Maintenance, end Operation of
Frivate Residential Swimming Fools.

BE IT ORDAMD BY THE 'ITY COUNCIL OF THE CITY OF EvANSTON,
COOK COUNTY, ILLINOIS :

SECTION 1:, Short Title. This ordinance shall be known
and may be cited as the private Residential
Swimming Fool Ordinance of the amity of Evanston.
SECTION 2: Definition. Frivate Residential Swimming
Fool, Ps regu.lated by this ordinance, shall
mean any swimming or weding pool over 2 feet in depth, or with a
surface area+ exceeding 250 square feet, locp.ted upon private resi-
dential in connection with a private residence, and intended
property
only for the use of the individual owner, his family and friends.
This shall include portable or temporary type pools installed
entirely above ground elevation except.that the provisions of Sections
4 And 5 (a) shall not apply to sn.id pools. The provisions of this
ordnance shell apply to all existing or new swimming pools as
defined in this ordinance, except where otherwise indicated.
SECTION 3: Location. Private Residential Swimming
Fools, as regulated by this ordinance,
shall be permitted in residential zones as defined by the present

or hereafter adopted zoning ordinance. No portion of any private
residential swimming pool shall be located at a distance less than
8 feet from any side or rear property line or building line. Pumps,
filters and water disinfection equipment installation shall be
located at a distance of not less than 6 feet from any rear or side
property line. Pools and appurtenant equipment shall not be per-
mitted in any required side yard between buildings. The provisions
of this section shall not apply to private residential swimming
pools of a permanent nature, constructed prior to the effective
date of this ordinance.
SECTION 4: Permits Required. (a) Installation Permit.
It shall be unlawful to install, enlarge, or alter any private
residential swimming pool within the City of Evanston unless a
permit therefor shall first have been obtained from the Director
of Building. The permit fee for the erection, construction or
alteration of a private residential swimming pool shall be $10 for
each 250 square feet or fraction thereof surface area to be contained
within the proposed pool as determined by the plans and specifications
submitted with the application for permit.
(b) Operation Permit: A permit to operate and maintain a private
• residential swimming pool shall be required. Such permits shall be
applied for annually, and whenever a pool is reopened for swimmers'
and waders' use or operation after being closed three months or more.
Application for an operation permit shall be made to the Director of
Health who shall cause said pool to be inspected before any operation
permit is issued.
The operation permit fee shall be $10 annually. If
three or more inspecticns are required to enforce compliance with
the provisions of this ordinance, an additional fee of $10 for the
third and for each successive inspection during any one calendar
year shall be paid by the operator of said pool. Operation permit
fees shall be payable to the City Collector.
SECTION 5: Pool and Appurtenance Construction.
(a) Drawings and Plans. All drawings and
plans for the construction, installation, enlargement or alteration

• of any private residential swimming P PP pool and appurtenances shall
be presented to the Director of Building for examination and
approval as to location and construction. All drawings shall
be complete, showing the lot lines and including information per-
taining to fence construction, water supply system, liquid capacity,
drainage and water disposal system and all appurtenances to the
pool.
(b) Material and Structural 'Design. Private residen-
tial swimming pools shall be constructed of impervious material.
The pool structure shall be designed to withstand the water pres-
sure from within any' to resist pressure of the earth when the
• pool is empty, aga..inst the forces to which it will. be subjected.
No pool shall be constructed in such proximity to adjoining

property as to cause a weakening of any adjoining foundations
or collApse of soil.
(c) Compliance with Flumbiniz and Electrical Codes.
Frivate residential swimming pools, as controlled by this or-
dinance, shall comply with the present or hereafter adopted
Evanston Flumbing or Electrical Codes. No current carrying
electrical conductors shall cross private residential swimming
pools either overhead or underground. All metal fences, enclo-
sures, or railings near or adjacent to said pools, which might

become electrically alive as a result of contact with broken over-
head conductors or from any other cause, shall be effectively
grounded.
(d) Fences. All outdoor private residential swim-
ming areas or areas in which the pool is located shall be completely
enclosed by a fence or other physical barrier adequate to restrain
children. All openings or points of entry into pool area enclosure
shall be equipped with gates. All gates shall be equipped with
self -closing and self -latching devices placed where they are in-
accessible to small -children,
• (e) Steps or Ladders. There shall be one or more

means of egress in each pool. Steps or ladders shall be constructed
so as to be safe and sanitary. Recesses which may support vegetable
or animal life shall be avoided.
(f) Divinq Boards. Diving boards or platforms more
than one meter (39.37 inches) above water level shall be approved
by the Public Health Director prior to installation.
(g) Floor Slope. Floor slope in the shallow end
of the pool (up to 4� feet) shall be sufficiently gradual to avoid
slipping into deep water.
(h) Water depth in Pools with Varyinq Depths.
Markings showing the depths of the deep and shallow ends of the
pool shall be plainly visible.

