After giving an overview of the agenda, Chair Fuechtmann indicted he talked to Commissioner Gauss about attendance and Commissioner Geuss is asking to be excused from attending January, February and (March Commission meetings due to evening graduate courses pursuing his M.B.A. Commissioner Geuss will officially make the request in writing. Chair Fuechtmann also indicated that !Mathieu Point Du Jour has officially resigned from the Commission. !Mayor Barr Is currently attempting to fill the three (3) vacancies on the Commission. After the introductions were made, The Chair welcomed the new Commissioners -- Marc Bermann, Sandra Donaldson, David Woodworth -- on behalf of the entire Commission. Other Commissioners then Introduced themselves. I ntrodUct Lon of Guests The three students from Northwestern University and Mrs. Jager from the Evanston Neighborhood Conference Introduced themselves to the Commission. Approval of Minutes of January--27,. Commissioner Bermann made note of a typo In the hearing schedule In the second paragraph, first line. The paragraph should read, "After giving an overview of the agenda, Chair Fuechtmann .i djrated..." The Chair also Indicated that on page 2 under Possible Fair Housing Ordinance Revisions, the second sentence should read, "Commissioner Fischer expressed concern about the current role Commissioners play In Ordinance enforcement". Lastly, Mrs. Jager mentioned that under staff reports the organization mentioned In the second Paragrap� should be, Eyanston Communitv__Foundaticn instead of "Evanston Co^imunity Conference". With the abovementloned corrections the minutes were unanimously approved. (continue) Evanston Human Relations Commission Minutes of 02/24/88.../2 !Qitlzen Input On behalf of the Evanston Neighborhood Conference, Mrs. Jager requested that the investigation concerning the solicitation complaint filed by Alderman Warshaw should proceed as though the issue was panic -peddling, which is a concern of her organization. Because of the housing activity going on in Integrated and recently changed areas, ENC would feel comfortable In knowing that the firm In question 1s conducting solicitations indiscriminately -- In all neighborhoods, not just in integrated or recently changed neighborhoods. The Chair gave a brief overview of the remaining agenda items --- IV through VIII -- and suggested a process for the remainder of the evening. Staff Reports - Owen Thomas In response to a question concerning charge 188-004-E (Employment), Thomas Indicated that the complainant was a black Evanston resident who worked for an Evanston company. Frequently, residents want assistance In resolving employment issues if they feel they have been unfairly treated or misrepresented. In this particular case the company was willing to discuss reasons for the termination. After reviewing issues concerning the termination and hearing compelling arguments as to why the employee should be dismissed, the former employee was referred to the Illinois Department of Human Rights If she chose to file an EEO complaint. In response to a question from Commissioner Fischer concerning the hearing with Evanston Bond b Mortgage Company, Thomas indicated that an agreement between the two parties has been reached, in principle, and they both requested that the hearing be cancelled. To date, there is no signed agreement however. Staff will inform Commissioners once it is received. In response to a question from Commissioner Bermann regarding a company's receptivity to outside Involvement In Internal employment concerns, Thomas indicated that this particular company was very open to his Involvement. Many companies are not, however. Thomas further stated that companies would rather resolve Issues amicably on a local level rather than a State or Federal level. While there Is an attempt to assist the employee(s), they are also advised of their rights If Issues cannot be resolved to their satisfaction. Over the years many residents have been positively assisted through such intervention. Regarding further Fair Housing Ordinance revisions Thomas mentioned to Commissioners that two meetings have been held with Herb Hill, 1st Assistant Corporation Counsel, the Chair, and staff to further address Issues pertaining to the administrative process, complaint Initiation, concillaTions, etc. Staff mentioned that several aldermen had expressed concerns recar-1i-; T~e conciila- tion process and Commissioners' role in that process. There .ias ;eneral agree- ment to draft ouidelInos for conciliation. Staff would conducT :onc 1 1 laTions and sign agreements under these guidelines. A sub -committee for the -'C would review signed agreements to monitor the efficiency of the guidelines. Attorney Fox, who is assisting staff, will have the suggested revisions ready for Com- mission review prior to the next monthly meeting. The revisions will hopefully cover all of the potential problem areas In the Ordinance. Staff will request that Attorney Fox attend the next Commission meeting. (continue) Evanston Human Relations Commission Minutes of 02/24/88... /3 Staff Report - Owen Thomas (continued) Lastly, Thomas informed Commissioners of charge #88-006-E (Employment). Minority employees -- some being Evanston residents and others non -Evanston residents -- asked for assistance In addressing employment related issues where they work. The company is located outside of Evanston. Employees indicated that there was a history of unequal treatment relative to minority and non -minority employees. While the company allegedly has mechanisms In place to addrdss such issues, employees indicated that the company Is generally Insensitive to minority concerns. Some concerns mentioned were: employees not being able to review their personnel folder, unfair treatment concerning disciplinary issues, and the inability to express legitimate concerns to the Director of Human Resources. Employees asked that the Executive Director serve as an Ombudsman in hopes of addressing the racially motivated inequities they allegedly must contend with from day -to- day. The employees, approximately fifteen In number, expressed a sincere desire to work with the company rather than against It, but they also felt that administrative and supervisory attitudes must change in order for this to be a reality. Thomas further Indicated that he has contacted the Director of Human Resources and the company indicated a willingness to resolve such issues. Thomas concluded by Indicating that the Commission has been involved in similar issues Involving Evanston and non -Evanston Institutions in the past. Examples are the Unificlation Church vs. Kendall College (charge 081-003-D, Discrimination), Prince vs. Winkel's Transportation (charge 182-008-E, Employment), HRC vs. Pioneer Press (charge #83-060-M, Miscellaneous), Citizens vs. Illinois Job Services and (charge #82-057-M, Miscellaneous) and Beam vs. Boy Scouts of America (charge 184-020-0, Discrimination). Staff Rcpgrft - Fred Underwood Underwood spoke on the Fair Housing Progress Report which was submitted to Com- missioners in the packets. He indicated that the report was from December 11, 1987 through February 17, 1988 instead of January 17, 1988. He also mentioned that on Page 5 of the report under "Conciliation Remedies", the number of stand- ard agreements for 1987 is eleven Instead of eighteen. After reviewing the report Commissioners felt that It was very informative. Additionally, Underwood mentioned that the Fair Housing poster and brochure was given to realtors at the seminar on February 23, 1988. Over forty-five persons attended the afternoon seminar but few attended the evening session. Regarding solicitation, Com- missioner Fischer expressed concern that people would not notify us of their desire not to be solicited If the notification had to be notarized. He asked If a community group could gather such requests and then have them notarized on behalf of the homeowners. Thomas Indicated that he would get a lei opinion from the Law Department on this Issue. Staff Report - Brenda Huff During the review of Huff's staff report, Commissioner Hillman asked that the report be done similar to Underwood's Fair Housing Progress report. Quarterly reports comparing Neighborhood Justice Center activity to date in comparison to (continue) Evanston Human Relations Commission Minutes of 02/24/88... /4 Staff Report - Brenda Huff(continued) prior years during the same time frame would be very Informative. Commissioner Volk asked If the complaint Intake breakdown could be more descriptive. Example: what type cases are referred from the Housing Department, Police Department, "Highlights", and the Cook County Legal Assistance program? '[hat were the results of the referrals? Also, at the request of the Chair, Huff gave an overview of the Neighborhood Justice Center process to inform new Commissioners. The Chair also mentioned that Commissioners can be certified as mediators to assist in the program. Thomas spoke to the need for another person to work with Commissioner Volk and Huff toward increasing intake for the Neighborhood Justice Center. He also emphasized the need to broaden the scope of the type cases mediated. Court referred battery cases can be mediated. This can be done by merely changing our Bylaws and developing a course of action. Commissioner Bermann volunteered to work with Commissioner Volk and Huff and report back at the next Commission meeting. Commissioner Fischer stated that he was keynote speaker at a conference in Hazel Crest on Diverse Communities. Many people from human relations commissions, housing centers and City staff discussed many Issues pertaining to encouraging and maintaining diverse communities. Economic development and race relations relative to diverse communities were several of the Issues discussed. Commissioner Fischer also mentioned that some issues discussed at the conference might be relevant to Evanston and serve as a possible model. Planning Session The Chair spoke to the June 1987 Retreat at which Homer Johnson served as an outside faclliator to assist Commissioners and staff in identifying key human relations Issues In tvanston. Now that the Commission Is at full strength, The Chair asked that Commissioners and staff develop a current list of human relations issues in Evanston and attempt to prioritize them. The priorities would then be sent to sub -committees to develop specific tasks. The following Issues were Identified by Commissioners and staff: Schools (race relations) - Ken Rodgers Communities outside of Evanston (housing) - Paul Fischer Employment - Karen Hillman Racial Diversity - Paul Fischer Community Group Interface - Owen Thomas Displacement of Black Evanston Residents - Judith Jager Business Development (business oriented issues) - Fart Bermann Better Public Relations for HRC - Ken Rodgers Other Community/Institutional Issues (impact on