HomeMy WebLinkAbout11-O-5811-0-58 ./ AN ORDINANCE Authorizing the Leasing of Certain Sub -sidewalk property to Washington National Life Insurance Company. WHEREAS, the City of Evanston, under date of March 3, 1950 entered into a purpoted lease with the Washington National Life Insurance Company, permitting them to occupy certain sub -sidewalk space on Chicago Avenue, south of Church Street; and WHEREAS, it appears that said purpoted lease was for a term of fifty (50) years and not executed in accordance with Chapter 24, Section 59-2 of the Illinois Revised Statutes; and WHEREAS, Wa shin gton-National Life Insurance Company are requesting a lease from the City of Evanston for additional sub -sidewalk space on Chicago Avenue contiguous to that sub - sidewalk space now occupied by them; and WHEREAS, it is desirable to remedy the error in connection with_the execution of the first purpoted lease and combine said sub -sidewalk space with the additional sub -sidewalk spaceā€¢ requested:: NOW THEREFORE, BE IT ORDAINED BY'THE CITY COUNCIL OF THE CITY OF EVANSTON : SECTION 1: That in accordance with Chapter 24, Section 59-1 of the Illinois Revised Statutes.. -the City Manager is authorized and'directed to enter into a --lease with Washington National Insurance Company for sub -sidewalk space for a period not exceeding twenty (20) years, same being that portion under the sidewalk on Chicago Avenue, south of Church Street, being - N 0 595 A' strip of land, east of and adjoining Lots 15 and the south 50 feet of Lot 16, being 17 ft. 71 inches on the north and 17 ft. 7 3/4 inches on the south, all in Block 19, Village of'Evanston, all in Section 18, Township 41 N., Range 14, in the City of _ Evanston, also that portion under the sidewalk of Chicago Avenue, aouth of Church Street, being A strip of land, east of and adjoining Lot 14 and the north 44 feet of Lot 13, being 12 _ feet 7-3/4 inches on the north and 12 feet 8 1/2 inches 6n the south, all in Block 19, Village. of Evanston, all in Section 18, Town- ship 41 N., Range 14, all in the City of Evanston, e and upon the following terms and conditions, among others as follows: 1. That the purpoted lease dated March 3, 1950 be cancelled. 2. That the rental for said combined premises by Two dollars ($2.00) a year, payable annually in advance. 3. That the City be furnished with a perpetual surety bond holding the City harmless against any claims for property damage in the amount of $10,000, and any claims for personal injuries, in amount of $50,000. 4. That the form of lease and surety bond and other conditions of said lease, be in such form as shall be approved by t he Corporation Counsel. SECTION 2: approval.
