being advised he was under arrest. Disposition by Chief: Unfounded Review by Committee: Accepted • 85-011 Complainant: B/F (46) Charges: Excessive force Accused: Unknown officer Summary: The complainant alleges that while officers were executing a search warrant at her residence she observed that her son was being taken into custody and upon going to his aid a struggle ensued and she was struck in the eye by an unknown officer. The property inventory sheet disclosed that the officers removed only three chains from the complainants possession at the time of her arrest. Disposition by Chief: Unfounded Review by Committee: Accepted • 85-014 Complainant: Unknown citizen Charges: The complainant alleges that an officer had a Black/Female in the front seat of a squad car, and was making sexual advances towards her. Accused: B/M (34) Summary: Information provided by the complainant for subsequent contact was bogus, and all attempts to contact the alleged victim were met with negative results. Disposition by Chief: Unfounded Review by Committee: Accepted • 85-015 Complainant: B/M (36) Charges: Discrimination during accident investigation Accused: W/M (42) uniformed officer Summary: The complainant alleged that the accused officer discriminated against him while investigating an accident in which he was involved. Disposition by Chief: Sustained (Two -Day Suspension) Review by Committee: Accepted 85-017 Complainant: W/M (21) Charges: Failure to provide name and star number Accused: W/M Uniformed Desk Officer Summary: The complainant alleged that the accused officer did not provide police service when he called requesting assistance regarding a parking complaint. Further, when he requested the officer's name and star number, the officer hung -up the phone. The accused officer stated that the complainant was shouting at him and hung -up when he could no longer understand him. Disposition by Chief: Sustained (Oral Reprimand) Review by Committee: Accepted 0 85-021 Complainant: B/F Charges: Improper Conduct Accused: B/M Uniformed Summary: The complainant alleged that the accused officer 10-15-85 Page 2 of 3 (the complainant's husband) failed to provide adequate shelter for her and his family. Disposition by Chief: Non -City Related Review by Committee: Accepted Item IV - Other Business Alderman Thiel addressed the Committee and discussed the ordinance pertaining to the number of dogs that can legally occupy a premise. Apparently, the current ordinance defines the number of dogs allowed per dwelling unit, not property parcel. After considerable debate, Alderman Bleveans indicated he would forward a memo to the Legal Department regarding this problem. Also, the Committee discussed "Pit Bulls". Committee requested staff to research ordinances/laws pertaining -.o to these dogs. Logan, Commander Frank Kaminski Alderman Bleveans The meeting of the Police Services Committee was convened at 7:45 p.m. by Alderman Bleveans at the Evanston Civic Center in room 2402. The following agenda items were considered. Item I - Minutes Minutes of the October 15, 1985, meeting were reviewed and accepted with one correction. Item II - Communications 9 The notice for the Awards Program was read. • The flyer on the Retail Loss Prevention Seminar was read. • Chief Logan reviewed the new organizational changes and promotions. Chief Logan also commented on the new inspectional functions to be implemented in the near future. a The citizen letters were reviewed. Alderman Bleveans mentioned that he would read some of the letters at the next council meeting. • The informational requests were reviewed. • The Committee expressed admiration and pleasure in the report of successful foot patrols. It expressed belief that an expansion of the program would be in the interest of the community, and invites the City Manager to express an opinion as to the feasibility of such expansion, and possible council actions which might be necessary to effect it. Item III - Complaint Reviews - !lone 11-19-85 Page 1 of 2 Item IV - Other Business Mote: The items on the agenda were not followed in the exact manner listed. e Approximately seventy-five people attended the meeting in reference to the Antique Ordinance. Alderman 8leveans explained the history and purpose of the pending ordinance to the audience. In retrospect, he indicated that input from antique dealers should have been solicited at an earlier stage in the development of the ordinance. Alderman Nelson made a motion to drop the ordinance from further consideration. The motion was unanimously passed. Alderman 8leveans then suggested that representatives from the antique dealers and the police department meet to discuss how to deal with some of the problems related to the ordinance. Chief Logan agreed to facilitate this meeting. s The Committee then discussed the memo from Ellen Szymanski, Legal Department, regarding the number of dogs per premise. The Committee requested further consideration from the Legal Department be given as to just changing the definition of premises to dwelling in the current ordinance. Respectfully submitted, am H.
