Jacobi Lieutenant Daniel Mangas Sergeant Thomas Gallivan Alderman Marge Wold The Police Services Committee meeting was convened at 7:40pm by Alderman Wold. The meeting was held at the Evanston Civic Center, Room 2401. Item I - Minutes The minutes from the December 7, 1989 meeting were approved and accepted. Item II - Complait Reviews *89-14 This C.R. was taken off the agenda due to pending Civil Litigation against the City by the complainant in this matter. On advise of the City Lau Department, this matter will not be addressed until the Civil process is completed. *89--16 Complainant xl L/M 18 years old Complainant #2 L/bi 19 years old Accused Officer tlW/114 47 years old Accused Officer t2W/Tef 26 years old Alleuations: The Complainants stated that the officers treated them with disrespect and used slurs against their Hispanic Heritage. Accused officer #1 was accused of kicking Complainant #2 car door causing damage to the door. M Police Services Committee February 1, 1990 Page 2 Investiaation Summary: Both accused officers stated that they never used any slurs against either of the complainants. Accused officer #1 stated that he kicked the side of the complainants car door, but stated that it was a defensive move to keep from being hit by the door when complainant #1 opened the door% Disposition: The charges against the officers were not sutained, however, the officers violated Department rules when they failed to report the incident they had involving the complainants. The officers were disciplined. Police Services Committee: The Police Services Committee accepted C.R. 89-16 Item III - Northwestern University Police ordinance Chief Jacobi explained to the Committee the problems that were encountered when the Auxiliary Police ordinance was repealed. It became clear that the city had to have a means to monitor and control certain activities of the Northwestern Campus Police. The new ordinance is in place and the problems have been worked out. Item I - Minutes The minutes of February 1, 1990 were reviewed and accepted. Item II - Communications Twelve citizen letters were presented and reviewed. Item III - Complaint Reviews 89-015 Complainant: Charge: Accused: Summary: Disposition by Chief: Review by Committee: 8/F 38 years of age Physical abuse/excessive use of force H/M 36 years of age, uniformed police officer The complainant alleged her 17 year old son was struck by the =_- accused officer with his flashlight. She further alleged the officer struck and kicked her son. She also alleged the officer struck her in her right eye. Unresolved Accepted MIKE P.S.C.M. Item III - Complaint Reviews (cont'd) 89-019 Complainant: Charge: Accused: B/M 38 years of age Excessive use of force during an arrest and racial slurs W/M 50 years of age, uniformed police officer Summary: The complainant stated he called the police to have his ex -girlfriend arrested and was arrested instead and the accused officer used excessive force while making the arrest. The officer also called him a "nigger". Disposition by Chief: Unfounded Review by Committee: Accepted Item IV - Other Business Bike Patrol A letter sent from the REsidential Crime Prevention Committee (R.C.P.C.) expressing their strong support of a bike patrol program during the school summer vacation was discussed. It was decided that, at the present time, there is no budgetary funding available. Alderman Wold Will send the R.C.P.C. a letter concerning the matter. Annual Report - Bureau of Inspection and Internal Affairs - 1989 The committee discussed the report and decided it Would be a good idea to send copies to all members of the City Council. W.E.D.G.E. The committee was presented a copy of this program by Chief Jacobi. It was decided that the program would be studied and commented upon at a Inter date. 1989 Police Service Statistics Chief Jacobi presented an overview of the statistical data and pointed out the differences in the criteria for reporting juvenile arrests. N.U. Article Alderman Wollin commented on an article nhe read in the Daily Northwestern Newspaper relating to the fear of crime in south eamt Evanston as being the cause of so many rental properties being vacant. Alderman Marge Woid presiding. Item I - Minutes: The minutes of April 5, 1990 were reviewed and approved. Item II - Dangerous Dog Ordinance: Mrs. Leslie Yambert appeared before the Committee and presented information regarding the current Dangerous Dog Ordinance, Mrs. Lambert stated that she felt the present Ordinance is not effectively serving the needs of the community and should be changed. The Committee, after a lengthy discussion with reference to the problems as stated by Mrs. Lambert, decided to refer the matter to the Planning and Development Committee and the Legal Department for an opinion on the matter. Item III - Communications: Six Citizens Letters were presented and reviewed. Two of the accused officers were found to be in violation of Departmental Rules and received discipline for their actions. W/14 34 Years of Age The accused officer parked a marked police vehicle in a No Parking Zone in Chicago. B/M 43 Years - Uniformed Patrol Officer The complainant alleged the accused officer parked his marked squad car in a No Parking Zone and this was improper. The -accused officer was found to be in violation of Departmental Rules,and was disciplined for same. BIM, 241 Years of Age Har�Ssment W/11; 28 Years of Age The;tomplainant stated that he ribs delivering newspapers ; and was stopped by the accused officer for no reason; He was then told he "had a big mouth, just like his father and mother".. This complaint was UNFOUNDED. Accepted. *90-001 Complainant: W/M,19 Years of Age Charge: The accused officer struck the ' complainant in the eye with a flashlight. Accused: W/M;29 Years of Age Summary: The complainant alleged he was leaving a flew Year's Party and was thrown to the ground by the accused officer and then hit in the eye with the officer's flashlight. Disposition by Chief: This complaint was UNFOUNDED. Review by the Committee: Accepted. *90-003 