The meeting of the Evanston Civil Service Commission was called
to order at 7:40 p.m. The minutes of the December 29, 1987 meeting
were approved.
Fire Chief Raymond Brooks was introduced to the Commission and
discussion was held regarding the selection of Firefighter/Paramedics.
The Commission then adjourned into Executive Session upon unanimous
vote, to discuss personal matters, at 7:50 p.m.
The meeting adjourned at 9:35 p.m.

were approved.

The meeting of the Evanston Civil Service Commission was
called to order at 7:10 p.m. The minutes of the May 3, 1988
meeting were approved. The Commission received a status report
on recently -hired Police Officers and their progress from
Chief Jacobi.
The Commission adjourned into Executive Session upon
unanimous vote, to discuss personnel matters, at 7:20 p.m.
The meeting adjourned at 10:00 p.m.

The special meeting of the Evanston Civil Service Commission was called to
order by Ms. Zachary at 6:50 p.m., for the purpose of hearing final oral
arguments in the case of Althea McKinney.
Oral arguments having been presented by both sides, the Commission ad-
journed into Executive Session at 7:35 p.m. for purposes of deliberation
in the matter.
At 9:15 p.m., the Commission reconvened in Public Session to announce its
decision as follows:
This Commission, after reviewing the record of these proceedings
including transcript of testimony, exhibits, briefs, the Hearing
Officer's report and recommendation and oral arguments on behalf
of both parties, hereby renders the following decision:
1. That Althea Williams McKinney be suspended for a
period of 90 days beginning October 23, 1987 through
January 20, 1988, without pay.
2. That the City of Evanston reimburse said Althea Williams
McKinney all pay and otherwise make her whole for any
and all lost benefits that may have been lost to said
employee from January 21, 1988 forward.
The meeting adjourned at 9:30 p.m.

The meeting of the Evanston Civil Service Commission was called to order at
6:15 p.m., for the purpose of final oral arguments in the case of Mark
Berndt, and for consideration of a motion to re -open proceedings in the
case of Althea McKinney.
Oral arguments were presented in the case of Mark Berndt.
At 7:00 p.m., the Commission moved to the second item on the agenda: the
consideration of a motion to re -open the proceedings in the case of Althea
McKinney. Ms. Ellen Szymanski was present; neither Mr. Donoghue nor Ms.
McKinney were present. The Commission decided to proceed in considering
the motions from the City and from Ms. McKinney, which had been submitted
in writing.
The City requested to make a correction to its motion, specifically that in
paragraph 9 and 10 the date of October 23, 1987 be changed to read January
21, 1988. The motion to amend was approved by the Commission. There was
brief discussion regarding unemployment compensation procedures, and res
judicata.
The Commission, upon unanimous vote, adjourned into Executive Session at
7:15 p.m. for purposes of deliberation on these matters.
At 8:00 p.m., the Commission reconvened in public session to announce its
decision in the case of Mark Berndt, as follows:

"This Commission, having reviewed the records of these proceedings,
the opinion of the Hearing Officer and having heard oral arguments and
being fully advised in the premises, does hereby make the following
findings:
1. On December 14, 1987, Hark Berndt was employed
as a patrol officer for the City of Evanston
Police Department.
2. On December 14, 1987, the City of Evanston had in
full force and effect the Evanston Civil Service
Commission.
3. On December 14, 1987, the Evanston Police Department
has in full force and effect certain rules numbered
2, 3, 4, 10 and 15, more fully set out as Exhibits
in the hearing.
4. On December 14, 1987, Sergeant Gallivan found
Officer Berndt sleeping in his vehicle.
5. On December 14, 1987, Officer Berndt admitted
he "screwed up." He admitted that he was
sleeping.
6. The actions of Officer Berndt were in violation
of City of Evanston rules 2, 3. 4. 10 and 15.
7. The City of Evanston has sustained its burden to
prove the events as alleged.
8. officer Berndt should be suspended for his
conduct.
9. The 20-day suspension of Officer Berndt by
Chief Jacobi is reasonable and appropriate
under the circumstances, for said violations.
Therefore, the appeal of Officer Berndt from said suspension is hereby
denied and said suspension of 20 days without pay hereby upheld.
This decision is certified to the appropriate persons for enforcement."
At 8:10 p.m.. the Commission again adjourned into Executive Session to
deliberate in the Althea McKinney matter.

At 8:45 p.m., the Commission re --convened in public session to announce
its decision, as follows:
"This Commission having taken under advisement the amended motion of
the City of Evanston Police Department to re -open these proceedings for the
purposes of determining the amount to be offset from Ms. McKinney's back
pay, and the written response and objections thereto filed on behalf of Ms.
McKinney, it is the decision of the Commission as follows:
That this Commission's decision of July 13, 1988 that Ms. McKinney be
reimbursed "all pay and otherwise make her whole for any and all lost
benefits that may have been lost to her from January 21, 1988 forward"
means, by the clear implication thereof, that Ms. McKinney is entitled to
back pay only to the extent permitted by law, which includes the right of
the City to offset such back pay to the extent the law permits under
established cases and otherwise.
This being the case, this Commission finds no need to re -open these
proceedings and therefore denies such motion.
However, this Commission means to clarify its decision of July 13,
1988 and directs the City to tender to Ms. McKinney the full amount to
which she is entitled as clarified herein."
The meeting adjourned at 8:50 p.m.

to order by the Chair at 7:30 p.m. The minutes of the September 9th
and the September 27th meeting were approved.
The Commission welcomed its new member, Dr. Nathan Clark.
The Commission adjourned into Executive Session, upon unanimous
vote, to discuss personnel matters.
There being no further business, the meeting adjourned at 10:00
p.m.
