Logan, Commander Frank Kaminski, Investigator Charles Wernick, Assistant Corporation Counsel Ellen Szymanski Presiding Official: Alderman Jon Nelson The meeting of the Police Services Committee was convened at 7:45 p.m. by Alderman Nelson at the Evanston Civic Center in the fourth floor Conference Room. The following agenda items were considered. , Item I - Minutes Minutes of the November 19, 1985, meeting were reviewed and accepted. Item If - Communications • The minutes from the Residential Crime Prevention Committee were accepted. • The news items were reviewed. • Citizen letters were reviewed. Item III - Ccmplaint Reviews Upon receiving a complaint from a citizen regardinq the conduct of a member of the Department, an official complaint register number is initiated and an initial investigation is conducted. This report is then forwarded to the Internal Affairs Division where a formal investigation is conducted which involves interviews of the complainant, witnesses, and accused member. The completed investigation is then forwarded to the accused member's deauty chief who makes a disposition in reference to the case (e.Q. unfounded, not sustained, sustained, etc.). If the complaint is sustained, a disciplinary recommendation is given. This process is also shared with the member's supervisors. The entire complaint is reviewed by the Chief and he makes the official disposition. The Police Services Committee reviews all complaints. The Committee does not have authority to overturn any disoosition made by the Chief. 1-21-86 Page 1 of 9 e 85-003 Complainant: WIM (16) Charges: Excessive Force Accused: B/M (32) Parking Enforcement Officer Summary: The complainant alleged that the Parking Enforcement Officer grabbed him by the neck, forcing his face down on to a table. The accused officer denied the allegation. Disposition by Chief: Sustained - 4 day suspension Review by Committee: Accepted e 85-004 Complainant: B/M (24) Cnarges: Unnecessary Force Accused: W/M (40) Uniformed Sergeant Summary: The complainant alleged that the accused sergeant unnecessarily used Mace during his arrest. the accused sergeant stated he used the Mace in order to subdue the complainant. Disposition by Chief: Not Sustained Review by Committee: Accepted e 85-007 Complainant- 'W/F (23) Charges: Damaged Property Accused: W/M (35) uniformed officer Summary: The complainant alleged that the accused officer damaged a Sony Walkman cassette player during a traffic stop. The officer denied the allegation. Disposition by Chief: Review by Committee: e 85-008 Sustained - Written Reprimand Accepted Complainant: W/M (26) Charges: Battery Accused: W/M (27) (off -duty) Summary: This complainant alleged that committed a battery upon the accused officer indicated he in self defense. Disposition by Chief: Not Sustained Review by Committee: Accepted 85-019 Complainant: B/P (29) Charges: Verbal Abuse, Damage to Property Accused: W/M (35) Uniformed Officer Summary: The complainant alleged that the accused officer was verbally abusive and damaged her vehicle during a traffic stop. The officer denied the allegation. The accused officer denied the allegations and indicated he was investigating a theft incident. The accused officer indicated that the complainant resisted the arrest. Disposition by Chief: Exonerated Review by Committee: Accepted 85-030 Complainant: W/F (37) Charges: Lack of Service Accused: Unknown Summary: The complainant alleged that she was speaking with an unknown officer when the line was disconnected. The Department was unable to determine how the line was disconnected. The complainant further alleged that the officer failed to furnish his badge number and name. The accused officer denied the allegation and indicated the complainants were intoxicated and had to be taken into custody because of the disturbance. The accused officer admitted to putting the radio on the hood, but not damaging it. Disposition by Chief: Not Sustained Review by Committee: Accepted • 85-045 Complainant: B/M (20) Charges: Theft Accused: W/M (32) Uniformed Officer Summary: The complainant alleged that the accused officer took a telephone pager from his vehicle during a traffic stow. The complainant later admitted the charge was false. Ellen Szymanski from the Legal Department was present. it was determined that its. Szymanski would research several aspects and report back to the Committee. The following agenda items were considered. Note: The items were not necessarily followed in this order. Item I - Minutes Minutes of the January 21, 1986, meeting were reviewed and accepted. Item II - Communications • Chief Logan highlighted the information regarding the Sports Drug Awareness Program sporsored at E.T.H.S. e Citizen letters were reviewed. • The Committee reviewed an article in Police Chief magazine that was written by Officer Robert Henricks. Item III - Complaint Reviews Upon receiving a complaint from a citizen regarding the conduct of a member of the Deparment, an official complaint register number is initiated and an initial investigation is conducted. This report is then forwarded to the Internal Affairs Division where a formal investigation is conducted which involves interviews of the complainant, witnesses, and accused member. Further investigation is being undertaken. 