HomeMy WebLinkAbout08-O-580040166 6 8-0-58 J AN ORDINANCE Providing for the Licensing of Dry Cleaning Establishments BE IT ORDAINED BY THE CITY COUNCIL OF THE EVANSTON, COOK COUNTY, ILLINOIS: . SECTION 1.1. CITY OF That there be added to Chapter 25 "Licenses and Occupation Taxes" of the Code of the City of Evanston., Illinois, 1957, Sections 25-17 to 25-19 incl. providing for the licensing of dry cleaning establishments, so that said sections shall read as follows: Section 25-17. License required - business defined. It shall be un"lawfui for any person',r firm or corpor- ation, to engage in or carry on within the City of Evanston, the business of dry cleaning in which gasoline, naptha, benzine or other volatile inflam- mable -fluids or carbon tetrachloride, are used to clean or renovate any clothing or articles of wearing apparel or any fabric of any kind, without first obtaining a license, as hereinafter provided, for each dry cleaning establishment, proposed to be conducted by such person, firm or corporation. Every person, firm or corporation;. -keeping or using more than two quarts of gasoline, naptha, benzine, carbon tetrachloride, or any other volatile inflam8 mable liquids or other solvents for the purpose above mentioned, for profit or hire, shall be held.and is hereby declared to be.a dry cleaner., for the purpose of this ordinance. Section 25-18 Application. Application_ for a license to conduct a dry cleaning business as hereinabove defined, shall be made in writing to the City Collector and approved by the ,City Manager. The application shall contain the name of the applicant, if an individual, the names of the principal officers, if a corporation, the location of the place at which it is desired or intended to carry on such dry cleaning business, together with a description of the place of business for which a license is desired. A separate license shall be required for each dry cleaning establishment carried on or conducted by any applicant wherever located in- the City of Evanston. Before a license shall be issued each such application shall be approved by the Director of Building and the Fire Marshal. The Director of Building shall determine that all the requirements of the Boca Basic Building Code, the Zoning Ordinance, the Plumbing Code, and the Electrical Code of the City of Evanston are complied with and that the premises are safe for the 589 purposes of said building. The Fire Marshal shall determine that all fire hazard precautions have been taken and conform to the Fire Prevention Ordinance of the City of. Evanston. If it shall appear from the appli- cation so filed and approved by the Director of Build- ing and the Fire Marshal as hereinabove provided, then upon the payment of the license authorizing said applicant to engage in or carry on the business of dry cleaning in the place designated in the license and for the period herein stated. Section 25-19 License Fee - Expiration, etc. The license fee for engaging in or carrying on the business of dry cleaning as defined in this ordinance is hereby fixed at $25 per annum. Every such.license shall expire on the 31st day of December in the year in which it is issued, provided however, that if less than six months of the annual license period shall have'expired at the time when such license is issued, "the full license fee shall be charged therefor. If six or more months of the annual license period shall have expired, one-half of the full license fee shall be charged. Said license shall be posted and remain posted in a conspicuous place in the room where the dry cleaning is done. SECTION 2: All ordinances or parts of ordinances in conflict her with are hereby repealed. SECTION 3i Any person, firm or corporation whoviolates any of the provisions of this ordinance shall be punished by a fine in accordance with Section 1-4 of the Code of the City of Evanston, 1957• Each day a violation of the provisions of this ordinance shall continue, shall constitute a separate offense. SECTION 4: This ordinance shall be in full force and effect from and after its passage, approval and publication., according to law.