Evanston) Role of Commission - Owen Thomas After some discussion on prioritizing the abovementioned Issues, the Chair suggested that focus be given to the Issues of: (1) Schools, (2) Housing, (3) Regional Focus. These three issue areas would require some activity for possibly six months. Committee assignments and strategies coula 5e developed around these three areas. (continue) Evanston Human Relations Commission Minutes of 02/24/88... /5 Executive S@gslon The Commission adjourned into Executive Session at 9:25 p.m. Staff informed Commissioners of charge #88-FH-001 Brown vs. Graber -- which will be going to hearing. Two possible dates are March 22 or 24. The Nearing Board will consist of Commissioners Fischer, Hillman and Rodgers, with Hillman serving as Chairman. Also, Donaldson and Woodworth will serve as alternates. The Tearing will convene on Tuesday, March 22 and Thursday, March 24 is an alternate day. There was also consensus that the conciliation guIdeIInes sub -committee would consist of the Chair and Fischer. Commissioner Rodgers will serve as a substitute. Staff Reports In response to a question from Commissioner 8ermann, Owen Thomas Indicated that the Commission should decide on a date for a hearing. The suggested dates are: May 3 or May 5, 1988. Fair Housing Report - Underwood Commissioner Hillman commended Fred Underwood for doing a thorough fair housing report. Commissioners Hillman, Fischer and Volk made comments as to how the report could be strengthened. Additionally, Commissioner 8ermann suggested that the tone of the report reflect a more objective point of view, which represents the entire Commission. His concern was that readers might feel that the report was not representative of the entire Commission. Commissioners agreed that staff would make the necessary changes in the report so It coin, be submitted to Human Services Committee. Commissioners again thanked Fred for its effort. (continue) Evanston Human Relations Commission Minutes of 03/23/88... /2 StUff Report - Neighborhood Justice Center Commissioner Volk and Brenda mentioned that the Neighborhood Justice Center sub- committee met and decided to have an Open House on Law Day, May 1, 1988, at Robert Crown Community Center. The purpose of the Open house would be to Introduce the Evanston community to the Neighborhood Justice Center. aldermen, community groups, mediators, and other social service agencies would be sent invitations to this activity. Plans are to also have several speakers. Com- missloner Volk emphasized that the objective was to inform the Evanston community about the Evanston Neighborhood Justice Center. Because Law Day is celebrated on May 1, 1988, It was felt that the timing for the Open House would be ideal. All Commissioners were urged to mark their calendars for this event. Brenda Indicated that invitations would be sent to over 100 persons. After further discussion, Commissioner Volk moved and Commissioner Hillman seconded a motion to proceed with the Neighborhood Justice Center Open House on May 1, 1988. The vote was unanimous. Chair Fuecthmann asked that the Commission refer to the Guide to Ordinance Amendments. Currently, the existing Ordinance does not grant specific authority to the Commission to initiate complaints. In Section 5-5-11 of the Ordinance, this issue is remedied by granting that authority to the Administrator. Further, in deciding to grant this power to the Administrator, the sub -committee on Ordinance Amendments, along with the Commission considered three options: a) Commission Initii1t dd complalnts While this procedure Is currently used it raises questions of due process because it can be objected that the Commission is both prosecutor and judge. (The Peoria Case). b) City Indtlated complaint This procedure would by-pass the Commission and lessen Its role In the implementation and execution of fair housing policy. c) Admi n 1 strator i n i tl ated cornp I_af nt5 This procedure allows for legal separation from the Commission proper, and is parallel to the procedure used on a Federal level. Commissioner Valk indicated that as long as there Is clear separation between the Administrator and the Commission regarding complaints, no problem would arise. The separation of duties must be clearly spelled out. After further discussion, the Commission approved the following amendments to the Ordinance In Section 5-5-11: 1) Administrator initiator complaints. 2) Clarifying language on the Commission acting througn the Administrator. 3) Moving the second sentence of Section D under the second paragraph. (continue) Evanston Human Relations Commission Minutes of 03/23/88... /3 After Commissioners discussed the changes In Section 5-5-12, Commissioner Volk moved and Commissioner Fischer seconded a motion to accept the changes. They are as follows: 1. (Section A) Allows amendment of comp IaInt, because of possibility of late discovery on part of complainant before actual hearing. Also in accordance with Civil Law. 2. (Section C) Extends Investigation period, If necessary, to sixty days (presently thirty days). Especially In audit situations it may be necessary to extend Investigation period beyond time presently allowed. 3. (Section D) Specifically authorizes Commission to establish rules and regulations regarding the conciliation process. 4. (Section 1) Language revisions suggested by City Law Department regarding due process. 5. (Section J) Language revisions suggested by City Law Department regarding Commission's "final order". 6. (Section J) Draft amendment removes rilmitation on reimbursement expenses. 7. (Section K) Language revision: Commission "order" and "has been filed". 8. (Section L) Language change. 9. (Section I'd) Substitutes new language of relevant Illinois agency (formerly Department of Registration and Education) and adds broader exposure to regulatory power of Illinois's ;overnment. 10. (Section 0) Specifies majority of Commission "then holding office". Horace Fox served as counsel to the sub -committee. The recommended rules and regulations were designed to Include the Commission In on the conciliation ;,recess. This presented practical problems. The sub -committee also considered having a group of citizens appointed to be involved in the conciliation process. However, It was felt that this would remove the Commission even further from the conciliation process. Lastly, the idea of a review board was considered. This body of people would actually hear all cases. The sub -committee felt that the review board concept was tried in Evanston atone time and presented several problems. Also, Bellwood is considering eliminating its review board process. In response to Commissioners questions under complaint processing, Fred Underwood Indicated that the Commission could suggest to staff the type cases that should be taken to court and staff will follow this suggestion. On Administrator initiated complaints, Commissioners would be given the names of the parties and the nature of the complaint. This does not include test results, etc. After further indepth discussion regarding the conciliation process, the role of the Commission and the types of cases that should be taken to court, the Commission decided that the Rules and Regulations for Complaint Processing and Conciliation would be Commission policy. Commissioners then reviewed the rules and regulations for further clarification on any points. In response to a question from Commissioner Fischer regarding staff making determinations on cases, Fred Underwood Indicated that once Commissioners are given details on a case, the Commission cannot take that case to hearing. After further discussion concerning how much information the Commission would have on any particular case prior to going into court, It was decided that the Commission would be Informed enough to make rational decisions. Guidelines could suggest the type uses that should go to court or be processed through normal ordinance procedures. The Commission can make the remedies for certain cases. There being no further discussion Commissioner Fischer moved and Commissioner Hillman seconded a motion to approve the framework for complaint processing. The vote was unanimous. Chair Fuechtmann began to discuss the conciliation process of the Rules and Regulations for Complaint Processing and Conciliation. After Indepth discussion of all areas under the conciliation process, Commissioner Fischer moved and Commissioner Volk seconded a motion to accept the guidelines. The vote was unamimous. Meeting with Human Services Committee on March 28. 1988 Chair Fuechtmann reminded Commissioners of the meeting on March 28, 1988, with the Human Services Committee. Agenda items to be discussed are: Fair Housing Update and Conciliation Guidelines. Chair Fuechtmann also mentioned that he and Commissioner Fiscner will meet with Alderman Feldman, Chair of Hunan Services Committee on Saturday, March 26, 1988. Chair Fuechtmann encouraged all Commissioners to attend the Monday meeting. The first Involves Hightower vs. Raymond & Associates. Commissioners decided to have this hearing scheduled for May 5, 1988. Commissioners Volk, Bermann and Woodworth will be hearing officers and Commissioner Volk will Chair the hearing. The second hearing involves Coleman vs. Arthur Goldner & Associates. Nearing officers will be Commissioners Fuechtmann, Gauss and Donaldson and Chair Fuechtmann will chair the hearing. The date will be April 13, 1988. Both hearings will begin at 7:30 p.m. but hearing officers should be present at 7:00 p.m. for a briefing of the hearing procedures from Herb Hill. HUD Conference Fred Underwood informed Commissioners of the upcoming annual H11D Conference In Atlanta, GA. This year the conference will be held May 31 - June 3, 1988. While staff must attend the conference, Commissioners and attorneys Involved in fair housing enforcement are also encouraged to attend. All funds are provided by HUD. Owen Thomas indicated that there are funds for four attendees. Also, Herb Hill of the City's Law Department indicated a desire to attend. Commissioner Volk indicated that she attended last year's conference and felt It was very beneficial. It was decided that Commissioner Donaldson and staff +rill attend the conference. Chair Fuechtmann indicated that on Page 2, sub -section A, Commission Initiated Complaints, the words "the Peoria Case" should be omitted. Department of Justice, and Chief Ernest Jacobi of the Evanston Police Department. Brenda then passed out a quarterly report depicting Neighborhood Justice Center intake. While the caseload is down it Is hoped that the Open House on May i will Increase intake activities. in response to a question from Commissioner Fischer, Brenda indicated that the Open House would hopefully increase complaint intake. There are still many people in the Evanston community that are unaware of the Justice Center service. In response