WHEREAS, the City of Evanston lying immediately north of and adjacent to the City of Ehicago, has,its.streets and public thoroughfares traversed daily by hundreds of thousands of,motor vehicles; and WHEREAS, the amount of motor vehicle traffic traversing certain streets of the City of Evanston has created unusual traffic" problems, and the necessity for taking additional precautions in order to prevent accidents, in juriest,and loss of life; and WHEREAS, in the opinion of the City Council of -the r City of Evanston, the operation of motor shooters, motobikes, motor driven.•Eycles, and bicycles driven'by muscular power upon certain streets and highways within the City of Evanston is dangerous and creates an unnecessary traffic hazard to the operators of automobiles as weel as to the citizens of this community;•and t WHEREAS.,, it is,deemed necessary that th'e City Council of the City of Evanston enact an adequate police power ordinance to restrain the.operation of motor scooters, motor bikes, motor -driven cycles, and bicycles upon certain public streets and highways within -the City of Evanston in order to maintain the .safety and general welfare of the inhabitants of this city:. NOW THEREFORE, BE IT.ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON: Section 1: That Section 27-176 of Article IX ."Motor Vehicles and Traffic" of the Cade of the City of. Evanston, 1957, be and the same is hereby amended so_that the same shall hereafter be and read, as follows: - Section'27-176.0 - Operation of certain vehicles -upon certain streets prohibited It shall be unlawful for any person to operate a motor scooter, motor driven cycle, or bicycle with motor -attached., any of which motor vehicles produces not to exceed five (5) brake horsepower, or any bicycle operated by muscular power, upon or along any of the following named strets and public thorough- fares within the City of Evanston, which have been determined by an official traffic survey as being heavily traveled by automobiles, or trucks, or -both, and upon which the oper- ation of motor scooters, motor driven cycles, or bicycles with motor attached, or bicycles - driven by muscular power, -is hazardous and dangerous to the citizens -of this community as well as to the operators of said vehicles: Sheridan Road - South City Limits to Burnham Place Sheridan Road - Greenwood to North City Limits Burnham Place - Lake.Shore Drive to Forest Ave. Forest Place - Sheridan -Road to Davis Street Forest Avenue - Davis Street to Main Street Hinman A -venue - University Place to South Blvd. Chicago Avenue - Howard Street to University P1. Section 27-176.1 - Restriction as to passengers; It shall be unlawful for more than one person to ride, drive, or be a passenger upon a motor scooter, motor driven cycle, or bicycle with motor attached, any of which produces not to exceed five (5) brake horsepower, or bicycle operated by muscular power, unless such vehicle is equipped with a permanently attached seat and designed for the carrying of an additional passenger to the rear or side of the operator. Section 27-176.2: - Operations in Public Alleys Restricted Any vehicle, as described in sections 27-176.0 or 27-176.1, shall be operated only on public streets and thoroughfares available for such vehicular traffic, and shall not be operated in any public alley for the purpose of evading any of the provisions of Section 27�176.0, wherein the operation of said vehicles upon certain streets is prohibited, or the provisions of Section 27-77 of the Code of the City of Evanston, 1957, but may be operated in a public alley for the purpose of obtaining ingress to or egress from property abutting on said public alley: SECTION 2: Any person, firm or corporation who violates any of the provisions of this ordinance shall be fined in accordance with Section 1-4 of the Code of the City of Evanston, 1957• SECTION 3: That all ordinances or parts of ordinances in conflict herewith afe hereby repealed.
