t S 7 • r� U 42-0-60 , �1 AN ORDINANCE i Vacating the West Three and one- half (3v2) feet of Asbury Avenue North of Brummel Street. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: SECTION 1:. All that part of the West three and one••half (3ya) feet of Asbury Avenue extending north from Brummel Street for a total of eighty- two (62) feet and legally described as - Vacation of the west three feet six inches (3'-6") of Asbury Avenue lying east of and adjoining Lots 3, 49 and 5 in the First Addition to Arthur Dunas Howard Avenue Subdivision in the N.E.14 of Section 25, Township 41 N., Range 13 East of the Third Principal Meridian in the City of Evanston, Cook County, Illinois, as cross -hatched and indicated by the words "HEREBY VACATED" on the Plat hereto attached, which plat for greater certainty is hereby made a part of this ordinance, be and the same is hereby vacated and closed, inasmuch as the same is no longer required for public use and the public will be subserved by such vacation, provided however, that said vacation shall be subject to any public utilities presently installed or located therein, together, with right of egress and ingress for maintenance of the same; ; subject also to an easement granted to the City of Evanston by the LaSalle National Bank as Trustee under Trust #24430 and the beneficiaries of said trust permitting use of the West three and one-half feet beginning at the South property line of Lot 5 and extending thirty (30) feet North to permit maintenance by the City of Evanston of existing sidewalk. WHEREAS,, the undersigned did request of the City of Evar4ton, a Municipal corporation, the vacation of all of that part of the west 3 if 2 feet of Asbury Avenue extending north from Brummel Street for a total of 82 feet, and legally described as m Vacation of'othe west three feet six inches (3'-6") of Asbury Avenue lying east of and adjoining Lots 3, 4, ' and 5, in the First Addition to Arthur Dunas Howard Avenue Subdivision in the N.E. !# of Section 25, Township 41 N., Range 13 East of the Third Principal beridian in the City of Evanston, Cook County, Illinois. Legal title to said property is recorded in name of La Salle National Bank as Trustee under Trust No. 24430; and WHEREAS, the City Council of the City of Evanston on November 26, 19W adopted Ordinance 42-0-60 vacating that portion of Asbury Avenue heretofore described, subject however, i among other things, to an easement to the City of Evanston permitting the City of Evanston the use of a portion of said vacated area so as to maintain the existing sidewalk: NOW THEREFORE, in consideration of the vacation of a portion of Asbury Avenue as aforesaid, the undersigned do hereby grant to the City of Evanston an easement over the west 3 1/2 feet beginning at the south line of Lot 5 and extending 30 feet north to permit maintenance by the City of Evanston of the existing sidewalk for public pedestrian traffic so long as said sidewalk shall be maintained in the location aforesaid. I A plat of said area is hereto attached and made a part hereof* In the event said sidewalk is relocated upon city { owned property and the need for said easement for the maintenance' 890 • of said existing sidewalk is no longer necessary, this easment shall cease and be of no further effect.