to a question from Chair Fuecttmann regarding publicity for the upcoming event, Brenda Indicated that letters were sent to both the "News Voice" and the "Evanston Review". Also, Alderpersons, community groups and realtors received Invitations. In response to a question from Commissioner Geuss, Brenda Indicated that aside from the Chicago Neighborhood Justice Center, Evanston Is the only other community In the Chicagoland area that has such a concept. Chair Fuecthmann suggested that the " block club network be used to publicize the Fair Housing Anti -Solicitation Information. Brenda and Fred will work on this immediately. Commissioner Volk again urged everyone to attend the Open House on Sunday, May 1, 1988 at Robert Crown Community Center. It will begin at 1:30 p.m. Chair Fuecttmann suggested that there be no smoking in the room during Commission meetings. There will be a short break at each meeting -- time permitting -- for those who wish to smoke in the hallway. There was consensus agreement on this suggestion. Brown vs. Grater Commissioners Rodgers and Fischer indicated that they were waiting for their written report of the hearing from Horace Fox, presiding attorney for the case. Commissioner Karen Hillman chaired the hearing. According to the Ordinance "At the conclusion of the hearings a written report with findings and a recommended decision shall be prepared for submission to the entire Commission. No report shall be delayed no more than sixty (60l days after the date of the first hearing unless waived by agreement of the complainant and the respondent or upon good cause shown and stated In the record. Once the Commission receives the report It will review the complete record Including transcripts of testimony, exhibits, the findings and recommended decision, and then make a final decision on the complaint. A majority of the Commission then In office must concur with the findings. The Commission shaII reach Its decision within, 60 days of the receipt of the written report. It was decided that the entire Commission will receive all materials pertinent to the hearing and be prepared to vote on the matter at the May 25, 1988 meeting." Page 3 ,School District 65 Sub -Committee Chair Fuechtmann indicated that the Commission should be paying particular attention to human relations Issues in the schools. Now that District 65 has a new superintendent it would be Important for the Commission to appoint a sub- committee to work on human relations Issues. Commissioner Rodgers Indicated that he and Commissioner Donaldson would work in this area. Commissioners Volk and Rodgers indicated that race relations, housing and mediation training were possible areas of involvement. Commissioner FIscher Indicated that racial balance was a key Issue to be addressed. Commissioner Rodgers also mentioned that school involvement would bring about higher visibility for the Commission. Chair Fuechtmann appointed Ken Rodgers to chair sub -committee on schools and requested that he also ask other non-Commissloners to be involved. Qgncillation of Complaints Chair Fuechtmann reviewed the five options available to the Commission for discussion. After Owen Thomas mentioned another option presented to him by Com- m€ssloner Bermann, Commissioners felt that this option was similar to option 12. The five options discussed are as follows: 1) staff conclllates, Commissions hears -- current Commission proposal. 2) split the Commission Into a hearing sub -committee and conciliation sub -committee. Such a split could be permanent with some members appointed to each committee, could be rotating, or possibly the chairman could be the conciliation advisor. 3) create a separate board, a fair housing review board, to hear complaints. The Commission would then initiate and conciliate cases. 4) appoint hearing officers to hear cases. The HRC would initiate and conciliate cases. 5) City Council would review and approve all concillations leaving the HRC as a hearing board. In response to Commissioner Volk's question, Chair Fuechtmann indicated that the discussion wouid pertain to Commission initiated complaints and audits. Citizen complaints follow a different course. Commissioner Fischer Indicated that the discussion should pertain to all complaints. After Indepth discussion on whether Commissioners should address all complaints or just Commission Initiated complaints and audits, It was decided that discussion would concern only Com- mission initiated complaints on audits. Also, it would be an additional responsibility to Human Services Committee. There was discussion on whether or not the Commission could advise staff on a particular case prior to it going to conciliation. However, in order to advise staff Commissioners would have to know the particulars of a case. Option 4, Hearing Offlcgrs - It was felt that this option would too dilute the Commission. Commissioner Volk felt that the Commission would be abdicating Its responsibility. Commissioner Fischer felt that it was very Important for Commissioners to be involved in the hearing process. The Intricacies of any particular case would give Commissioners an opportunity to fully understand the intent of the Ordinance and better determine whether or not violations actually occurred. To give this responslblllty up would be a mistake. Option 3, Fair Housing Review Bogrd - It was felt that this option has not been successful In other communities. In Bellwood, Illinois, they are considering moving from this concept. Also, there is no Indication as to how many cases would be heard by a review board resulting, In a non-functional group due to the low number of hearings. Fred Underwood mentioned that a big advantage could be that the Commission would be able to advise staff on investigation of particular complaints. After more discussion on this option, Chair Fuechtmann asked staff whether or not it would be advantageous to have advise from the Commission on cases. Fred Underwood mentioned that it would only be helpful If persons In the community had a lack of confidence In staff. Owen Thomas indicated that the same concerns could be raised whether or not Commissioners were Invovled In the concilia- tion. Commission involvement does not guarantee that there will be no criticism about how cases are conciliated. Cec�lssIoner Fischer Indicated that he saw the main Issue as being Commission Involvement. Commissioners should become more Involved In policy decisions. This In turn would Improve the quality of human relations In the Evanston community. Commissioner Rodgers expressed concern about having Commissioners do what staff has been hired To do. Additionally, staff has years of experience and they consult with knowledgeable people In each and every case prior to mavin; decisions. He questioned the role of the Commission's involvement In the process. Further, will Commissioners want to be Involved In decisions regarding employment discrimination and police -community Issues? Page 5 with Commissioner Rodgers. She said that the Commissions policy guidelines on conciliations allow Commissioners to become involved In the process. There was further discussion between Chair Fuechtmann and Commissioner Fischer regarding the role of the three Comissioners in the cone#Ilation process. Chair Fuechtmann felt that the Commissioners could not be knowledgeable and make Informed decisions unless they were totally Involved with the case. He suggested that such Involvement would be cumbersome and also Infringe upon the responsibility of a professional staff. This would continually confuse and officlate the role of staff. There was discussion of an idea mentioned by Fred Underwood whereby staff would ask for a Commissioner to assist on particular cases. After more discussion Chair Fuechtmann indicated that Option 12 -- Split Commission -- had been given due consideration. He suggested that the Commission take a straw vote on which of the five options it favored. Chair Fuechtmann then asked for a vote on whether Commissioners favored developing Option 2 and making this an amendment to the Fair Housing Ordinance. The vote was 5 to 1 with Commissioners Volk, Woodworth, Geuss, Rodgers and Chair Fuechtmann voting nay and Commissioner Fischer voting aye. There was consensus opinion among Commissioners that they would remain with Option 11 -- Current Commission Proposal. Chair Fuechtmann thanked the Com- mission for participating In a difficult process. New Business Commissioner Fischer asked for Information on the antl-solicitation Issue. He indicated he had received some complaints on the process. Fred Underwood responded by indicating that currently there are seven persons who have indicated a desire not to be solicited. The problem concerns the State of Illinois requiring lists of persons desiring not to be solicited to be certified that the names are geniune. For staff to certify the lists, the Law Department advised that the foams be notarized. This Is not the case with the Evanston Ordinance. If Fred personally got people to sign the anti -solicitation form, he could then certify that the persons were legitimate. This would not be the case If someone else got the names and gave them to Fred. The current form has the Evanston Ordinance on one side and the State on the other. Chair Fuechtmann Indicated that the main Issue is to get the antl-solicitation list out to the community and have people sign up. NAACP Freedom Fund Banquet Commissioner Volk Indicated that the Evanston NAACP would have their annual Freedom Fund Banquet on May 7, 1988. She suggested that several Commissioners accompany staff to this affair. Commissioners Volk and Rodgers along with Owen Thomas and Fred Underwood will attend. In case 937-037-10 , Coleman vs. Arthur Goldner and Associates, the parties reached an agreement prior to the conciliation date and the case was closed. Also, In case 187-038-HD, Hightower vs. Raymond G Associates and Rental Realty, Hightower has reached an agreement with Raymond d Associates but the case with Rental Realty is still open. The Commission voted to extend the conciliation period in the Hightower vs. Rental Realty case until June 30, 1988. There was discussion on how to address the issue of respondents requesting a continuance of a hearing at the last minute. Also, cases have Laen sertled by the two partiez prior to a hearing. Several banks in Atlanta have committed funds to low income and Tiicrity residents for housing. The first concern Is the Library and Levy Center Issue. The Commission has already appointed a sub -committee to look at concerns regarding the Levy Center. Owen indicted that the second Issue was the educational gap between minority and non -minority students in District 65. Now that the district has hired a new superintendent, the time is Ideal for the Commission to work with him on addressing this issue. Lastly, there is a need to examine race relations