Regulating the -Constructions
Maintenance, and Operation of
Private Residential Swimming Pools
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON,
COOK COUNTY, ILLINOIS..

SECTION 1: Short Title. This ordinance shall be known and
may be cited as the Private Residential
Swimming Pool Ordinance of the City of Evanston.
SECTION 2: Definition. Private Residential Swimming Pool,
as regulated by this ordinance,
shall mean any swimming or wading pool over 2 feet in depth, or with
a surface area exceeding 250_square feet, located upon private resi-
dential property in connection=with a private residence, and intend-
ed only for the use of the individual owner, his family and friends.
This shall include portable or temporary type pools installed entire-
ly above ground elevation except that the provisions of Sections 4 (a)
and,5 (a) shall- not apply to said -pools. The provisions of this
ordinance shall apply to all existing or new swimming pools as defined
in this ordinance, except where otherwise indicated.
SECTION 3: Location. Private Residential Swimming Pools,
-as regulated by this ordinance, shall
be permitted in residential zones as defined by the present or here-
after adopted zoning ordinance, No portion of any private residential
swimming pool shall be located at a distance less than 8 feet from
any side or rear property -line or building line. Pumps, filters and
water disinfection equipment installation shall be located at a
distance of not less than 6 feet from any rear or side property line.
Pools and appurtenant equipment shall -not be permitted in any required
side yard between buildings. The provisions of this section shall
not apply to private residential swimming pools, of a permanent nature,
constructed prior to the effective date of this ordinance.
SECTION 4: Permit Required.
(a) Installation Permit: It shall be unlawful to
install, enlarge or alter any private residential swimming pool with-
in the City of Evanston unless a permit therefor shall have first
been obtained from the Director of Building.. The permit fee for the
erection, construction or -alteration of a private residential swim-
ming pool shall be $10 for each 250 square feet or fraction thereof
of surface area, to be contained -within the proposed pool as deter-
mined by the plans and specifications submitted with the application
for permit.
(b) Operation Permit: A permit to operate and
maintain a private residential swimming pool shall be required. Such
permits shall be applied for annually, and whenever a pool is reopened
for swimmers' and waders' use or operation after being closed three
months or more. Application for.an operation permit shall be made
to the Director of Health who shall cause said pool to be inspected
before any operation permit is issued.
The operation -permit -fee shall be $10 annually. If
three or more inspections are required to enforce compliance with
the provisions of this ordinance, an additional fee of $10 for the
third and for each successive inspection during any one calendar year
shall be paid by the operator of said pool. Operation permit fees
shall be payable to the,City Collector.
SECTION 5: (a) Drawings and Plans: All drawings and plans
for the construction, installation,. enlarge-
ment or alteration of any private residential swimming pool and
appurtenances shall be presented to the Director of Building for
examination and approval as to location and construction. All draw-

ings shall be complete, showing the lot lines and including inform-
ation pertaining to Fence construction, water supply system, drainage
and water disposal system and all appurtenances to the pool.
(b) Material and Structural Design. Private
residential swimming pools shall be constructed of impervious material.
The pool structure shall be designed to withstand the water pressure
from within and to resist pressure of the earth when the pool is
empty, against the forces to which it will be subjected. No pool
shall be -constructed in such proximity to adjoining property as to
cause a weakening of any adjoining foundations or collapse of soil.
(c) Fences. All private residential swimming area
or area in which the pool is located shall be completely enclosed by
a fence adequate to restrain children.
(d) Compliance with Plumbin and Electrical Codes:
Private residential swimming pools, as controlled by this ordinance,
shall comply with the ,present or hereafter adopted Evanston Plumbing
and Electrical Codes. No Current carrying -electrical conductors shall
cross private residential swimming pools either overhead or underground,
or 'within 15 feet of such ,pools. All metal fences, enclosures, or
railings near or adjacent to said pools, which might become electrically
alive as a result of contact with broken overhead conductors or from
any other cause, shall be effectively grounded.
(e) Water'Sup2lz. No source of water other than
that secured from the City of 'Evanston Water Works distribution
system shall•be used in private residential swimming pools.
SECTION 6: Sanitary. Requirements - Adoption of Rules and
Regulations. The City -Council shall adopt such
written rules -and regulations,submitted by the Director of Health as
may be necessary to establish minimum safety and sanitary requirements
in connection with the installation and operation of private resi-
dential swimming pools provided that such rules and regulations shall
not be in conflict with the provisions of this ordinance. The
Director of Health shall file a certified copy of all said rules and
regulations, which may be adopted by�the City Council, with the City
Clerk. Such rules and regulations shall -have the same force and
effect as the provisions of this ordinance and the penalty for violations
thereof shall be the same as the penalty for violations of the provisions
of this ordinance.
SECTION 7: Sanitation of Premises. The buildings, grounds, and
all other pool facilities shall be kept clean and in a sanitary condition
and maintained free from garbage, trash and other refuse.
SECTION 8: Interference with Enjoyment of Property Rights
Prohibited. No private residential swimming pool
shall be so located, designed, operated or maintained as to interfere
unduly with the enjoyment of property rights by owners of property
adjoining the pool or located in the neighborhood.
SECTION 9: Shieldino Lights. Lights used to illuminate any
private residential swimming pool shall be so arranged and shaded as
to reflect light away from adjoining premises.
SECTION 10: Unnecessary Noise. It shall be unlawful for any
person to make, continue or cause to be made or continued at any
private residential swimming pool any loud, unnecessary or unusual
noise or any noise which annoys, disturbs, injures or endangers the
comfort, repose, health, peace or safety of others. In the
operation of a private residential swimming pool the use or permitting
the use or operation of any radio, musical instrument, phonograph
or other machine or device for the producing or reproducing of sound
_in such manner as to disturb the peace, quiet and comfort of the
neighboring inhabitants or at any time with louder volume than is
necessary for convenient hearing of the person or persons who are in
the swimming pool or on the pool premises, shall be unlawful.

SECTION 11: Indecent Exposure. Every person using an outdoor private
residential swimming pool must wear a bathing suit or other suitable
garment to protect his person from indecent exposure.
SECTION 12: Penalty. Any person, firm or corporation violating
any of the provisions of this ordinance shall be fined not less than
$10 nor -more than $200. Each day any violation of this ordinance
continues shall constitute a separate offence.
SECTION 13: Severability. The intention of the City Council is
hereby expressed that this ordinance is severable and that the
invalidity of any section hereof or of any portion of any section
hereof, shall not affect any other section or portion of section of
this ordinance.
SECTION 14: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 15: This ordinance shall be in full force and effect
from and after its passage, approval and publication,
according to law.