Complainant: B/F 35 Years of Age Charge: Unprofessional Conduct. Accepted. Egyptian/M 24 Years of Age Unnecessary use of force and hostility towards the complainant. B/14 49, Years of Age The complainant stated the accused officer, while investigating a cese of a child left unattended In a car, used unnecessary force and.ihowed his hostility towards the complainant. This complaint was classified ! as EXONERATED. Accepted. Chief Jacobi gave a presentation on the Gang problem in Evanston. He noted that there has been a definite decline in gangs and members. In the past -six years the number of identifiable gangs has declined from eight (8) in 1984, to two (2) in the first six months of 1990. Item VI - Other Business: The Staff and Committee members discussed drugs and gangs as a problem in Evanston. Chief Jacobi noted that the WEDGE and DARE PROGRAMS initiated by the Department, while still in their infancy, were being received well in the Community and the Schools. Jacobi Lieutenant Ron Pryor Sergeant Richard Ayers Alderman Marge Wald The meeting of the Police Services Committee convened in Room 2404 of the Evanston Civic Center at 7:35pm, Alderman Marge Wold presiding. Item I - Minutes The minutes of June 7, 1990 were reviewed and approved. Item II -- Communications Nine citizens letters were presented, reviewed and accepted. The Committee discussed the response by Assistant Corporation Counsel Ellen Szymanski, offering opinions on the Dangerous Dog Ordinance. Alderman Wold said she doesn't see an immediate need to change the Ordinance as it is written now. Chief Jacobi stated that the complainant appearing before the Committee on .Tune 7, 1990 said things are much better now at the problem location. Item III - New Business Dr. Eisenstein appeared before the Committee and voiced his concern for youths who are not wearing bicycle helmets when cycling. He stated that he feels there should be some legislation requiring the use of helmets. P.S.C.M. 9-6-90 Page 1 of 7 Item III -- New Business (cont' d) Alderman Rudy inquired as to whether or not there was any current State legislation requiring the use of helmets and was told there is not. Alderman Rudy further suggested that persons who have suffered head injuries from cycling without Helmets could possibly appear before the Committee to share their. experiences. Chief Jacobi said he would check into related legislation and report back to the Committee. Alderman Wold related that the issue certainly seems worth pursuing and said that Staff will check out other Ordinances available. D.I. 90-003 A citizen appeared before the Committee to express her displeasure with a decision by the Police Department not to take any punitive action towards an officer of the Department for displaying a "poor attitude" towards her. The citizen voiced her opinion in the matter and was advised that the Committee would meet in Executive Session and advise her, at a later date, of their decisioni. Noise Comments Chief Jacobi commented on some problems stemming from the use of loud speakers at block parties in the 700 block of Reba and James Park. There was a general discussion by the Committee on the effect of Noise Meters as an instrument of use in the prevention of noises and its suitability as an enforcement tool. The also used profanity during the arrest. Summary: The complainant said that she was arrested by the accused officer for an Ordinance violation and during the arrest, he manhandled her and used profanity. The complainant said that he witnessed the accused officer make an arrest and the officer used unnecessary force and would not give his name and star number when asked. Item I - Minutes The minutes of the September 6, 1990 were reviewed and Alderman Wallin recommended that page 1, Item III - O.I. #90-003, line 2, be corrected to read that the disposition would stand instead of the complaint would stand. The minutes were approved with the correction. Item II - Communications a Citizens Letters Ten citizen's letters were presented, reviewed and accepted. a Bicycle Helmets Chief Jacobi said his report on bicycle helmets would be presented at the next meeting. a Aldermanic Response to O.I. #90-003 The Aldermanic Response to 0.1. #90-003 was reviewed and approved. , Item III - flew Business C.R. 190-019 A citizen appeared before the Committee to express his displeasure with a decision by the Police Department not to sustain a complaint against an officer of the Department for striking him in the chest. The citizen voiced his opinion in the matter and was advised that the Committee would meet in Executive Session and advise him, at a later date, of their decision. S Item III - New Business (cont'd) Sample of an A.R. A sample of A.R. #90-096 was reviewed by the Committee and accepted. The Committee commended the Department for its pursuit of this case and noted that the alleged victim admitted that the incident never happened. Item IV - Complaint Reviews 0 90-016 Complainant: B/M 22 Years of Age Charges: Excessive Use of Force Accused: W/M 30 Years of Age. Uniformed Patrol Summary: The complainant alleged that the accused officer used excessive force by striking him in the head with a nightstick while arresting him. Disposition by Chief: EXONERATED 0 90-018 Complainant: B/M 27 Years of Age Charges: Racial slurs and threats of bodily harm. Accused: W/M 28 Years of Age, Uniformed Patrol Summary: The complainant alleged that the accused officer called him "A Jamaican piece of shit" and threatened to shoot him in the stomach. Disposition by Chief: NOT SUSTAINED 0 90-019 Complainant: B/M 20 Years of Age Charge: Excessive Use of Force - Accused: B/M 36 Years of Age, uniformed Patrol Summary: The complainant said the accused officer struck him twice in the chest while he was under arrest at the police station. Disposition by Chief: NOT SUSTAINED Item III - C.R. #90-019 The Committee went into Executive Session at 7:05 pm with reference to this complaint. .It was decided that the disposition would stand and the complainant would be advised of the disposition.
