Members of the Liquor Control Review Board began the
meeting at 7:30 P.M. and considered the following agenda items:
AGENDA
Consideration of application to amend the existing Evanston
Code to permit the issuance of a Class C liquor license to N U Eats
Corporation, 817 University Street.
- Consideration of application to amend the existing Evanston
Code to permit the issuance of a Class C liquor license to WRY. INC., DBA
Va Pensiero, 1566 Oak Street.

Frank Deberry, Sr., Suren Ipjian, and Andrew Antonczy' , owners, were
present and gave responses to questions and comments by t`e Board "embers.
Mayor Barr reviewed the requirements of the City's liquor license law with
the owners. The Mayor emphasized that on no condition could alcoholic
beverages be served to persons under twenty-one years of age, even when
dining with a parent. Mayor Barr also explained that a meal consists of
two courses or full salad bar and must be served along with alcoholic
beverages. The owners acknowledged this and agreed to abide by w.anstcn's
requirements.

The owners stated that "Open End Inn" will be the name of their new
restaurant and also stated that they have redecorated, changed the
lighting, and have created a more casual atmosphere in their
establishment. They will be serving American contemporary food and will
have a large salad bar.
Mayor Barr expressed concerns regarding Sherman Gardens. The Mayor felt
that a restaurant located across from dorms might create sanitary problems
with regard to garbage and open dumpsters. The Mayor also warned that
this can only be a Class C service bar.
Mr. Shank stated that a 5% liquor tax is in effect. He will prepare a
packet and provide instructions to the owners on administering liquor
taxes.
Upon further review and discussion, the Liquor Commission unanimously
recommended to the Mayor that a Class C liquor license be issued to the
applicants.

Owners Gerald Graef, Ronald Graef, Mary Kincaid and David Hard were
present.
Mayor Barr reviewed Evanston's liquor law requirements with the applicants
and warned them that serving liquor to minors was a serious offense and
that alcoholic beverages cannot be served to minors even when accompanied
by their parents. The Mayor explained that there should not be just bar
service and that a meal, consisting of at least two courses, must be
served. All owners agreed that they would enforce the requirements and
the City Code.
The owners stated that 100 shares of stock were authorized and to date 90
shares have been issued.
The subject of parking was discussed. The owners t.`._t there is
parking across the street and that Davis and Grove Streets wc,.ld be used
for valet parking.
Mr. Heyrman inquired about the kind of sign that would be displayed. The
owners advised the Board that they would like to have a canopy ala
Leslee's in front of the building.
The owners also stated that they had 22 tables in their main. Lining room
and 8 tables in the cafe room to handle the overflow. Their establishment
has already been opened and was operating as a restaurant w;"; a casual
dress code.

After further review and discussion, the Commissioners unanimously
recommended to the Mayor that a Class C license be issued to the
applicants.

Members of the Liquor Control Review Board began the
meeting at 7:30 P.M. and considered the following agenda items:
AGENDA
- Review of draft of proposed ordinance establishing separate liquor
license category for caterers.
- Consideration of application to amend the existing Evanston Code to
permit the issuance of a Class D liquor license to Wild Asparagus, Inc., 1709
Benson.
Consideration of application to amend the existing Evanston Code to
permit the issuance of a Class B liquor license to Devon Avenue's Pepe's
Tacos Inc., DBA Pepe's Mexican Restaurant, 1729 Benson Avenue.
Consideration of establishing separate liquor license :a-_egory for caterers
Mr. Curtis Sharp of Food for Thought Catering and Ms. �inda Boyd of Lady Ann
Catering joined the Commission meeting to discuss this issue.
Mayor Barr began review of a draft of an ordinance whitt would establish this
new classification. ThE ordinance draft was prepare by First Assistant
Corporation counsel Herbert Hill.

