HomeMy WebLinkAbout20-O-596` 9 p 1 20-0-59 AN ORDINANCE Amending Sections 27-97 and 27-98 of the Code of the City of Evanston, 1957• BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EQTANSTON, COOK COUNTY, ILLINOIS: SECTION 1: That Sections 27-97 and 27-98 of the Code of the City of Evanston, 1957, be and the same are hereby amended so as to read. as follows: Section 27-97:. To facilitate the cleaning of streets and public thoroughfares within the City of Evanston; the City of -Evanston is hereby divided into five (5) District Areas. It shall be unlawful, where parking is not otherwise p rohibited, for any person to stop, stand, park or leave unattended a motor vehicle on any street or public thorough- fare within the districts hereafter described between the hours of 2::00 o'clock A.M. and 6:00 o'clock A.M. on the days and months as follows: (a) On the south side of all streets and public thoroughfares extending east and west, and on the west side of all streets and public thoroughfares extending north and south on each Monday; on the north side of all streets and public thoroughfares extending east and west and on the east side of all streets and public thoroughfares extending north and south on each Tuesday; during the months of April, May, June, July, August, September and October, included in that district area described as follows: All that part of the City lying south of the north property line of Main Street and west of the center line of the right-of-way of the Milwaukee Division of the Chicago and Northwestern Railway Company. (b) On the south side of all streets and public Thoroughfares extending east and west, and on the west side of all streets and public thoroughfares extending north and south on each Tuesday; on the north side of all streets and public thoroughfares extending east and west and on the east side of all streets_ and public thoroughfares extending north and south on each Wednesday, during the months of April, May June, July, August, September and October, included in that district area described as follows: All that part of the City lying east of a line des- cribed as follows: Commencing at a point being the center line of the right-of-way of the Milwaukee Division of the Chicago and North Western Railway Company and the south City limits; thence northerly along said center line of said right-of-way to its intersection with the west property line produced south of Ridge Avenue; thence northeasterly along the west property line of Ridge Avenue and the same produced north to the north City limits; thence east along.the north City Limits to the center line of Sheridan Road; thence north along the center line of Sheridan Road to the north City Limits. (c) On the south side of all streets and public thoroughfares extending east and west, and on the west side of all streets and public thoroughfares extending north and south on each Wednesday; on the north side of all streets and public thoroughfares extending east and west and on the east side of all streets and public thoroughfares extending north and south on each Thursday; during the months of April, May, June, July, August, September, and October, included in that district area described as follows: All,that part of the City lying west of the center line of the right-of-way of the Milwaukee Division of the Chicago and Northwestern Railway Company, south of the north property line of Church Street and north of the north property line of Main Street. (d) On the south side of all streets and public thoroughfares extending east and west, and ,on the west side of all streets and public thoroughfares extending north and south on each Thursday*` on the north side of all streets and public thoroughfares extending east and west and on the east side of all streets and public thoroughfares extending north and south on each Friday; during the months of April, May, June, July, August, September and October, included in that district area described as follows: All that part of the City lying westerly of a line described as follows: Commencing at a point being the west City Limits and the center line of the north sore channel of the Sanitary District of Chicago; thence northeasterly along said center 11,ne of said Channel to its intersection with the center line of the right-of-way of the Milwaukee Division of the Chicago and NorthWestern Railway Company, thence northwesterly along said center line of said right-of-way to the north City Limits. (e) On the south side of all streets and public thoroughfares extending east and west, and on the west side of all streets and public thoroughfares extending north and south on each Friday; on the north side of all streets and public thoroughfares extending east and west and on the east side of all streets and public thoroughfares extending north and south on each Monday; during the months of April, May, June, July, August, September and October, included in that district area described asfollows: All that part of the City lying north of the north property line of Church Street, easterly of a line described as follows: Commencing at a point being the intersection of the north property line produced west, of,Church Street and the west City limits; thence north along said west City limits to its intersection with the center line of the North Shore Channel of the Sanitary District of Chicago; thence northeasterly along said center line of said Channel to its intersection with the center line of the right-of-way of the Milwaukee Division of the Chicago and North Western Railway Company; thence northwesterly along said center line of said right-of-way to the north C City limits; also westerly of a line described as follows: Commencing at a point being the north property line of Church Street and the center line of the right-of-way of the Milwaukee Division of the Chicago and North Western Railway Company; thence northwesterly along said center line of said right- of-way to its intersection with the west property line produced south of Ridge Avenue; thence north- easterly along the west property line of Ridge Avenue and the same produced north to the north City Limits. Section 27-98.0: To facilitate the cleaning of and snow removal from streets and public thoroughfares within the City of Evanston, it shall be unlawful, where parking is not otherwise prohibited, for any person to stop, stand, park or leave unattended a motor vehicle on any street or public 682 thoroughfare, from November 1 to March 31 inclusive, between the hours of 2:00 o'clock A.M. and 6:00 o'clock A.M. as follows: (a) On the south side of all streets and public thoroughfares extending east and west, on Monday, Wednesday, and Friday of each week during the months of November, December, January, February, and March; (b) On the north side of all streets and public thoroughfares extending east and west, on Tuesday, Thursday and Saturday of each week during the months of November, December, January, February and March; (c) On the east side of all streets and public . thoroughfares extending north and south, on Monday Wednesday and Friday of each week, during the months of November, December, January, February and March; (d) On the west side of all streets and public thoroughfares extending north and south on Tuesday, Thursday and Saturday of'each week, during the months of November, December, January, February and March. Section 27-98.1: Nothing in this ordinance shall be construed as prohibiting physicians or emergency cars of any other person operating au thiorized emergency cars while engaged in their duties, from parking a vehicle in such designated areas during any emergency. Section 27-98.2s The provisions of this ordinance shall only be enforced where notice of this ordinance is given by appropriate signs erected upon or at the entrance of the street or public --thoroughfare or part thereof affected, and in com- pliance with Chap. 952 Ill. Revised Statutes, Article II, Section 123.. Section 27-98.3: Any person, firm or corporation who violates any of the provisions of Sections 27-97 and 27-98 Incl. of the Code of the City of Evanston, 1957s shall be guilty of a misdeameanor, punishable by a fine of not less than $3.00, nor more than $200.00. Any violator may avoid prosecution for violating this ordinance by paying to the Clerk of the Municipal Court, the minimum penalties herein provided, and 6 O e3 before legal action has been brought against the violator, surrenddring the traffic ticket or other notice of violation, either received or placed upon such vehicle. Any person making such payment shall receive a receipt therefor from the Clerk of the Municipal Court. SECTION 2. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. Intention of the City Council is hereby expressed that the provisions of this ordinance are severable and that the invalidity of any section hereof or of any portion of any section hereof, shall not affect any other section or portion of section of this ordinance. SECTION 3: This ordinance shall be in full force and effect thirty (30) days from and after its passage, approval and publication, accordimg to law.