in Evanston. At the June 13, 1988 City Council meeting, a citizen asked that the Commission work with Council In the area of race relations. Staff Reports Brenda Huff - In response to a question from Commissioner Geuss, Brenda Huff clarified how many cases were mediated during the last period. Fred Underwood - Fred Underwood asked whether there were questions regarding the Fair Housing Report submitted in the packets. Fred also responded that the cases filed by Aldermen Rainey, Warshaw and Judith Jager are being reviewed by counsel. Additionally, Fred mentioned that during his investigation of a case with Bari Management, he was personally assaulted by the owner of the company. Fred requested that the Commission initiate its own charge and file a complaint with the Illinois Department of Human Rights and the Department of Professional Regulations. ,After in-depth discussion on the particulars of the complaint, it was moved and seconded that complaints be filed with the Illinois Department of Human Rights and the Department of Professional Regulations. The vote was unanimous. EVANSTON HUMAN RELATIONS COMMISSION Minutes of July 27, 1988 2 Lastly, fired indicated that he and Brenda Huff had met with Owen and they are currently working jointly to promote Fair Housing and the Neighborhood Justice Center through block clubs. The Commission felt that this was a good idea. The Neighborhood Justice Center's sub -committee (Commissioners Bermann and Volk) will work with Fred and Brenda. Report of Executive Director Owen Thomas mentioned that in addition to attending meetings of the sub -committee on schools, involvement in housing conciliations and attending Council meetings, he alto attended the monthly meeting of the -Illinois Municipal Human Relations Association on July 13, 1988. The meeting was held in Oak Park. In March of 1989, Evanston and Oak Park will co -host the monthly meeting to discuss common concerns between the two cities. IMHRA has decided to co -host meetings to get more attendance from Commissioners and citizens and also to inform the public of the Association's activities. On July 14, 1988, Owen assisted the Personnel Department in the physical agility examination for Fire Fighters/Paramedics. The examination was given at James Park. As a timer, Owen mentioned that he was afforded an ❑pportunity to observe the rigorous requirements to become a Fire Fighter in Evanston. On July 28, 1988, Owen indicated that he and Chair Fuechtmann had been invited to address a select group of black and Jewish religious leaders to discuss how our Evanston Commission functions and what we might recommend to strengthen the Chicago Commission on Human Relations. Our presentation was given at the Community Renewal Society in Chicago. Lastly, Owen indicated that on August 3, 1988, he was invited to speak at the Levy Center Men's Club on the role of the Evanston Human Relations Commission. Housinq Update Fred Underwood indicated that the order regarding the Brown vs. Graber case has been mailed to all concerned parties. Old Business Conciliation Sub -Committee Report Commissioner Fischer, Chair of the Conciliation Sub -Committee, indicated that he, along with Commissioners Rodgers and Fuechtmann, EVANSTON HUMAN RELATIONS COMMISSION Minutes of July 27, 1988 . . . 3 met with staff twice to discuss conciliations. The first meeting was June 20 and the second meeting was July 25. Commissioner Fischer indicated that he felt the meetings were both constructive and productive. Conciliations were examined and cases were dis- cussed. The latest guideline developed by the sub -committee concerned what action to take when a conciliation is breached (Policy #10). The sub -committee decided that when there is a breach of a conciliation, staff will develop independent evidence and initiate its own charge, which would ultimately lead toward a hearing. There would be no need to reconciliate the case. Commissioner Fischer moved and Commissioner Geuss seconded a motion to accept the sub -committee's conciliation guidelines. The motion passed unanimously. The updated Complaint Processing and Conciliation guidelines are attached to these minutes. Commissioner Fischer mentioned that the meetings with staff regarding conciliations were very positive and it gave him better understanding of what staff does. The sub -committee will meet quarterly. Judy Jager suggested that staff speak with someone in HUD to determine whether conciliations are absolutely necessary in every case. It is her understanding from HUD that the Commission has an option to either conciliate or go to a hearing. Alderman Feldman indicated that there was a difference between policy and HUD mandate. If conciliations are mandated by HUD there is no option. The question is policy versus HUD mandate. Owen Thomas indicated that he would personally look into the con- ciliation issue and confer with HUD officials. Since 1981, when the Evanston ordinance became equivalent to the language in Title 8, HUD has never suggested that conciliations were optional. Also, HUD officials have never indicated that conciliations were optional at the numerous conferences on Fair Housing enforcement over the years. Further, when Evanston received the aviard for Outstanding Performance in Atlanta, one of the areas mentioned was our unique approach in conciliation agreements. If con- ciliations are optional however, staff will follow Commission policy guidelines. ~ Schools Sub -Committee Report Commissioner Rodgers, Chair of the Schools Sub -Committee, stated that the Committee has met twice and both meetings have been outstanding. Committee members are non -commissioners and many of them have children in District 65. The objective of the Committee is to work with Superintendent Pollack in addressing issues of common concern. Some of the issues include special education, parental involvement in the PTA and closing the EVANSTON HUMAN RELATIONS COMMISSION Minutes of July 27, 1988 . . . 4 educational gap between minority and non -minority students. Because there are other groups in the Evanston community in- terested in doing the same thing, the sub -committee is desirous of serving as a clearing house to work towards a common goal. Further, the sub -committee has scheduled a community meeting for August 16, 1988, at the Evanston Civic Center, Room 2402. The meeting will begin at 6:30 p.m. The meeting will hopefully give people an opportunity to indicate what direction they feel the Commission should be taking relative to issues in School District 65. Whatever the issues are, the Commission will serve as a facilitator and work with the school district towards addressing the issues. Commissioner Rodgers further indicated that after the attendees sign in, Commissioner Donaldson will welcome everyone. Brenda Huff will then make a few statements and introduce the panel. The facilitator for the evening will be Owen Thomas. Lastly, Commissioner Rodgers indicated that he will fully discuss ideas about the scholarship for a high school senior at the next regular meeting. Chair Fuechtmann indicated that it should be known that the educational gap issue has been a concern of the Commission for some time. The meeting on August 16th should be seen as an exploratory meeting to understand and frame what people feel the issues are. We should listen to hear what people are saying. At another meeting we might begin to frame some plan of action. Commission Retreat Chair Fuechtmann mentioned that there had been some discussion about having another Commission Retreat - similar to that of last year. Tne purpose would be to discuss long term issues and develop an agenda for the upcoming budget year. A facilitator could be invited to assist in the process. The retreat (planning session) could possibly be held during the evening following a dinner. Commissioner Fischer suggested a 3 hour Saturday retreat. In response to a question regarding last year's retreat, Commissioner Hillman felt that the facilitator was not totally aware of the Commission's needs. She further stated that perhaps -uch time was spent on generalities and not enough spent on specifics. Ccrs:issioner Bermann felt that 3 hours could be well spent if the agenda was well planned. Further, he suggested that research be done on the issues that came out of last year's retreat and use them in the upcoming retreat. The retreat should be an extension ❑f last year's. After more dis- cussion, Commissioner Geuss suggested that the idea be held off for several months to determine whether there was a need. Commissioners Fischer and Hillman suggested an informal get-together where everyone could focus on issues and determine a plan of action. There was concensus opinion that there will be an informal get-together on September 10, 1988, at the home of Commissioner Fischer. The activity will start at 9:00 a.m. New Business Community Development Block Grant Request Owen'Thomas indicated that he and Fred Underwood appeared before the Community Development Block Grant Committee to speak to a pre- liminary budget for the upcoming 1989 - 90 fiscal year. Due to the noticable increase in Fair Housing activity, the preliminary request included funds for an additional full time staff person. After Commissioners reviewed the memo which was mailed in their packets, Commissioner Bermann moved and Commissioner Rodgers seconded a motion to request an additional staff person to assist in Fair Housing activities. The vote was unanimous. Hearing Panel Because the Commission will not officially meet again until September 28, staff suggested that they preselect a hearing panel to hear any case during the interim, if necessary. It was decided that Commissioners Volk, Fischer, Geuss, and Fuechtmann would comprise the panel. Commissioner Volk would chair. Other Commissioner Fischer indicated that his report on a regional approach to Fair Housing will be presented at the September 28th meeting. The entire Commission thanked Karen Hillman for her efforts over the 6 years she has been a Commissioner. Her overall efforts in Human Reid}ions endeavors have been outstanding. Co7�issioner Fischer reflected upon Karen's diligence as Chair in the Brown vs. Graber case. Owen Thomas indicated that he has enjoyed his relation- ship with Karen over the past 6 years. Staff Resort - Owen Thomas Owen Thomas mentioned that he met with Superintendent Pollack of District 65 to update him on the role of the Commisaion`s Subcommittee on Schools. Mr. Pollack expressed appreciation for the Commission working with the School District towards addressing issues of common concern. He indicated that he would be willing to speak to members of the Subcommittee when asked. Owen also indicated that he and Fred Underwood conducted several fair housing conciliations during tho month of August. Additionally, Owen and Brenda Huff met with Police Chief Ernest Jacoby to discuss a new