The Mayor stated that she wanted it clarified in the ordinance that
deliveries of food, such as pizza, would not qualify as catering activities.
If this activity were permitted then a case might be made for qualification
for a caterer liquor license by pizza and other food delivery firms.
Accordingly, the Mayor and Commissioners agreed that a definition section
should be added to the ordinance in order to precisely define catering
activities. The Mayor and Commissioners also agreed that caterers be
required to provide food service while alcoholic beverages are available.
Also it was agreed that if caterers provide alcoholic beverages for catered
events then the caterer must serve the alcoholic beverages. This would
prevent the sale of packaged liquor by caterers. These stipulations are also
to be inserter: in the definition section to be written by Attorney Herbert
Hill.
The Mayor noted that the present proposed ordinance draft specifically
limited the caterer liquor license to cover only Evanston caterer business
locations or private party locations within Evanston. The Mayor noted that
the proposed liquor license for Evanston caterers could not apply to private
parties or events held outside of Evanston. In that case the liquor laws of
the respective community or county would apply. Accordingly there would be
no responsibility to check the activities of Evanston caterers at events
outside the City. It was felt that retention of the clause "within Evanston"
in the proposed ordinance might suggest that Evanston should check, in
advance, the planned location of every event serviced by Evanston caterers
Accordingly the Mayor and Commissioners asked that Mr. Hill delete the clause
"within Evanston" in the revised draft of the ordinance.
The Mayor then instructed Mr. Shank to relay the changes decided on to Mr.
Hill. The Mayor requested that Mr. Hill prepare a revised ordinance for
further review at a March, 1989 meeting. This meeting is to be scheduled as
soon as the revised ordinance is available.
Wild Asparagus, Inc. 1709 Benson - Class D liquor license applicant
John Tosto, Patricia Tosto, and Katie Maday, owners and manager, were present
and responded to questions and comments by the Board members.
Mayor Barr described the liquor control procedures and the role the City
Council plays in the enforcement of liquor control laws. Mayor Barr stressed
the importance of not serving liquor to minors and strongly emphasized that
alcoholic beverages could not be served along with carry out food. This was
acknowledged by the owners.

Hr. Tosto stated that selling beer and wine will increase the volume of
their business and the applicants agreed to abide by all the requirements
of the Evanston liquor code.
The owners were advised that a 5% liquor tax is in effect and that a
packet and instructions will be provided to them on administering liquor
taxes.
Upon further review and discussion, the Liquor Commission unanimously
recommended to the Mayor that a Class D liquor license be issued to the
applicants.
Devon Avenue Pepe's Tacos, Inc. DBA Pepe's Mexican Restaurant 1709
Benson Avenue - Class B liquor license applicant
The owner, Ray Maldonado, was present.
Mayor Barr reviewed Evanston's liquor law requirements and warned that
serving liquor to minors was a serious offense and that alcoholic
beverages cannot be served to minors, even when accompanied by their
parents. The applicant agreed to enforce the requirements and the City
Code.
Mr. Maldonado stated he has another restaurant on Devon and Western
Avenues in Chicago where beer and wine are served. He intends to open his
new restaurant in early April, and has obtained a 20 year lease on the
premises.
Pepe's Mexican Restaurant will have a separate bar that will be used on
week ends and busy days, Ihis restaurant will seat 122 people - there
will be 23 tables and booths, and will be open 7 days with the exception
of Christmas and New Year.
Mr. Maldonado was advised that a 5% liquor tax is in effect and that a
packet and instructions on administering taxes would be provided to him.
Final consideration will be given to this application on and an amending
ordinance will be recommended to the City Council on March 13, 1989.
The Board then adjourned the meeting at 9:30 P.M.

Members of the Liquor Control Review Board began the
meeting at 7:30 P.M. and considered the following agenda item:

- Consideration of application to amend the existing Evanston Code to
permit the issuance of a Class D liquor license to Main Cafe Inc., $35
Chicago Avenue.

John and Bill Hamill, owners, were present and responded to questions and
comments by the Board members.
Mayor Barr reviewed the requirements of the City's liquor license law with
the owners. The Mayor emphasized that on no condition could alcoholic
beverages be served to persons under twenty-one years of age, even when
dining with a parent, and that liquor is not to be served to anyone
suspected of having a mental problem.
The owners stated that alcoholic beverages will be handled by John
Hamill's son, Bill Hamill, and their deli man. They also stated that
liquor would no-t be served at their counter.

Mayor Barr also explained that a meal consists of two courses and that
such a meal must be served along with alcoholic beverages. John Hamill
agreed with this statement and advised the Board that he would never serve
liquor to minors and they would abide by Evanston's requirements.
Upon further review and discussion, the Liquor Commission unanimously
recommended to the Mayor that a Class D liquor license be issued to the
applicants.

