Resolution 29-R-20, Extending the Declared State of Emergency to April 13, 2020 Staff recommends City Council adoption of Resolution 29-R-20 extending the declared State of Emergency to April 13, 2020. COVID-19 State of Emergency Preparation, planning and issues regarding the current state of emergency for Covid-19. For Discussion (VI) PUBLIC COMMENT Members of the public are welcome to speak at City Council meetings. As part of the Council agenda, a period for public comments shall be offered at the commencement of each regular Council meeting. Public comments will be noted in the City Council Minutes and become part of the official record. Those wishing to speak should sign their name and the agenda item or non-agenda topic to be addressed on a designated participation sheet. If there are five or fewer speakers, fifteen minutes shall be provided for Public Comment. If there are more than five speakers, a period of forty-five minutes shall be provided for all comment, and no individual shall speak longer than three minutes. The Mayor will allocate time among the speakers to ensure that Public Comment does not exceed forty-five minutes. The business of the City Council shall commence forty-five minutes after the beginning of Public Comment. Aldermen do not respond during Public Comment. Public Comment is intended to foster dialogue in a respectful and civil manner. Public comments are requested to be made with these guidelines in mind. (VII) CALL OF THE WARDS (Aldermen shall be called upon by the Mayor to announce or provide information about any Ward or City matter which an Alderman desires to bring before the Council.) {Council Rule 2.1(10)} (VIII) EXECUTIVE SESSION (IX) ADJOURNMENT Page 2 of 5 Memorandum To: Honorable Mayor and Members of the City Council From: Brian George, Assistant City Attorney Subject: Resolution 29-R-20, Extending the Declared State of Emergency to April 13, 2020 Date: March 26, 2020 Recommended Action: Staff recommends City Council adoption of Resolution 29-R-20 extending the declared State of Emergency to April 13, 2020. Council Action: For Action Summary: The Mayor of the City of Evanston declared a state of emergency in the City in response to the COVID-1 Emergency Illinois the of 11 Section 15, March on outbreak 9 2020. Management Act provides that the Mayor's declaration will only last seven (7) days without City Council consent. Given the fact that there is no immediate end to the COVID -19 outbreak in sight, staff recommends that City Council adopt Resolution 29 -R-20 to extend the current state of emergency to April 13, 2020, the date of the next scheduled City Council meeting. Attachments: Resolution 29-R-20 Extending State of Emergency to April 13, 2020 SP1.Page 3 of 5 3/19/2020 29-R-20 A RESOLUTION Extending the Declared State of Emergency to April 13, 2020 WHEREAS, the City of Evanston, Cook County, Illinois (“City”), is a home rule unit of government and, pursuant to the provisions of Section 6(a) of Article VII of the Illinois Constitution, may exercise any power and perform any function pertaining to its government and affairs; and WHEREAS, on March 13, 2020, the President of the United States declared a national emergency concerning the Novel Coronavirus Disease (“COVID- 19”) outbreak; and WHEREAS, on March 9, 2020, the Governor of Illinois issued a disaster proclamation for the State of Illinois concerning the COVID-19 outbreak that is to last 30 days; and WHEREAS, on March 15, 2020, the Mayor declared a state of emergency due to the COVID-19 outbreak pursuant to Section 9-9-3 of the City Code; and WHEREAS, Section 11 of the Illinois Emergency Management Agency Act, 20 ILCS 3305/11, provides that a disaster declaration by the principal executive officer of a political subdivision shall not last longer than seven (7) days without the consent of the governing board of the political subdivision; and WHEREAS, the City Council finds that it is appropriate extend the current declared state of emergency until April 13, 2020, the date of the next scheduled City Council meeting; Page 2 of 3 SP1.Page 4 of 5 29-R-20 ~2~ NOW BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS, THAT: SECTION 1: The current declared state of emergency is hereby extended up to and including April 13, 2020. SECTION 2: This Resolution 29-R-20 will be in full force and effect from and after the date of its passage and approval in the manner provided by law. _______________________________ Stephen H.