Neighborhood Justice Center intake process that would hopefully increase our referrals from the Police Department. Currently the new procedure is being reviewed internally by the Police Department. On August 15th. Owen chaired the meeting of the Subcommittee on Schools. Also present were Commissioners Donaldson and Rodgers. The meeting was well attended and those present discussed ways of working with District 65 towards addressing concerns regarding the educational gap between minority and non --minority students, and special education. The Subcommittee serves as a cloaring-house for other community groups towards working with District 65 to address issues of common concern. Owen also mentioned that he attended a campaign with other City and local officials sponsored by Mothers Against Drunk Driving. Testimony was given from victims of drunk driving accidents. Owen also met with Mayor Barr and Commissioner Susan Johnson to familiarize her with the scope of the Human Relations Commission. Evanston Human Relations Commission - Minutes 9/28/88 --2- Also, on September loth, Owen met with Commissioner Volk to discuss the Human Relations Commission and Fair Housing 1883--90 Budget requests. Also during the month of August, there was the Kelsey vs. Schermerhorn Fair Housing hearing. The hearing was continued. Also, Owen mentioned that the Illinois Municipal Human Relations Association has asked the Commission to sponsor the May 19, 198S Annual Conference in Evanston. The meeting that we were to co -host with Oak Park in November of this year will be held in Oak Park. A 1989 Conference Planning Committee has already been established. Lastly. Owen mentioned that he participated in a Dedication Ceremony sponsored by the Avenue of the Righteous Committee. He (spoke about Andre and Magda Trocme of France. Andre and his wife Mazda lived in the Le Chambon region of south central France. Andre was a Protestant minister who used his church and home as refuge for German and French Jews fleeins Hitler. Owen gave an award to the Trocme's grandson, James, who is attending graduate school at Northwestern University. The Commission unanimously endorsed hosting the Annual Meeting of the Illinois Municipal Human Relations (-association in May of 1989. American Legion Pancake Day Owen mentioned that he and Brenda Huff were working with Evanston American Legion to sponsor a Pancake Day whereby the proceeds would go to the Commission, who would in turn distribute the funds to needy families in Evanston. Owen was involved in this activity last year and the Pancake Day generated over S400, which in turn was shared between the City's Emergency Assistance and General nsaintance Programs. This year the Pancake Day will be on Saturday, November 19, 1988 from 7:00 a. m. to 2:00 P.M. The location Is 1030 Central Street at the Evanston American legion Hall. For three dollars, patrons will receive a full course breakfast. Fair Housing Uadate - Fred Underwood Fred reminded Commissioners that the Fair Housing Case - Kelsey va. Schermerhorn has been rescheduled for October 25. 1988- The hearing officers are: Commissioners Rodgers (Chair), Donaldson, Woodworth, and Herman. Also, the hearing of Provost vs. Sandblom is scheduled for October 12. 198a. Thu hearing officers are: Commissioners Volk (Chair), Johnson. Fischer. and Geuse. Fred also indicated that in the case of Austin vs. Powers (City of Evanston), the Administrator ruled "Probable Cause" partially due to the City'ts Zoning Ordinance being in conflict with the Fair housing Ordinance relative to the unrelated Adult's Clause in the Zoning Ordinance. This would appear to violate the Fair Housing Ordinance duo to discrimination based upon marital status. flue to the conflict in the two ordinances, the case was resolved between the two parties. Regarding the three cases filed against Century 21/Mancheater Realty, the Administrator ruled "Probable Cause" on the solicitation portion and "No Probable Cause" on the panic -peddling portion. Evanston Human Relations Commission - Minutes 8/28/88 -3- After extensive investigation and consultation with outside counsel, it wars staff's opinion that the results of the investigation did not support the allegation of panic-peddlins. At the request of the complainants, staff will informally discuss the investigation with thew. The complainants always have the right to appeal the Administrator's decision to the full Commission, which in turn. could hold a hearing or refer it back to staff. In response to a question from Alderman Feldman, Fred indicated that there have been eighteen (18) persons who have signed the list desiring no solicitation. Owen mentioned that there have been mailings to community groups and organizations and anti -solicitation materials were given to Persona having block parties throughout the summer. A notice was also put in the Evanston Review. The Evanston/Skokis PTA Council has been asked to inform all PTA members of their right not to be solicited for real estate sales. To date, the only groups► that have assisted in getting the word out and/or signing on to the list are Nichols Neighbors and S. W. E. A. R. Alderman Feldman suggested that staff begin to build a track record of what has been done to encourage people to sign on to the list. The Human Services Committee would be interested in knowing everything that has been clone to encourage people to sign on to the list. It there is no interest after considerable effort has been made, there is no reason for it to be part of the Ordinance. Chair Fuechtmann summarized the discussion by stating that he would contact Judy Jager of the Evanston Neighborhood Conference and find out if they are going to assist in getting people to sign the non -solicitation lint. Aioo, staff should plan to have the forms available at the Block Club Congress sponsored by the F.vanoton Neighborhood Conference. Lastly, staff should take advantage of every opportunity to Sot people to sign the non -solicitation list. The Neighborhood Justice Center- Brenda Huff In response to a question from Commissioner Fischer regarding promotional materials, Brenda indicated that once organizations go to the City's Traffic Engineering Department to request that their street be blocked off for a block party, they are then referred to her to roceive materials on Commission activities. In response to another question from Commissioner Berman regarding the mediation of residents concerned about homeowner having movies made in his home, Brenda indicated that the mediation has been rescheduled at the request of both parties. 1 0 Commispion and Fair Housin Bu et Reauents Commissioner Volk indicated that she and Owen went through both budgets line by line in attempts to prepare a realistic budget For the upcoming fiscal year beginning March 1. 1989. She further indicated that there waxy a line by line analysis of each item comparing current expenditures with Projected needs for next year. In response to a question regarding the decrease in regular salaries, Owen indicated that the reduction is due to a new secretary being hired at an entry level salary. Commissioner Volk indicated that her aim was to present a realistic budget with the necessary dollars available for staff to achievu the objectives for the coming year. In response to Commissioner Fischer, Commissioner Volk referred the Commission to the Budget Summary sheets in the prepared budgets. Evanston Human Relations Commission - Minutes 9/28/88 -4- She indicated that the line items were based upon the six-month expenditure and the 1988-89 estimated expenditure at year and. Owen reminded the Commissioners that the 1989-90 Commission Budget Request will be reviewed by the Human Services Committee on October 10, 1988. it was decided that Chair Fuschtmann and Commissioners Fischer and Volk will attend the budget meeting on October loth. Commissioners also suggested that under the "Ongoing Activity Measures" coction of the budget, Activity #5 should read: "Number of Human Relations Complaints Addreased", and the measurement would be percent of complaints brought to closure. It was felt the word "issues" was too ambiguous. Regarding the Fair Housing/1001--Budget, Commissioner Fischer expressed concern about the Letter of Transmittal not coinciding with Commission involvement. Fred Underwood indicated that the Fair Housing Budget was prepared with monies for an audit as well as other Commission housing activities. Commissioner Berman indicated that he felt that the budget should reflect what the Commission planned to do relative to Fair Housing and how much money we would be given towards completing the activities. Chair Fuschtmann indicated that it was obvious that in order to continue fair housing enforcement at the current level, additional staff would be needed. Rosa i onal Fair Hous3i nR Avvroapti Commissioner Fischer indicated that he was in the procoan of talking with the Skokie Human Relations Committee, the Interfaith Housing Couter of the Northern Suburbs and the Minority Economic Resource Corporation, and attempt to develop interest towards a more coordinated fair housing effort in the northwest suburbs. Evanston Human Relations Commission - Minutes 8/28/88 -5- Issues discussed at the meeting were the educational gap between minority and non -minority students, more parental involvement in the schools and the PTAa, and special education. Dr. Iris Metz, Assistant Superintendent, also attended the meeting. She indicated that the Administration was supportive of the Human Relations Commission's efforts. The next Subcommittee mooting is scheduled for October 13, 1988. In response to a question from Chair Fuechtmann, Commissioner Rodgers indicated that at the August 16th meeting the major issues concerned the communication gap between school and parents. how to get more parents involved in school activities - PTA included - and, the educational gap between minority and non -minority students. In response to a question from Commissioner Fischer, Commissioner Rodgern indicated that numerous groups affiliated with District 65 were present at the August 16th meeting. The purpose was to hear from all of the groups to formulate some ideas as to how the Subcommittee could facilitate all groups towards working with the School District. Commisasioner Berman, who attended the August 16th meeting, indicated that his perception was that the PTA was more represented than other community groups. Further, he felt that perhaps the PTA has attempted to serve as a clearing-houoe in the past. Concerning the issue of black parental involvement. Commissioner Rodgers indicated that he heard people indicating that blacks reel that they were not part of the decision -- making process in the special education area. Commissioner Fischer indicated that if the Commission is going to serve as a Facilitator, it is necessary to determine myth from reality. In