I3E IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EVANSTON, COOK COUNTY, ILLINOIS° SECTION 1° That Sections 25-17 to 25-19 inc., of the Code of the City of Evanston 1957, as amended, providing for the licensing of dry cleaning establishments, be amended so that said ordinance shall provide as follows° Section 25-17 - License Required - Business Defined: It shall be unlawful for any person, firm or corporation to engage in or carry on within the City of Evanston the business of dry cleaning as herein defined, in which • gasoline, naptha, benzine or other volatile, inflammable fluids, or carbon tetrachloride are used to clean or renovate any clothing or articles of wearing apparel, or any fabric of any kind, without first having obtained a license as herein provided for each dry cleaning estab- lishment proposed to be conducted by such person, firm or corporation. (a) Dry Cleaner, shall mean any person, firm or corpor- ation keeping or using more than two (2) quarts of gasoline, naptha, benzine, or any volatile inflammable liquids or other solvents, for the purpose of dry cleaning wearing apparel or fabrics, for profit. (b) Spotter, shall mean any person, firm or corporation keeping or using less than two (2) quarts of the aforesaid described liquids for the purpose of dry cleaning or spotting wearing apparel or any fabric, for profit. (c) Retail. Outlet, shall mean any establishment located within the city where dry cleaning is sold, solicited or offered for sale direct to the retail consumer, but the dry cleaning is done elsewhere than on the premises. 40 • 2 8I ti. (d) Self service coin operated, shall mean any estab- lishment providing mechanical coin operated devices for dry cleaning. Section 25-18 - Application- Application for a license to conduct the business of dry cleaning, spotter, retail outlet or mechanical or coin operated devices for the purpose of dry cleaning as hereinabove defined, shall be made in writing to the City Collector. The application shall contain the name of the applicant, if an individual, the names of the principal officers, if a corporation, the location of the place at which it is intended to carry on such business, together with a description of the place of business for which a license is desired. A separate license shall be required for each dry cleaning estab- lishment, spotter or retail outlet carried on or conducted by any applicant wherever located in the City of Evanston. Before a license shall be issued each such appli- cation shall be approved by the Director of Building and the Fire Marshal. The Director of Building shall determine that all the requirements of the Boca Basic Building Code, the Zoning Ordinance, the Plumbing Code, and the Electrical Code of the City of Evanston are complied with and that the premises are safe for the purposes of said business. The Fire Marshal shall determine that all fire hazard precautions have been taken and conform to the Fire Prevention Or- dinances of the City of Evanston. If the application :'.so filed is approved by the Director of Building and the Fire Marshal as hereinabove provided, then upon payment of the license fee hereinafter provided, the City Collector shall thereupon issue to said applicant a license authorizing said applicant to engage in or carry on the business of dry cleaning, spotter, or retail outlet, in the place designated in the license and for the period therein stated. Section 25-19 - License Fee. The license fees for the carrying on any of the businesses as defined in Section 25-17, shall be as follows° (a) Dry Cleaner, . . . . . . . .$25 per annum (b) Spotter and Retail Outlet . . . . .$10 per annum (c) Self Service Coin Operated . . . . .$15 per annum for each coin operated device maintained in the establishment. Each such license shall expire on the 31st day of December in the year in which it is issued, provided, however, that -2- • • 288 if less than six months of the annual license period shall have expired at the time when such license is issued, the full license fee shall be charged therefor. If six or more months of the annual license period shall have expired, one-half of the full license fee shall be charged. Said license shall be posted and remain posted in a conspicuous place in the room where the dry cleaning is done. are hereby repealed. SECTION 2� All ordinances or parts of ordinances in conflict herewith SECTION 3° This ordinance shall be in full force and effect from and after its passage, approval and publication, according to law.
