LIQUOR CONTROL REVIEW BOARD

Members of the Liquor Control Review Board began the meeting at
3:00 PM and considered the following agenda items.
- To review application of Osco Drug Inc. for a Class R package liquor
license for their retail store at 1630 Sherman Avenue.
The following employee& of Osco Drug Inc. were present to provide information
on the application.

Mayor Barr opened the meeting by reviewing the requirements of the Evanston
liquor license law with the Osco representatives. Mayor Barr stated that
alcoholic beverages arc not allowed to be sold to minors under twenty one
years of age. She stated that the requirements of the City lawn are strictly
enforced. The representatives of Osco all stated that the requirements of the
Evanston liquor license law would be strictly followed.
Mr. Anderson presented plans for the 1630 Sherman Avenue store. Mr. Anderson
stated that the package liquor sale area would be at the north west corner of
the building and would have an entrance direct from the remainder of the
store. The area would contain 2.500 square foot. There would be an eight foot
grate and door that would separate the liquor sales area from the remainder
of the store. The liquor section would use a common storage area with the
rest of the store.
The Mayor and Commissioners reviewed the Osco plans and compared these plans
to the requirements of the Evanston City Code. The Board concluded that the
Osco plans as presented did not comply with the requirements of the code.

Mr -Anderson and his associates were informed that among other considerations,
the liquor sale area would have to comply as ■ minimum as follows:
a. The liquor sale area cannot be allowed to be accessed from the remainder
of the store. Ingress and •gross must be by a door direct to the street.
b. There must be a solid wall separating the liquor sales area from the
remainder of the store. A short air vent would be allowed at the top.
C. The liquor storage area must be maintained separate from the remainder
of the store storage area.
Mr -Anderson and the Osco representatives stated that Mr. Shook had previously
advised them of these requirements. Nevertheless they were in hopes that a
license could be allowed under the plans as presented.
Mayor Barr and the Cossaissioners then reiterated that the building plane as
presented would not qualify. The 'Board members acknowledged the fine
operation of Osco reta13 service■ in the cosimunity. The Mayor encouraged Osco
to revise the plan■ and place them in conformity with the Evanston Ordinance.
Mr. Anderson stated that be would ask Osco officials to review the Satter
further. They would determine whether the corporation would be willing to
apply for a liquor license featuring a physically separate liquor sales area.
Mr. Anderson stated he would notify the Board whether or not Osco would
return with a qualified set of plans.
The Osco representatives thanked the Mayor and Commissioners for the bearing.
The Board then reTiewod other liquor license natters.
It was noted that Hanlake Trading Co. was negotiating for a retail store
lease on promises at 624 Davis Street. Mr. Shenk was instructed to contact
Hanlake and find out the status of these negotiations. Hanlake is s package
liquor Class H license applicant.
Mayor Harr reported that pizza Hut had applied for a Class D liquor license
and that The Best Spot had closed and the Class C liquor license voided.

Members of the Liquor Control Review Board began the meeting at
10:30 AM and considered the following agenda items.
AGENDA
- To continue the review of the application of Osco Drug Inc. for a Class
H package liquor license for their retail store at 1630 Sherman Avenue.
The following employees of Osro Drug Inc. were present to provide information
on the application.

Mr. Anderson presented revised plans for the 1630 Sherman Avenue store. Mr.
Anderson stated that the package liquor sale area would still be at the North
West corner of the building. The only customer entrance to the package liquor
sales area would be direct from the street (Church Street). The area would
contain 2,500 square feet. There would be a permanent wall that would
separate the liquor sales area from the remainder of the store. The package
liquor sales area would have its own separate storage area.
The Mayor and Commissioners reviewed the Osco plans and compared these plans
to the requirements of the Evanston City Code. The Board concluded that the
Osco plans as revised did comply with the requirements of the code.
Mayor Barr then again reviewed the requirements of the Evanston liquor
license law with the Osco representatives. Mayor Barr stated that alcoholic
bevereagee are not allowed to be sold to minors under twenty one years of
age. She stated that the requirements of the City law are strictly enforced.
The representatives of Osco all stated that the requirements of the Evanston
liquor license law would be strictly followed.
Kr. Sullivan, the store manager, stated that all employees in the liquor
sales area would be thoroughly trained on the requirements of the city law.
Mr. Buron, the regional manager, stated that it was Osco policy to check
Identification cards of all customers who claim to be age twenty five or
less. Mr. Anderson stated that Osco intends to ask the Evanston Police to
provide talks to Osco employees concerning proper procedures governing the
legal sale of alcoholic beverages. Kr. Anderson also stated that Osco has a
good training video on liquor sales that they show to all their employees. A
copy of this video will be forwarded to the Mayor for review.
The members of the liquor control board then reviewed all the details of the
Osco application for a Class H package liquor license. The Board members
voted unanimously to recommend that a Class H package liquor license be

