AN ORDINANCE
To acquire certain property
by condemnation
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EVANSTON:
SECTION 1: That it is necessary, convenient
and desirable for the City of
Evanston to acquire title to`and possession of certain real
property lying wholly within the limits of the City of Evans-
ton, which real property is hereinafter described in Section
665
2 of this Ordinance, for the. purpose of laying out,
establishing, constructing and maintaining a park in the
City of Evanston, State of Illinois, and for park purposes.
SECTION 2: The property necessary, conven-
ient and desirable to acquire
for the purposes set forth in Section 1 of this Ordinance
is, more fully described as follows:
Lot 66 in George F. Nixon & Co.ts Dodge Avenue
Rapid Transit Subdivision in the southeast
quarter of the northwest quarter of Section 25,
Township 41 North, Range 13 east of the Third
Principal Meridian, in Cook County, Illinois,
according to plat thereof.recorded November 30,
1925, as Document No. 9110906,
SECTION 3: That the Director of Public Works
of the City of Evanston be and he
hereby is authorized to negotiate with the owners of said Lot
166 for the acquisition of fee simple title to said real pro-
perty for said park and park purposes.
SECTION 4: In the event that said property
cannot be acquired as the result
of negotiations, fee simple title to and possession of said
real property specifica7.ly described in Section 2 of this
Ordinance shall be acquired by the City of Evanston and the
Corporation Counsel for the City of Evanston is hereby auth-
rized, empowered and directed to institute proceedings in
any court of competent jurisdiction to acquire fee simple
title to and the possession of said property for the City of
Evanston in accordance with the Eminent Domain laws of the
State of Illinois.
SECTION 5: This ordinance shalltake effect
and b e in full force from and
after its passage.