Members of the Liquor Control Review Board began the
meeting at 7:30 P.M. and considered the following agenda item:
AGENDA
Consideration of application to amend the existing Evanston Code to
permit the issuance of a Class D liquor license to Lupita's Inc., 1721
Benson Avenue.
Discussion of proposed ordinance establishing separate liquor
license classification for caterers.
Lupita's Inc. - Class D liquor license applicant
Hennon and Guadalupe Carson, owners, were present and responded to
questions and comments by the Board members.
Mayor Barr reviewed the requirements of the City's liquor license law with
the owners and stated that the liquor ordinance must be strictly adhered
to. The Mayor emphasized that beer and wine must be served with a meal
consisting of two courses and cautioned them that alcoholic beverages
cannot be served to persons under twenty-one years of age. Both
applicants agreed that the liquor code would be strictly enforced.
Mr. Carson questioned whether a "Torto", which is li?e a large chicken
sandwich, could be considered a meal. Mr. Heyrman responded that a
sandwich alone does not constitute a meal, but that soup and a sandwich is
considered two courses and would be acceptable.

Ms. Alexander asked how many people could be seated in the restaurant and
Mr. Carson responded that there are 72 seats.
Mr. and Mrs. Carson were advised that a 5% liquor tax is in effect and
that a packet and instructions on administering taxes would be provided to
them.
Upon further review and discussion, the Liquor Commission unanimously
recommended to the Mayor that a Class D liquor license be issued to the
applicants.
Discussion of proposed ordinance establishing separate liquor license
classification for caterers.
The Mayor and Commissioners reviewed the draft of the proposed ordinance
which had been prepared by Mir. Hill.
A discussion ensued regarding the service of alcoholic beverages. It was
agreed that service shall be by employees of the licensed caterer.
Herbert hill affirmed that the ordinance places no limit to the number of
times a caterer could have an affair at a given location.
The subject of police enforcement regarding the service of liquor to
minors was discussed. It was decided that enforcement would have to be on
a complaint basis only.
There was a discussion regarding collection of taxes from the party
giver. Mayor Barr stated that the point of origin applies regardless of
where the affair is being held.
The license fee for Class C licenses was discussed. The annual fee of
$2,250 was agreed upon. A semi-annual installment payment system will be
permitted.
Mr. Hill was instructed to prepare the ordinance in final form, to reflect
necessary changes noted in the evening's discussion. '!r. Shonk was then
asked to circulate the completed ordinance to the May-: and C:)mmissioners
for final review and approval.

meeting at 7:40 P.M. and considered the following agenda !ten:

Consideration of application to amend the existing Evanston Code to
permit the issuance of a Class B liquor license to Chicago's - Evanston
Inc., Ltd., 1727 Benson Avenue.
Chicago's - Evanston. Inc. Ltd. - Class B liquor license applicant
Mr. Alphonse Sudan, owner, was present and responded to questions and
comments by the Board members.
Mayor Barr reviewed the requirements of the City's liquor license law with
Mr.. Soudan and stated that the liquor ordinance must be strictly adhered
to, The Mayor emphasized that food service must always be available and
cautioned him that alcoholic beverages cannot be served to persons under
twenty-one years of age. Mayor Barr stated that Dr. Taylor, the minister
of the church next door to Chicago's, was greatly concernEl- about their
close proximity and would be watching the operation for service to
minors. The applicant agreed that the liquor code would be strictly
enforced.
Mr. Soudan intends to open his establishment by October 20, 1989.
Although Mr. Soudan plans on being open daily, he will not serve Sunday
brunch and instead will open on Sunday evenings. The applicant described
his $600,000 investment in the leased building as elegant type facilities.

Members of the Liquor Control Review Board began the
meeting at 7:30 P.M. and considered the following agenda item:
AGENDA
Consideration of application to amend the existing Evanston Code to
permit the issuance of a Class C liquor license to Mary Jean Jettner, new
owner of Corinthian Column Corp., 828 Noyes Stroet.
- Consideration of application to amend the existing Evanston Code to
permit the issuance of a Class B liquor license to Humberto A. Martinez
and Humberto Martinez, known as Two Humbertos Inc., new owners of the New
Image Restaurant, 618 Church Street.
Consideration of application to amend the existing Evanston Code to
permit the issuance of a Class J liquor license to Renee Boyd, Lady Ann
Catering, Inc., 1611 Chicago Avenue.
Corinthian Column Restaurant -- Class C liquor license applicant
Ms. Mary Jean Jettner, owner, was present along with her son, Michael
Jettner, and brother-in-law, Edward Bottcher, and responded to questions
and comments by the Board members.
Mayor Barr reviewed the requirements of the City's liquor license law with
them and stated that they must strictly adhere to the liquor ordinance.
She cautioned them that alcoholic beverages cannot be served to persons
under twenty-one years of age and also explained that the burden will be
on the server of alcoholic beverages to obtain two forms of
identification. The applicants agreed that the liquor code would be
strictly enforced.