Members of the Liquor Control Review Board began the meeting
at 7:00 PH and considered the following agenda items.
AGENDA
- Discussion and Review of City Code requirements for Class B and Class C
licensees.
- Consideration of application to amend the existing Evanston City Code to
permit the issuance of a Class D liquor license to Phoenix Inn Restaurant,
located at 608 Davis.
- Consideration of application to amend the existing Evanston City Code to
permit the issuance of a Class D liquor license to Siam Square II Restaurant,
located at 622 Davis.
City Code requirements for Class B and Class C licensees
Kayor Barr opened the meeting with the announcement that the meeting was
called for the purpose of discussion and review of City Code requirements for
Class B and Class C licensees. She then reviewed the letter dated July 16,
1987 she had received from Andrew and Leslee Reis, owners of Leslee's and
Cafe Provencal Restaurants requesting clarification of the Evanston law.
Mr. Heyrman stated that this is not a question whether to serve liquor to
minors but to enforce the law to avoid it. Mayor Barr and Commissioners
emphasised that it is illegal to serve liquor to minors under 21 years of age.

Mayor Barr stated that she will again write a letter to all license holders
which will stress the prohibition not to serve liquor to minor#.
No. Leslee Bois stated that the would like to see uniform enforcement of the
law in Evanston.
Mr. Yanneman stated that it is important to clarify the definition of Heal.
The intent of the code is that hotels are the only exception to requiring
food with weals. Only full meals are permitted and he does not think
hamburger can be considered as a full meal. Upon his current reading of
ordinance both hotels and restaurants qualify for Class B license. At one
time he felt only hotels qualified.
Mr. Lytle stated that in reading the City Code, he believes restaurants have
an equal right to Class B licenses according to the law. with reference to
Class C license, City Council has elected not to define meal but leave it up
to Mayor.
Lealee Reis claims certain Class C restaurants serve liquor only with hors
d'oeuvres or baked potato. She cited Stephen B's and other restaurants as
examples. She stated that Yesterday's and Stephen B's have been advertising
"Happy Hoar" and that they require something to eat but a baked potato seems
to be enough.
Mayor Barr asked the people present if they felt the City must continue to
define meal as two courses or whether hors d'oeuvres would qualify for a meal
definition. Mr. Lytle stated that he does not think hors d'oeuvres or baked
potato can be defined as a meal.
Leslee Reis stated that in her opinion "happy hour" snacks are not a meal.
Mayor Barr stated that she will write a letter to all license holders
concerning the definition of meal and state that happy hour snacks do not
qualify. The letter will also cover the requirement for new managers to
complete the appropriate forms in every case.
Mayor Barr concluded the discussion of this part of the Agenda, thanking Mr.
Yanneman and Mr. Lytle for their presence in this meeting.
Phoenix Inn Restaurant - Class D application:
Dr. Kam H. Y. Chang, the owner of 'Phoenix Inn Restaurant Inc., was present at
the hearing and responded to questions and comments by the Board.
Mayor Barr reviewed the requirements of the City liquor license law with the
owner. The Mayor stated that a full meal must be served with liquor
purchases and that egg roll or soup are not considered as a full meal. The
Mayor emphasized that there can be no alcoholic beverage served to minors
under 21 years of age even in the presence of their parents and that wine
glass should not be offered to a minor.

The owner stated they would never serve minors and will always follow the
City liquor license laws.
Mayor Barr also stated that no drink can be served to anyone that seems to be
intoxicated even when they intend to consume meal with the drink. The hours
of operation were reviewed with the applicant.
After discussion and consideration of this application, the Board voted
unanimously to recommend to the City Council that a Class D liquor license be
granted to Phoenix Inn Restaurant.
Siam Square Restaurant - Class D aDplication
Ms. Sunanta Laddaglom was present representing health Conscious. Inc., owner
of the restaurant. She reviewed the operation of the restaurant.
Mayor Barr reviewed the requirements of the City liquor license law and
emphasized that there can be no alcoholic beverage served to minors under 21
years of age even when accompanied with parents. In any doubt ask for
identification and inform parents, if children are with them, that ■erring of
liquor to minor is not allowed.
The Mayor stated that a full meal must be served with liquor purchases and
that egg roll is not considered as a full meal.
The owner stated they would never serve minors and will always follow the
City liquor license laws and that they have applied for a liquor license
because they feel that wine will help their business.
Mayor Barr also pointed out that no drink can be served to intoxicated
patrons even when they intend to consume meal with the drink.
After further review and discussion, the members of the Board voted
unanimously to recommend to the City Council that a Class D liquor license be
issued to Siam Square Restaurant.
The Board then adjourned the meeting at 9:15 PM.
