HomeMy WebLinkAbout20-O-58607 20-0-58 AN ORDINANCE Regulating Drive -In -Restaurants WHEREAS, Drive -In Restaurants have been the source of loud, raucous, and disturbing conduct during late hours of night; and WHEREAS, Drive -In Restaurants have caused large areas of resideptial neighborhoods to be -strewn with napkins, straws, paper cups, plates, bottles, cans and other similar waste products; and WHEREAS, police department reports have indicated an abnormally high crime rate, including assault and battery, burglary, and attempted kidnapping in the immediate environs of aforesaid Drive -In Restaurants; and WHEREAS, there has been an inrodinately large congregation of intoxicated persons frequenting the aforesaid Drive -In Restaurants and consuming intoxicants on or near the premises; and WHEREAS, the owners, managers, and operators of aforesaid Drive -In establishments.have been unable to restrain the undesirable conduct of their patrons in the absence of an effective ordinance: . _ NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS: ` SECTIONl: That there be added to Article II of Chapter 19 "Restaurants and Food Dispensers" of the Code of the City of Evanston, 1957, Sections 19-54.1 to 19-54.9 inclusive, providing for the regulating of Drive -In Restaurants so that said sections shall be and read as follows : 19-54.1: Definition. A Drive -In Restaurant, for the purposes of this ordinance 'is defined as any establish- ment where food (including frozen dessert), or beverage is sold to the consumer,,, where ancautomobile parking area is provided, and where such food or beverage is intended to be consumed.in the automobile parked in the parking area or at a stand-up counter. 19454.2: Disposal of Refuse and Debris. Each Drive-In.Restaurant shall, at lease once in each twenty-four (24) hour period, dispose of all paper, cups, plates, napkins, garbage and other waste material accumulated. upon the premises. It shall be the duty of the owner, manager, or person in charge of said Drive -In Restaurant, to keep the premises in and about said restaurant including the parking area ddjoinin g thereto, at all times, free from rubbish, waste products and debris inclu- ding napkins, straws, paper cups, plates, bottles, cans and other similar waste products. 19-54.3: UNnecessary Noise. No patron of a Drive -In Restaurant, or any other person, while driving a motor vehicle upon or standing, stop- ping or parking such vehicle in the parking area adjoining any such Drive -In Restaurant, shall race the motor of any such motor vehicle, cause any horn to be blown except as a traffic warning, or make or cause to be made any other loud or. unnecessary noise or disturbance upon said premises. 19-54.4: Intoxicating Liquors. No person upon the premises of any Drive -In Restaurant or in the parking area adjacent thereto, whether in or out- side an automobile, shall drink, have in his possession or under his control, or offer or give to another to drink, any wine, beer or intoxicating liquor. 19-54.5: Premises to be kept Free of Refuse. No person shall places throw or -deposit any food, beverage, paper, bottle, cans, or similar waste materials upon the permises of any Drive -In Restaurant, -or in the parking area adjacent thereto, unless such waste material be placed in a waste receptacle which shall be conveniently provided upon said permises or parking area. - 19-54.6 : Serving Hours. It shall be unlawful for any patron to be served, or to consume any food or beverage upon the premises of any Drive -In Restaurant between the hours of 12:,00 midnight and 7:00 a.m. 19-54•7: Operations Subject to Other Ordinances. Every owner, manager or person in charge of a Drive - In Restaurant shall be subject in the operation of said Drive -In Restaurant to any and all other applicable ordinances. 19-54.8: Severability. The intention of the City Council is hereby expressed, that the provisions of this ordinance are severable and that the invalidity of any section hereof or of any portion of any section hereof, shall not affect any other section or portion of section of this ordinance. 19-54.9: Penalties for Violation. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction shall be fined not less than Twenty- five Dollars ($25.00) nor more than Two Hundred Dollars ($200.00) for each offense. Each day that A violation continues shall be deemed a separate offense. SECTION 2: after its passage, approval INTRODUCED PASSED ATTEST: City Clerk Approved as to form: Publication.