Mr. Heyrman informed the applicants that they cannot operate under the
existing Class C license for Corinthian Column Restaurant but must qualify
for a new liquor license even though the corporation remains the same. He
went on to state that in this case, since the restaurant is closed, the
existing license is void. A new license must be authorized by the City
Council under an approved amending ordinance. The Mayor stated that there
is no final limit on liquor licenses that may be issued, but the City
Council must first vote approval for each ne:,- license. She stated that no
liquor license transfers to other owners are ever permitted.
Mr. Shonk stated that liquor license investigatory forms must now be
completed by Michael Jettner and Edward Botteher.
The Mayor emphasized that food service must always be available, that a
meal requires two courses. and that a hamburger and salad would qualify as
a meal. Mayor Barr expressed her concern that they do not have firm plans
on the type of food they will serve. Ms. Jettner responded to say she
plans middle priced food service such as soup, salad, and an entree. They
have not decided upon the final menu as yet and it is still in the process
of being designed. The owners intend to open their establishment within
the next 30 to 60 days. Mayor Barr advised Ms. Jettner to inform the
Board when the restaurant is closer to opening and their plans are more
firmly set. At that time, another review meeting will be held with the
Board.
Two Humbertos Inc., The New Image Restaurant - Class B liquor license
applicant
Humberto A. Martinez and his son. Humberto Martinez were present. They
stated they will use the current menu of the existing New Image
Restaurant, although there may be a few items that will be changed. They
will not be remodeling, but will be cleaning the premises.
Mayor Barr stated that strict enforcement of the liquor code is required
and that liquor must not be served to minors, She asked if they were
familiar with the requirements of obtaining a Class B license and informed
them that their kitchen must remain open at all times in order to have the
right to serve alcoholic beverages under a Class B classification. Mr.
Martinez acknowledged understanding of the law and the particular
provision of not serving liquor to minors and stated that they will
strictly enforce this rule.
The Mayor observed that only one reference check had responded to the
Police out of three provided by Mr. Martinez and asked him to secure one
more personal reference for qualification.
After further review, the Commissioners voted to reco=end to the City
Council that a Class B license be issued to the Two Humbertos Inc., doing
business as The New Image Restaurant.

Renee Boyd. Ladv Ann Caterinr, Inc. - Class J (Catering) liquor license
applicant
Ms. Renee Boyd, owner of Lady Ann Catering, Inc., was present and
responded to questions by the Liquor Board. The Mayor warned Ms. Boyd
against serving liquor to minors. She noted that Ms. Boyd would be
responsible and not the North Shore hotel, where her business is located,
Mr. Heyrman advised Ms. Boyd to review in detail, orally and in writing,
the requirements of the Evanston liquor laws with each client at the time
each event contract is signed. Ms. Boyd stated that she normally caters
church functions, weddings, and business club meetings. Weddings never
total over 250 people, the average number is 150. She caters events held
outside the Northshore Hotel, but probably will rarely serve liquor
outside the hotel.
Ms. Boyd stated her preference that her liquor license be issued as early
in December as possible to enable her to serve liquor during the Christmas
season. The license, otherwise, would be of little immediate use to her.
The Mayor stated that she would ask for the suspension of rules but cannot
predict if the Council will do so. She stated she will have an ordinance
introduced at the December Ath meeting and then will move to suspend rules
to have the ordinance adopted on the same night. Mayor Barr indicated to
Ms. Boyd that this will require a unanimous vote.
After further review, the Commissioners voted to recommend to the City
Council that a Class J license be issued to Renee Boyd, doing business as
Lady Ann Catering, Inc.
At 8:35 P.M. the Mayor announced the Board would be going into executive
session to discuss pending litigation.
The Board then adjourned the meeting at 9:00 P.M.