(i) Skimmers. All private residential swimming
pools shall be equipped with hand or automatic skimmers or approved
over -flow gutters.
(j) Rescue Equipment. Every private residential
swimming pool shall be equipped with rescue equipment including at
least one or more light, strong; poles &pith blunted ends not less
than twelve feet in length or two-thirds of the diameter for circular
pods, making reach assistance or rescues.
(k) Indoor Swimming Fools. Indoor swimming pools
in addition to the relevant or pertinent requirements promulgated
for outdoor pools must also have approval of the Director. of Buildirg
• Department in relation to ventilation, natural Rnd Artificial
lighting and the use of structural material.
SECTION h: S?nitpry Requirements)
(,a) Grater S�,ipply. No source of water other than that
secured from the City of Evanston '•?a.ter Works Distribution system
shall be used in private residential swimming pools unless advance
approval of the source and installation of the water supply is
obtained from the Department of Health. Any source of wster (public
or private) used to fill the pool shall be equipped with protection
against accidental backflow or back siphone.ge from the pool water.

Its protection shall be in the nature of a free -fall gap or other
device that would meet the approval of the Director of the Depart-
ment of Building.
(b) Water Treatment. Chlorine disinfectant in the form of
sodiinn or calcium hypochkrite shall be applied either by hand or by
mechanical feeder as frequently as needed to assure at least 8.3
of a part per million of chlorine residue throughout .the pool volume
while the pool is in use. Other recognized or accredited methods
of disinfecting the pool water shall be permitted providing advance
approval is grantel by the i'vanston Department of Health.
(b)-(1) Acidity - A1ke.linity pH. The water shall show a
• neutral or alkaline reaction as inJice.ted by a pH of 7.0 to 8.0 at
all times *chile the pool is in use.
(b) (2) Test Kit. A test ':it with permanent color standards
shall be provided At All pools and be uses' a.t frequent intervals to
check on the adequacy of disinfection and to determine the acidity
or alkalinity of the water.
(c) Water Clarity. Whenever the pool is in use the water
shall be sufficiently clear to permit a black disc or disc of con-
trasting color 12 inches in diameter on the bottom of the pool, at
the deepest point, to be clearly visible from the adjacent pool
sidewalks.

(d) Waste Vater. Disposal or discharge of pool waste
water must be accomplished in such a way that nuisance or damage
to other property is avoided. When discharged into storm or sanitary
-sewers, care must be taken to avoid overtaxing the capacity of
such sewers.
SECTION 7: Sanitation of Premises. The buildings,
grounds, and all other pool facilities shall be kept clean and in
a sanitary condition and maintained free from garbage, trash and
other refuse.

• No private residential swimming pool shall be so located, designed,
operated or maintained as to interfere unduly with the enjoyment
of property rights by owners of property a=iioining the pool or
located in the neighborhood.
SECTION 9: Shielding Lights. Lights used to illum-
inate any private residenti.a.l swimming pool shall be so Arranged
and shaded as to reflect light a-,rAy from adjoining premises.
SECTION 10: Unnecessary Noise. It shall be unlawful
for any person to make, continue or cause to be made or continued
at any private residential swimming pool any loud, unnecessary or
unusual noise or any noise •Aiich annoys, disturbs, injures or

endangers the comfort, repose, health, peace or safety of others.
In the operat-ion of a private residential swimming pool, the use
of permitting the use or operation of any radio, musicAl instrument,
phonograph or other machine or device for the producing or repro-
ducing of sound in such a manner as to disturb the peace, quiet and
comfort of the neighboring inhabitants or at any time with louder
volume than is necessary for convenient hearing of the person or
persons who are in the swimming Fool or on the pool premises, shall
be unlawful.
SKTION 11: Indecent Exposure. Every person using
an outdoor private residential swimming pool must wear a. bathing
suit or other suitable garment to protect his person from indecent
exposure.
SECTION 12: Ienalty. Any person, firm or corpor-
ation violating any of the provisions of this ordinance shall be
fined not less than $10 nor more than $200. Each day any violation
of this ordinance continues shall constitute a separate offense.
The Director of Health or his representative is hereby empowered
to inspect any of the said pools at reasonable times to determine
compliance with the provisions of this ordinance.

SECTION 13: Severability. The intention of the
City Council is hereby expressed that this ordinance is severable
and that the invalidity of any section hereof or of any portion
of any section hereof, shall not effect any other section or
portion of section of this ordinance.
SE 'ION 14: All ordinances or parts of ordinances
in conflict herewith are hereby repealed.