order to do this, it is necessary to know statistically the number of minority administrators. the number of students in special education classes. etc. Commissioner Rodgers agreed. He further indicated that there were several myths that are in the community about District 65. He agreed with Commissioner Fischer in that the Commission muot operate from a base of fticts rather than myths, innuendoea and hearsay. Alderman Foldnsan indicated that the Commission must bu caroful not to be advocates for someone's political agenda. He o uggeatod that certain questions are best addressed by the school community. The Commission certainly has a role in issues that are discriminatory due to either board Policy or teachers. However, the Commission cannot anoume that there are problems. There must be some factual basis. Alderman Feldman further indicated that what the Commission does not want to do is to lose credibility with any part of the Evanston community. The beauty of the F3uman Relations; Commission is that people can see that we do not advocate any Particular position other than what is right and just. Commissioncr Rodgers indicated that he had only two goads for the Subcommittee: One was to serve an a clearing -house. If citizens come to the Commission and indicate they have a problems, the Commission should be able to advise them where to go to gat the problem resolved. The other aim is to have the Commission forms a Youth Human Relations Commission in Evanston High School. He suggented that this would be one of the best avenues for groater visibility for the Commission. Such involvement would includes assistance in student government acitivites and having a scholarnhip For a student who best exemplifies the goals of the Human rWlationa Commission. Evanston Human Relations Commission - Minutes 9/28/88 -6- Commissioner Fischer suggested that tho Human Relations Commission facilitate more honest and open dialogue on racial issues at Evanston High School. He indicated that there are many issues that go on that are not addressed. Perhaps the Commission could serve as a convener to facili- tate meaningful dialogue. After more in-depth discussion it was determined that all Commissioners have minutes of the Subcommittee on Schools' meetings. This would enable all Commissioners to follow the concerns and perceptions that are voiced by those in attendance. Additionally, Alderman Feldman and Commissioner Berman suggested that the Commissioners on the Subcommittee make it known that the Subcommittee is not an extension (offical body) of the Commission proper. The sole purpose is to serve as a convener to hear concerns and perceptions, not to reach conclusions. Commissioner Berman indicated that he felt it was essential for the Subcommittee to have a marriage with the School Board so as to not appear to be subterfuging their efforts. In summary, Chair Fuechtmann indicated that there were four issues he felt the Commission should currently address. The first was the current Commission commitments. Secondly, are there human relations' issues beyond the current commitments that should be addressed. Thirdly, what should the priorities be in addressing these issues. And fourthly, how can the Commission organize to effectively address the priorities. Currently, we are strongly committed towards fair housing. An adiitional staff person is needed to assist us in our efforts. We want to increase the connections between block clubs and our housing activities. Also. the Commission is desirous of exploring a more regional approach to more open housing in the suburbs. Lastly, the Commission has established a school subcommittee to begin listening to Issues concerning the schools. This is a creditable first step in identifying what the concerns are. Chair Fuechtmann further mentioned that fair housing also includoo meetings, hearings, and audits. Considering the aforementioned, it is difficult to begin to think of other things that the Commlosion should address. Clearly, activities are cut out for the Commission. In regards to priorities, the regional approach to open housing has not been embarked upon as yet. Also. fair housing enforcement is going to take an incredible effort in the coming year. Due to new federal legislation there may be a need to again revise the Ordinance. In order to successfully manage the current load before the Commission, it is necessary to strengthen the committee approach that has been adopted. This seems to be the only rational way to manage the load we have taken on. Currently there is a Subcommittee on Schools, Conciliation Subcommittee, Audit Subcommittee, Neighborhood Justice Center Subcommittee, and the Regional Approach Subcommittee. It is important to work with the Neighborhood Justice Center Subcommittee to strengthen the anti -solicitation part of the Ordinance. Evanston Human Relations Commission - Minutes 9/28/88 -7- Also, It was decided that Commissioner Woodworth would work with Commissioners Rodgers and Donaldson on the Subcommittee on Schools. Due to the nature of concerns addressed by this subcommittee, it is advisable to have integrated representation from the Commission. Lastly, Chair Fuechtmann indicated that the Commission was desirous of the Subcommittee on Schools continuing their investigation of human relations questions involved with the Evanston schools. That primarily is a task of convening people and listening to what they have to say. Also, a record should be developed of the listening sessions and made available to the Commission. Prior to taking any steps towards planning or organi-zing, there should be an extensive meeting with the Subcommittee and possibly the entire Commission. When discussing Guidelines On Processing Audit Charges, the Commission suggested that the following language be used for clarity: 1. Upon receipt of any audit results, staff will concurrently do the following: A. Consult with the Law Department and City tanager to prepare recommendations regarding prosecution of possible fair housing violations. Tnese recommendatlons will be presented to the City Council for Council advice regarding the forum for prosecution, whether conciliation should be attempted, and settlements to be sought in conciliation. The a^vice and approval of Council will be sought for settlenun;s of audit cases arising out of concilication. 3. Prepare complaints on possible violations which small be filed before the Human Relations Commission prior to the expiration of the Fair Housing Ordinance statute of limitations. These charges will be filed to preserve the Human Relations Commission's right to near the cnarges. In the event a case is filed in the courts, the charges on the same case before the Hunan Relations Commission may be withdrawn Evanston Human Relations Commission - Minutes 11/16/88 page 2 i% 2. The Human Relations Commission Concilatlon Subcommittee will review and evaluate these procedures. The minutes were approved with the aforementioned revisions. Staff Repgrt - Executive Director Owen Indicated that he was currently investigating a complaint in Southwest Evanston regarding alleged racial harrassment. The complainant, a homeowner, feels that certain residents are against her because minority residents have lived with her from time to time. After speaking with a minority tenant at the house, they too feel that some residents are antagonistic toward them due to their race/black. Owen further indicated that the entire issue may be one of overcrowding in a house which would be ultimately decided by the Zoning Board of Appeals. However, If In fact there are racial overtones, another approach might be necessary to resolve the issue. Owen indicated that he spoke to a group of Independent Senior Citizens In i'lovember. The Invitation came at the request of the groups' president, Harry Robinson. Owen spoke on the overall role of the Human Relations Commission since Its establishment In 1964. Also In November, Owen was Interviewed by a graduate student at Northwestern Medlll School of Journalism. The student will be following the Hunan Relations Commission for the next three months and Is Interested in the area of housing enforcement. Lastly, Owen mentioned the death of Recreation Supervisor, Debra Austin. The Employee Assistance Counselor, Victim -Witness Program and the Crisis Intervention Team of the Evanston Hospital, all did a tremendous job in assisting City employees In working through their concerns about the Incident. Owen concluded by Indicating that the entire month has been quite trying for himself, staff, and otner employees. Alderman Feldman Indicated that the senior citizens Owen spoke to still have real concerns about the Levy Center, Its relocation and where It might be built. In response to a question from Commissioner Guess regarding the seniors being given ample opportunity to express their concerns. Alderman Feldman indicated that they have seen heard by Council but the decision has been made to raise the Levy venter within a two year time frame. Commissioner Guess Indicatec that ne wanted to make sure that the seniors were involved in some type process leading up to the removal of the facility. Alderman Fel�:man Indicated that attempts are now to Incorporate the seniors' concerns Into some type of multi -purpose senior center. WhIle it is not always possible to accomodate groups, the effort should be made to ma'ee people feel that their concerns are legitimate and being heard. Alderman Feldman Indicated that while he does not see the Commission having a role In this Issue, It is Important for the seniors to feel that they can come to any group to air their concerns. In resaorse to Evanston Human Relations Commission - Minutes 11/16/88 page 3 a question from Commissioner Berman, Alderman Feldman Indicated that the Levy Center Advisory Board has come out against moving the Levy Center and establishing a multi -purpose center In close proximity to the Levy Center. However, the Commission on Aging which represents a broader constituency than tho Levy Center proper, Is strongly in favor of a mufti -purpose senior center In close proximity to the Levy Center. Such a center would combine all of the senior services into one building. Social, psychological, and emotional counseling, senior health services, legal advice, are all services that would be housed In the multi -purpose center. Regarding the death of Debra Austin, Commissioner Berman r,entioned that usually during the last four to six weeks of the year, people become very depressed and there is some degree of irony. For many people this is perhaps the most depressing time of the year. He suggested that the Commission attempt to inform residents of ail of the services available to them during this time of the year. This could be done through the local news media free of charge or if necessary through advertlsment. All of the agencies that are available