AN ORDINANCE
Vacating Alley -Lying South of
Mulford Street and North of
Chicago Northshore & Northern
Railroad, between Wesley Avenue
and Asbury Avenue
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EVANSTON.. COOK COUNTY, ILLINOIS:
SECTION.1: All that part of the East and
West public alley lying North
of the Chicago Northshore & Northern Railroad, and extending West
from Asbury Avenue to and adjoining the north " an d ' s outh alley
south of Mulford Street between Wesley Avenue and Asbury Avenue,
and legally described as -
The sixteen (16) foot public alley lying south
of and adjoining Lot 7 in George F. Nixon and
Company's Asbury Avenue Rapid Transit Subdivision
in the N.E. 4 of Section 259 Township 41 North,
Range 13 East of the Third Principal Meridian in
the City of Evanston, Cook County, Illinois,
as cross -hatched and indicated by the words "HEREBY VACATED" on
the plat hereto attached, which plat for greater certainty is'
hereby made a part of this ordinance, be and the same is hereby
vacated and closed, inasmuch as the same is no longer required
for public use and the public will be subserved by such vacation,
provided however, that said vacation shall be subject to any
public utilities presently installed or which may be hereafter
located therein, together with right of ingress and egress for
maintenance of the same, and provided further that no- buildings
shall be constructed upon the vacated alley and said land will be
used exclusively fora tot lot and be continuously landscaped,
in accordance with requirements of the Department of Public Works.
Failure to comply with any of the foregoing conditions shall cause
title to revert to the City of Evanston.
SECTION 2: This ordinance shall take effect
and be in force from and after
its passage, and approval, subject to the condition that the
City Clerk shall, within 90 days after its passage, file and cause
to be filed for record in the office of the Recorder of Deeds of
Cook County, Illinois, a certified copy of this ordinance together
with the Plat made a part hereof.