2-18-86 Page 3 of 4 It • 86-001 Complainant: W/F (31) Charges: Theft/Damage to Property Accused: W/M (32) Uniformed BIM (30) Uniformed Summary: The complainant alleged that the accused officers damaged her coat while arresting her, and lost items of her personal property while she was in custody. The property was not taken but was in the Sheriff's lock -up. Disposition by Chief: Unfounded Review by Committee: accepted Item IV. - Other Business • Chief Logan addressed the Committee regarding the highlights for the Department in 1985. He also reviewed some of the plans for 1986. The Committee suggested that these highlights be put in a written format and distributed to Council. • Detective Gallivan from the Department's Vice/Narcotics Bureau made a presentation on how the Department handles raids. The standard operation plan was reviewed as well as the procedures for obtaining a search warrant. Detective Gallivan indicated that the Department has served 98 search warrants (raids) since April of 1984, and none of these have been quashed by the Court. • The Legal Department is still gathering materials in reference to the Dog Ordinance. Item II - Communications • The ALERTS were reviewed. • Chief Logan summarized the in-service training program and invited any committee members to attend. • The Committee is looking forward to the response from the Legal Department regarding executive sessions for the Police Services Committee. • The minutes of the Residential Crime Prevention Committee (RCPC) were reviewed. • The press release regarding Officer Schoolmaster was reviewed. e The program for the second-hand merchants on April 7th was highlighted by Chief Logan. • The Committee discussed the new law regarding fees for copies of traffic accident reports. Alderman Nelson made a qiotion that a memo be sent to Administration and Public Works to consider adjusting our fees to the fees established by the law. Complainant declined any further action. s 85-041 Complainant: W/F (34) Charges: Rape/Use of Controlled substance Accused: B/M (34) Off -duty officer Summary: The complainant alleged that the accused officer raped her and forced her to ingest a controlled substance (Cocaine). The accused officer admitted to being with the complainant and stated the sexual relationship was consented by both parties. The accused officer denied using Cocaine, but refused to take a drug test. The State's Attorney's Office declined criminal prosecution. Disposition by Chief: Sustained - 30 day suspension. The accused officers indicated that they conducted themselves within the guidelines of the law. The accused officer indicated he acted correctly. The accused officer indicated he acted within the scope of the law. Disposition by Chief: Unfounded Review by Committee: Accepted Item IV. - Complaint Hearing (Executive Session Held) 85-039 The Committee heard an oral presentation from the complainants and there was no basis for changing the findings. Item V. - Other Business • The dog ordinance information is still pending with the Legal Department. • The Committee reviewed the information regarding an automobile alarm system ordinance. The Committee requested that the Legal Department draft an ordinance pertaining to this which would address how long an auto alarm could sound, the riqht to tow under this situation, and the steps to terminate the alarm at the scene. • Alderman Morton requested that staff check with the telephone company regarding placing the non -emergency telephone numbers on the cover of telephone books. Prior to deciding on this matter, the Committee requested that additional information be obtained. Review by Committee: Accepted. a 86-007 Complainant: B/M (35) Charges: Physical Abuse Accused: B/M (38) Plain Clothes Officer M1 8/M (32) Plain Clothes officer #2 Summary: The complainant alleged that accused officer #1 struck him in the left temple area of his head with a flashlight. Investigation revealed the accused officer could not be at the place at the time when this allegedly occurred. Disposition by Chief: Unfounded. Item IV. - Other Business r Ms. Liz Gaines addressed the Committee regarding some issues concerning dog problems in her area. Ms. Gaines is a member of The Dewey Community Conference and resides in the 1600 block of Asbury. During the last several months, Ms. Gaines has experienced a number of problems with bandit dogs, ie. damaging her property, killing other animals, etc. As a result of these experiences, Ms. Gaines feels there are some changes needed in the ordinance on dog control and the way animal complainants are handled by the Animal Control Bureau. Ms. Gaines discussed many points and issues of this multi -faceted problem. The Committee expressed their concern for being able to address all of the issues Ms. Gaines raised. The Committee asked Ms. Gaines to provide a written statement identifying the points and problems. Ms. Gaines agreed to provide this. • The Committee reviewed and discussed the memo regarding the use of the CR synopsis. The issues of the right of the employee for confidentiality vs. the right of the public to know were discussed. After some discussion, the Committee voted to raise the fee to a flat $3.00 per accident report. • A reference was made to a graffiti ordinance that was referred to the Police Services Committee from Administration and Public Works. The Committee had not yet received anything. Chief Logan commented that he thought the City's current vandalism ordinance adequately met enforcement needs, and he was uncertain as to what a graffiti ordinance would do. Chief Logan suggested that Administration and Public Works be contacted to see how such an ordinance might differ from the current vandalism ordinance. After considerable debate, the Committee unanimously voted to endorse all of the recommendations as stated in the Study, including a City - Wide Program of Foot Patrols. The Committee vent into executive session during the discussion. Item V. - Presentation • Commander Kaminski made a presentation on the Department's Differential Police Response (DPR) Program which will be pilot tested for a six week period beginning on January 5, 1987. Through DPR, certain calls for service will have the options of reporting the incident over the telephone instead of having a mobile police officer respond to the scene to take the report. The purpose of the program is to free up mobile police units for other activities and to help manage the increasing �olttme of ca11s for service. The program will be evaluated after the six week period. Currently, an educational campaign is being conducted throughout the community.
