AN ORDINANCE
Amending Sections 43-12, 43-16, 43-20,
43-26, 43-27, 43-28, and 43-29, of
Article II "Licenses of Public Passenger
Vehicles" and Sections 43-39, 43-42 and
43-45 of Article III "Public Vehicle
Drivers and their Licenses" of the Code
of the City of Evanston, 1957.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON,
COOK COUNTY, ILLINOIS-.
SECTION 1: That Sections 43-12,, 43-16, 43-20,
43-26, 43-27, 43-29 and 43-29 of
Article II "Licenses of Public Passenger Vehicles" and Sections
43-39, 43-42 and 43-45 of Article III "Public Vehicle Drivers and
their Licenses" of the Code of the City of Evanston, 1957, be and
• the same are hereby amended so that same shall hereafter be and
read as follows,
Section 43-12: Applications for all types of Public Passenger
Vehicle Licenses shall be made by the owner and operator upon
forms furnished by the City Collector. Such applications shall
be addressed to the City Collector and shall contain the full
name and address of the owner and operator, the officers of a
corporation or members of a partnership, information as to
financial responsibility, names of sureties signing bonds of
applicant or the name of the company issuing public liability
policies as required by the state law, a complete description
of the vehicle for which the license is desired, including
kind and make of vehicle, motor and serial number, seating
capacity, excluding driver's seat or any part thereof, state
license number, car number, motor number, color of vehicle and
horsepower, and such other data as the city council may prescribe.
Before any such Public Passenger Vehicle license is issued
or renewed, in addition to the foregoing, inquiry shall be
made into the applicant's qualifications as follows:

(a) That the financial responsibility, experience, character,
and general fitness of the applicant are such as to
command the confidence of the public and to warrant
belief that the business will be operated lawfully and
honestly and in a manner calculated to protect the
health, safety, morals, and general well-being of the
public at all times.
(b) If the applicant is a partnership each partner shall
meet the character and general fitness requirements;
if the applicant is a corporation, each officer and
each director, and each manager and each shareholder
owning 10 per cent or more of the shares shall meet
the character and general fitness requirements.
Section 43-16° The annual license fees shall be as follows,
and said licenses shall expire on the 31st day of December
following date of issuance°
Rent -a -Car . . . . . . . . . . . . .$15 per annum
Taxicabs and Livery Cabs . . . . . . . . . ....$66 per annum
Sight-seeing vehicles, motor coaches
or buses other than those operated
• by a duly licensed public utility . . . . $20 per annum
Section 43•-20.- The words "Mayor" shall be deleted and the
words "City Manager" inserted in lieu thereof.
Section 43-26u The words "City Council" and the words "City
Council in its discretion may recommend to the Mayor that
the license for such taxicab be revoked and the Mayor in his
discretion may revoke the same" shall be deleted and the
words "City Manager may revoke the same" be inserted in
lieu thereof.
Section 43-27° For the purpose of enabling the city to inform
itself as to the character and quality of service rendered the
public and the just and reasonable uniform rates of fare to be
fixed from time to time by the council and for determining
whether the licensee is maintaining adequate reserves to meet
personal injury, death and property damage claims, the City
manager or his agent shall have access to the plant, equipment,
apparatus and other property and the inventories, books,
papers, accounts and records of all property and operations
of the licensee at all reasonable times. Every licensee,
at all times, shall keep in the city complete and accurate
books and records of all property, operations, -receipts and
disbursements, in such form and detail as may be.prescribed,
from time to time by the City Manager. Every licensee whenever

called upon by the city council or the City Manager, shall
file such other information as may be required by them.
All statements required to be filed pursuant to this section
shall be sworn to by the licensee or his duly authorized agent.
Section 43-28° In the event that the City Manager after
investigation and hearing -
(a) sha11 determine that any licensee has obtained any
license for any taxicab or other public passenger vehicle
by fraud or false representation or misstatement of facts,
or fails to carry out any promise made before the issuance
of such license, or -
(b) the licensee, either knowingly or without the exercise
of due care to prevent the same, has violated any provision
of this ordinance or any regulation or order lawfully made
pursuant to and within the authority of this ordinance; or that
(c) any fact or condition exists which, if it had existed or
had been known to exist at the time of the original appli-
cation for such license, clearly would have justified the
city in -refusing originally to issue such license, the City
Manager may revoke such license and shall report said revo-
cation to the City Council with his reasons therefor.
• Section 43-29; Delete the words "City Council" and "Mayor"
and insert the words."City Manager," in lieu thereof.
Section 43-39- The fee for a pubic vehicle driver's or
operator's license shall be $5 per annum for the original
application and $3 per annum for the'next three succeeding
annual renewals. Each annual license shall expire on the
31st day of December following date of issuance.
Section 43-42 That Section 43-42 be and the same is hereby
repealed.
Section 43-45° The words "Mayor or the"City Council" shall
be deleted and the words "City Manager" be inserted in lieu
thereof.

its passage, approval and publication, according to law.