to help people in need would be listed. The objective would be to facilitate people to cope with stressful situations. Alderman Feldman felt that this was a good idea and suggested that the '•lental Health Board be contacted to work with the Commission. Chair Fuechtmann indicated that rather than this being an advertisement, it could be a public relations piece. Commissioners Johnson and Volk felt that the idea was excellent. There was a consensus of opinion that Owen and Brenda would work on this issue. Staff will consult with the Mental Health Board for assistance. Baring on Fair Ho sing Case 88-FH-011 Kelsey vs. S hemerhorm After discussing possible dates for a hearing, the Commission voted to hear the case on Wednesday, November 30, 1988 at 8:30 P.M. Also on that evening at 7:00 P.l1. the hearing panel on the case of Provost vs. Sandblom will go into deliberation. Staff will notify all parties about the room for each of the abovementioned meetings. Mr. LaGloia, counsel for J.P. Schemerhorn and Co., thanked the Commission for their attention In this matter. Staff Reports cont. Brenda Huff in response to a question from Commissioner Bermann about the ViC Conference on November 19, 1988, Brenda mentioned that the Commission will have a table near the registration desk. Aside from Commission materials that will be passed out, attendees will have an opportunity to sign the anti -solicitation list. Commissioner Bermann, Brenda and Fred will be at the conference. Owen will attend the conference after attending the American Legion/Human Relations Commission Pancake Day. Owen reminded the Commission that all funds raised at this activity will go directly to the Commission to be given to needy families during the Christmas holidays. Evanston Human Relations Commission - Minutes 11/16/88 page 4 Commissioner Guess commended Brenda for her case disposition format with the Neighborhood Justice Center. He felt that it was very clear and concise. He also Indicated that he felt that the Justice Center advisory board was a good idea. In reponse to a question from Commissioner Volk, Brenda Indicated that the in-service training session would be some time in January. Fred Underwood Fred spoke to the new Fair Housing Law printed In the Federal Register. He asked the Commission to submit comments after reading the new proposals. After discussion on whether or not the Commission would comment on the new language, 1t was decided that they build on any approach the Fair Housing Alliance might have and work with them towards drafting language. Chair Fuechtmann would sign any comment to be presented to HUD. Fred also mentioned that Lisa Beverly was working part-time in the area of Fair Housing. Lisa is assisting in the area of developing community outreach. Lastly, Fred Indicated that he was Interviewed by 1160 Minutes" regarding a steering case he was involved in while working at the Leadership Council of Metropolitan Open Communities. Filming took place at the 1160 I•linute" studio In Chicago. Fred will inform everyone If and when the piece is aired on national television. Process for Anneal of Ruling In Cases 88-FH-002. 88-FH-004. and 88-FH-010 Chair Fuechtmann indicated that he spoke with Alderman Warshaw, one of the complainants in the case, regarding identifying a mutually acceptable date to hear the appeal. He explained to her the process leading up to the Commissions decision to hear the appeal on December 14, 1988. Due to the unavailability of all complainants another date will have to be Identified. Chair Fuechtmann further indicated that he felt the Commission should decide on the process for the appeal prior to Identifying a date. Regarding the appeals process, the only question the Corrmissicn should decide on is whether or not the "no probable cause" ruling, by the Administrator was justified. If the Commission upholds the ruling,, the next step would be a hearing on the complaint. The Commission must be very careful to hear only the evidence pretaining to the "no probable cause" ruling. To hear other evidence would amount to a hearing of the entire complaint. The Commission's decision would pretain soley to the appeal by the complainants. Chair Fuechtmann further Indicated that Herb Hill of the City's Law Department suggested that a written brief be received from the complainants and staff regarding the reason for appeal and rationale for the "no probable cause" ruling, respectively. During the appeals hearing oral arguments from both sides would pretain 5trlctly to their resaective Evanston Human Relations Commission - Minutes 11/16/88 page 5 briefs. Also, both the complainants and staff will have a specified time period to present oral arguments. Alderman Feldman questioned why a complainant would need to write a legal brief stating why they are appealing a ruling. WhIIe one of the complainants Is an attorney, this could be a difficult task for the average citizen. Chair Fuechtmann Indicated that it was more procedural In nature and would give the Commission a written statement to go on. Commissioner 'folk Indicated that the degree of sophistication In the written statement would depend on the degree of sophistication by the person preparing one. There was discussion regarding the statement being voluntary versus It being required. Alderman Feldman indicated that the complaint itself could be used as grounds for the complainants appealing a ruling rather than requiring them to write a legal brief on why they are appealing. After further discussion, it was decided that the word "written statement" be substituted for the work "brief". Both complainants and staff could prepare written statements to help the Commission fc�:us on the issues. 'Jithout the such a statement the Commission would have to rely coley on oral arguments. In response to a question from Alderman Feldman, Chair Fuechtmann Indicated that the Commission has not reviewed the entire staff investigation. Alderman Feldman felt that it was necessary for the Commission to examine to staff's investigation In order to determine whether an appeal would be justified. Owen Thomas indicated that if the Commission sustain the "no probable cause" ruling after having reviewed staff's entire Investigative file, they would have prior knowledge of the case were It to go to the hearing stage. This might make It difficult for the Commission to be objective during deliberations. After more in depth discussion Chair Fuechtmann outlined the following procedure for the appeal: 1. Staff will submit to all parties, the same pieces of investigative material. 2. The appellants will prepare a written statement regarding their appeal. 3. Staff may respond to the statements in writing. 4. The resondents in the case may respond in writing. 5. The Commission will get the statements no later than tKo days prior to the appeals hearing. 6. A specified time will be alloted for appellants to present their oral argument. 7. A specified time will be presented for staff to present their argument. Evanston Human Relations Commission - Minutes 11/16/88 page 6 8. The Commission may or may not allow a specified time for the respondents to respond. 9. The Commission may ask questions to the appellants and staff during the responses. 10. The Commission will deliberate on the appeal In Executive Session. After an in depth discussion concerning the amount of time to aIIoted for the appeals hearing, there was concensus opinion that the entire January 25, 1988 Commission meeting be devoted to the appeal. Nominating committee members are not excluded from being slated for an officer. It was moved and seconded that the aforementioned Commissioners constitute the nominating committee. The vote was unanimous. Further, Chair Fuechtmann requested that all nominating committee members talk to other Commissioners regarding their choice. Brown v2, L•":ter Owen Thomas Indicated that the Commission's initial order in this cases stipulated that the complainant, 'tattle Brown, r:3celve S500.00; the City would receive 5528.00 covering the cost of the transcript and the respondent would pay S2000.00 for violating the Fair Housing Ordinance. Counsel for the respondent wanted to pay $500.00, $523.00 and $500.00 respectively. Through the City's Law Department efforts, the respondent is now willing to settle the case for $500.00, S528.00 and S1000.00 respectively. The question before the Commission is whether to uphold the Inital order or settle the case witn c1000.00 going to the City for flnes. After some discussion, the O..77issian voted to request that the respondent pay S500.00 to 'dattie Erown, $528.00 to the City for transcripts and 51000.09 as a fine for violating the Ordinance. The total amount being S2028.00. Owen will notify Herb Hill of the Commission's decision. After reviewing the calendar the Commission voted the fallowing dates for meetings in 1989: January 25 April 26 July 26 October 25 February 22 !•fay 24 August 23 Novemberl5 i•farch 22 June 28 September 27 December 13 Report fr_oM the Schools Subcommitte2 Commissioner Bermann indicated that he attended the Schools Subcommittee meeting held at Martin Luther Laboratory School on November 15, 1988. Those present heard from members of the School Districts' Blue Ribbon Committee on Special Education. Commissioner Bermann was impressed with the report from the committee members. He felt that there was good use of statistics and the report was well written. There was also good dialouge from the members of the PTA who were present and the Blue Ribbon Committee Nlembers. Nearly all the recommendations in the Blue Ribbon Report are doable. The PTA representatives will go back to their respective PTA's and get a sense of priority regarding the recommendations. These priorities will be presented at the next Subcommittee meeting In January. There will also be discussion of an action plan at that meeting. Commissioner Bermann indicated that the Human Relations subcommittee could assist in facilitating that action plan. The Commission could assist in getting the process from the discussion stage to an Implementation stage. The next Subcommittee meeting will be at Family Focus, 2010 Dewey Avenue, on January 12, 1989 at 7:30 p.m. Commissioner Eermann, who also attended the meeting Indicated that It would be to the Commission's advantage to work in concert with the PTA's. They are desirous of the Commission serving as a facilitator to help them address the Special Education Issue. He further Indicated that he felt the PTA Council was the most proactive Council he has seen 1n several years. Cn November 19, 1988, Owen indicated that he and other staff members attended the conference at Family Focus sponsored by the Evanston Neighborhood Conference. Also that morning Owen attended the Pancake :ay which was co —sponsored by the Evanston American Legion and Tne Human Relations Commission. On December 1, 1988, Owen