HomeMy WebLinkAbout26-O-608 C r J r Ln l/ v 26-0-60 v1 AN ORDINANCE �j AMENDING AN ORDINANCE ENTITLED "An ordinance to classify, regulate and restrict the location of trades and industries and the location of buildings designed for specified uses and to regulate and limit the height and bulk of buildings hereafter erected, to regulate and limit the intensity of the use of lot areas of yards, courts and other open spaces within and surrounding such buildings and to establish the boundaries of districts for the said purposes and prescribing penalties for the violation of its provisions," adopted by the City Council of the City of Evanston on January 18, 1921, and approved by the Mayor of said City on January 19, 1921, as amended March 25, 1940, hereinafter called the "ZONING ORDINANCE" BE IT ORDRINEU BY THE CITY COUNCIL OF THE CITY OF EVANSTUN, COOK COUNTY, ILLINOIS: • SECTION 1: That a variation from the use and height regulations of the zoning ordinance so far as said regulations pertain to the property in the City of Evanston located at the southwest corner of Ridge Avenue and Davis Street, is hereby granted, permitted and made so'as to permit DAVIS CORNER, INC., to construct an institutional type office building at the southwest corner of Ridge Avenue and Davis Street in the block bounded by Davis Street, Asbury Avenue, Grove Street and Ridge Avenue, to be owned, occupied and controlled by the General Board of Pensions of the Methodist Church, subject to the following conditions: 0 853 • 1. The building shall be set back at least 30 feet from Ridge Avenue, 30 feet from Davis Street, and 45 feet from Asbury Avenue, the distance to be measured from the property line or the inside sidewalk line, which- ever would result in the greater setback; 2. Automobile entrance to and exit from the property shall be from Davis Street; the locations subject to the approval of the City Manager; 3. A strip 27 feet in width, measured from the property line or the inside sidewalk line, whichever would result in the greater setback, shall be preserved along the east side of Asbury Avenue, not less than 20 feet of which shall be planted and maintained with grass, and the easterly few feet of said strip is to be improved with shrubbery designed to obscure the parking lot. A similar strip of shrubbery running east and west, at a point approximately 120 feet north of the north property line of Grove Street shall be provided. This row of shrubbery shall continue eastward from the shrubbery on Asbury Avenue to the point where this property joins with the municipal park. This strip of shrubbery shall extend north and east along the municipal park boundary line. The remaining land at the northeast corner of Grove Street and Asbury Avenue area shall be developed into an open park area and used as such until the need • for parking facilities shall reach the maximum number of required spaces as determined by the City Council, and as further stated herein. A similar grass and shrub- bery strip shall be provided on the Davis Street side from Asbury Avenue to the main entrance of the proposed building near the northeast corner of this parcel. All of the above shall be in accordance with the revised site plan as approved by the City Manager. 4. Parking space for a minimum of 70 automobiles shall be provided on the property in such manner as to be hidden from view from Asbury Avenue, from Davis Street, from Grove Street, and from the municipal park, and that owner will execute an agreement in proper form with the City of Evanston for the installation of an additional 20 car area whenever the need therefor shall be determined by the City Council. 5. The variation is subject to the execution of an agreement in proper form with the City of Evanston providing that in the event the property becomes e'.igible for tax exem- ption, that annual paymants in lieu of taxes shall be made based on tax rates and assessments prevailing. 7. A low level lighting shall be provided for the parking area subject to the approval of the City Manager, all in accordance with the plans submitted to and the findings of the Zoning Board of Appeals. The granting of this variation shall not affect the terms of a certain decree entered in the Circuit Court of Cook County, Illinois on May 5, 1960 in Case 60 C 6116 ordering and directing the transfer of certain properties and the abrogation of a covenant running with the land as it pertains to the present Alexander Park. SECTION 2: The Director of Building is ordered and directed to grant a permit to • DAVIS CORNER INC., to construct an institutional type office building, subject to the provisions referred to in Section 1 of this ordinance and in accordance with the plans submitted and recommendation of the Zoning Board of Appeals. All actions of the Director of Building which have been taken and which conform to the provisions of this crdinance are hereby ratified and approved. ..3- • 855 • • 0 SECTION 3: This ordinance shall be in full force and effect from and after its passage and approval, according to law.