attended the monthly meeting of tie American Legion and was presented with a check for $800.00, which was to be given to needy families in Evanston during the Christmas Holidays. Tr;Is was the second annual cooperative venture. Owen recommended that t-e proceeds be given to the Evanston Latin American Association to assist families in the 1200 block of Dodge Avenue who were relocated due to housing code violations. The entire Commission unanamlously endorsed the recommendation. Commissioner Johnson, a member of the Latin American Association, assured the Commission that the funds would be used to assist those who had to relocate. She Indicated that the families have many needs such as beds, sheets, etc. Owen also indicated that he was Involved in the Kelsey v. Schermerhorn hearing on November 30, 1988. The hearing was continued to December 7, 1988. On December 2, 1988, Owen Indicated that he was invited to have breakfast with Reverand Donald Scott, paster of Covenant Methodist Church. Reverand Scott Is also a member of the Evanston Ecumenical Action Council, (EEAC). Reverand Scott discussed a possible role the Human Relations Commission would have in assisting EEAC foster stronger relationships between blacks and whites In Evanston. This is a current concern with a subcommittee of EEAC. Commissioner Fischer Indicated that he was Interested in knowing what specific programatic ideas EEAC had and how they saw the Commission facilitating them. Owen Indicated that he would be giving periodic reports to the Commission once concrete Ideas are formulated. Lastly, Owen indicated that on December 9, 1988, he attended an Open House sponsored by the Latinamerican Office located at St. Francis Hospital. The invitation came from former Commissioner Lucinda Nieto. Owen mentioned that he received three checks from the attorney representing Bertha Graber In the Brown v. Graber fair housing case. S1000 goes to the city for violating the ordinance, $500 goes to the complainant, Mattle Brown, and $526 goes to the city for the cost of transcripts. Staff Report Brenda Huff In response to a question from commissioner Fischer regarding the conference sponsored by the Evanston Neighborhood Conference, Brenda mentioned that the sessions she attended were well organized. She really enjoyed the keynote speaker, `•Iary Dee. Also, I.1ary Gonzales was very inspirational. In reponse to another question from Commissioner Fischer regarding Issues at the ENC Conference that would directly i-aact on the work of the Commission, Owen Indicated that there were numerous housing Issues that directly related to our overall fair housing ef`crt. There were also concerns in the area of education that are currenTly being addressed by the Commission's Subcommittee on Schools. Commissioner Hermann Indicated that he felt that there were key points from the conference that the Commission can work on, but, there must be continued dialouge with ENC to make them aware of our continued interest in being a part of their process. The bulk of their attention 1s being focused on individual community groups. Commissioner Bermann further sT_ted that he felt that it would be advantageous for the Commission to invite John Schafer or Emily Guthrie to a Commission meeting to talk about common Interest. In summary, Commissioner Bermann indicated that ne felt that there were many things that took place at the conference that could Cenefit the Commission and it Is important to decide what Issues the Commission and ENC could address Jointly. Chair Fuechtmann Indicated that this was one of the major pieces he saw being on the Commission's agenda during the next six months. He felt the Commission should begin dialouge with ENC on common concerns. Commissioner Bermann indicated that It was possible for a situation like this to become politicized. However, the Commission should not see ENC as a force to be reckoned with. That might very well create an adversarial relationship. He further Indicated that he attended the ENC Conference wondering whether it would be politicized and attendees might be encouraged toward a particular mindset. The contrary was the case, however. He felt that discussions were very objective. After further discussion, the Commission decided that the Chairman should Invite members of ENC to attend the February 22, 1989 Commission meeting to dialouge on Issues of common concern. Staff Report Fred Underwood Fred updated the Commissioners on the recent audit which Is currently before Council after consultation with the City Manager and the legal department. Also, another complaint has been filed against a realtor for failure to notify staff of solicitations. In response to a question from Commissioner Fischer regarding the year to date complaints in contrast to last year at the same time, Fred Indicated that the number of current complaints should in no way suggest that violations are on the decrease. Audit results in 1987 were reported in the month of November white the current audit was completed In early December. Next month's report should reflect more accurately on the number of complaints to date. Fred also Indicated that on December 13, 1988, the Community Development Block Grant Committee voted to allocate an additional $3843.00 to the Fair Housing CDGB Budget Request. This means that only $3482.00 additional dollars would be needed to have a bare bones Fair Housing Program for budget year 1989-90. The final FY 1939-90 Commission request frogs rDGB was $62,257.00. With the CDG8 Committee's recommendation being $54,932.00, the additional $3843.00 increases the amount to $58,750.00. This Is 53482.00 short of our revised 1989-90 CDGB budget request. Report frem the Nominating Committee Prior to the Nominating Committee's report from Commissioner Wooi+ocrth, Commissioner Volk Indicated that the Nominating Committee consiCered t.ro issues. The first concern was Chair Fuechtmann not wanting to to considered for a second term. The second consideration was that current Vice -chair, Commissioner Rodgers, will be running for Alderman In the Eighth Ward. Chair Fuechtmann indicated that due to other pressing priorities, he did not feel it would be prudent of him to run for a second term as Chairman. There would be considerable demands on his t€cte in the coming year and he did not feet it would be wise to commltt himself to Chairmanship for another year. Commissioner 'doodwarth indicated that the process included contacting every Commissioner to receive Inout on who they felt the officers should be for the coming year. After considerable discussion, the Nominating Committee had slated Commissioner VoIK for Chairman and Commissioner Fischer for Vice -chair. There was concensus for the slate from the members of the Commission. Chair Fuechtmann asked for other nominations from the floor. There being none, Commissioner Bermann moved and Commissioner Donaldson seconded a motion to accept the Nominating Committee's slate. There being no discussion, the Commission voted unanimously for Commissioner Volk as Chairman and Commissioner Fischer as Vice-chairman for the upcoming 1989 year, beginning with the January meeting. The Commission also decided to have Chair Fuechtmann chair the January 25, 1989 Fair Housing Appeal Hearing. The entire Commission thanked Chair Fuechtmann and Vice -chair Rodgers for a job well done over the past year. Afterwards, everyone congradulated the new incoming officers. Chair Fuechtmann thanked everyone for their support and indicated that It has been a very rich experience to him due to the support he has received from both the Commissioners and staff. He thanked everyone for the energy and effort put Into the various issues that were addressed over the year. He asked that everyone do the same for Commissioners Volk and Fischer during the coming year. Chair Fuechtmann personally thanked Commissioner Rodgers for his leadership role with the Schools Subcommittee. Commissioner Volk indicated that there Is need to deliberate on the Provost v. Sandbloom fair housing case. The ideal time would be on January 25, 1989, prior to the appeals hearing of Rainey, Warshaw, and Jager v. Manchester/Century 21. Staff was asked to notify the parties In the appeals hearing tha the case will be heard at 7:30 p.m. instead of 7:00 p.m. The Provost v. Sandbloom deliberation will begin promptly at 7:00 p.m. Planning Session Chair Fuechtmann outlined the process used in the Commission's retreat in 1987. Dr. Homer Johnson served as facilitator. I! 1 • 1 " II aI c Chair Fuechtmann suggested that the next step would be to identify Issues beyond our current committments, then we could prioritize these issues. Commissioner Fischer suggested that one Issue to address Is the Housing Market. He felt It would be worthwhile to look at class changes and the entire gentrification question. What Is happening to the housing market and what imact those changes are having on the character of the population In Evanston. He felt that these concerns, particularly In the black community but also In parts of the white community. These are Issues that are not so much talked about. In order to address these concerns through policy committment there needs to be research to gain a factual base. Chair Fuechtmann indicated that it would be good to do research to develop a data base. Chair Fuechtmann indicated that another Issue to be considered beyond current Commission commlttments Is in the area of promoting better multi -cultural relations In Evanston. He felt it was good that the Evanston Ecumenical Action Council was willing to address this Issue. Chair Fuechtmann further Indicated that he would like to see the Issue be expanded to Include the .Jewish Community as well. Commissioner Bermann suggested that Commission meeting be at various locations throughout the city to help identify what some of the Issues are. This, In turn, would help focus on the type research that would be beneficial. The meeting could possibly be hosted by various community groups and organizations. Commissioner Bermann asked staff to research and Identify possible places to have Commission meetings In 1989. A report should be made at the February, 1989 meeting. In response to a question from Chair Fuectmann regarding the Commission's involvement In race relations in Evanston, Owen Indicated that he felt It would be appropriate for the Commission to be involved in a race relations workshop to examine our own values and feelings about the issue. Once we become more cognizant of the many facets of race relations, Ke could then be better equipped to facilitate others. This suggestion came some months ago from Commissioner Rodgers. Commissioners agreed that a race relations workshop would help in the area of addressing race relations In general. Owen was asked to research possible facilitators in this area and report back to the Commission at the February, 1989 meeting.
